CAP calls for RCI on road accidents involving heavy vehicles

PETALING JAYA : The Consumers' Association of Penang (CAP) today called for the establishment of a royal commission of inquiry (RCI) to investigate the recent spate of road accidents involving heavy vehicles.
CAP president Mohideen Abdul Kader said in the first quarter of 2024 alone, there had been 652 accidents involving heavy vehicles, 287 of which resulted in fatalities.
The most recent fatal incident occurred on the East-West Highway on Monday, involving a bus that had been carrying a group of students from Universiti Pendidikan Sultan Idris (UPSI) back to their campus after the Aidiladha celebration.
Fifteen students died while many others were injured.
The following day, an express bus carrying 28 passengers including 13 students from Universiti Malaysia Pahang Al-Sultan Abdullah rammed into the back of a trailer on the East Coast Expressway. No casualties were reported in that incident.
Mohideen said the incident involving UPSI students had shaken public trust in the safety of express bus travel, which he described as an affordable and crucial means of long-distance travel for low-income individuals.
'CAP calls on the government to establish an RCI into the rising number of accidents involving heavy vehicles.
'The increase in road accidents involving heavy vehicles is a longstanding issue that has remained inadequately addressed for years,' he said in a statement.
Mohideen also urged the government to focus on increasing the safety of express bus travel as well as road safety in general.
He likewise backed calls for a ban on late-night bus travel, citing the fact that the UPSI incident had occurred in the early hours of the morning.
'Late-night bus travel increases the risk of accidents due to driver fatigue, and drivers are more susceptible to micro-sleep,' he said.
He said to tackle such fatigue, some drivers might resort to using unregulated stimulants to stay alert which could affect their judgment while driving.
'Additionally, some drivers may have the mentality of wanting to complete their last trip of the day quickly. This leads to a disregard for safety regulations, including speeding, dangerously overtaking other vehicles, and neglecting road safety laws and regulations,' he said.
He added that the mental well-being of heavy vehicle drivers should be routinely assessed to ensure safe travel for all.

JUNE 13 — Prime Minister Datuk Seri Anwar Ibrahim was charged in the High Court under Section 377A of the Penal Code with committing carnal intercourse against the order of nature against his then personal assistant, Mohd Saiful Bukhari bin Azlan (PW1). After the close of the defence's case, the High Court acquitted and discharged Anwar of the offence on the ground the DNA analysis done by one of the government chemists (PW5), could not be reconciled with the evidence of two experts called by the defence (DW2) and (DW4), thus casting a reasonable doubt on the prosecution's case. In addition, the trial court also held that since all the body swabs taken from PW1 at the Kuala Lumpur Hospital were individually put into plastic receptacles, labelled and sealed and all the receptacles were then sealed in a common plastic bag (P27) before being handed to the investigating officer, (PW25), the latter's action in later cutting open P27 to relabel the receptacles before sending them to the chemist had compromised the integrity of the samples. The trial judge held that since the court could not be absolutely certain the integrity of the samples had not been compromised before they reached the chemist, it was unsafe to rely on the DNA result obtained from the chemist's tests on the samples; hence there was no evidence to corroborate PW1's evidence on the factum of penetration, an ingredient of the offence. Former research assistant Muhammed Yusoff Rawther was discharged and acquitted by the High Court in Kuala Lumpur on June 12, 2025, of charges involving cannabis trafficking and possession of two imitation firearms. — Bernama pic On the prosecution's appeal, the Court of Appeal (COA) reversed the High Court's findings, convicted Anwar and sentenced him to five years' jail. Anwar appealed to the Federal Court. The prosecution cross appealed for enhancement of the sentence. The host of issues raised by Anwar before the apex revisited matters that were raised before the courts below and included contentions that PW1 was not a credible witness; that his evidence was not corroborated; that there was a break in the chain of custody of the exhibits; that DNA evidence that the appellant's semen/sperm were found on rectal swabs taken from PW1 was unreliable in view of the delay before the samples were tested; and that the COA had failed to consider or evaluate the Anwar's defence of political conspiracy. The last ground was based on the contention that PW1 had, two days before the offence, met with the then Deputy Prime Minister of Malaysia and on the same evening met with a high-ranking police officer at a hotel; that he then contacted the then Inspector General of Police the following day; that the day following the sodomy, and before lodging a police report, PW1 had met with four other persons which included a senator and a former national sprinter. After lengthy deliberations, the Federal Court dismissed Anwar's appeal and the prosecution's cross-appeal, hence affirming the decision of the COA on conviction and sentence. In short, Anwar was acquitted by the High Court. The acquittal was overturned by the COA. Anwar's conviction was finally affirmed by the Federal Court. It's a long, drawn out process to a finality. Expect the same in the acquittal of Anwar's former political aide Muhammad Yusoff Rawther who on Thursday (June 12) was acquitted and discharged by the High Court of two charges involving drug trafficking and possession of a fake firearm without being called to enter his defence. We recall that Kinabatangan MP Datuk Seri Bung Moktar Radin and his wife were acquitted and discharged by the High Court from three charges of corruption totalling RM2.8 million. The prosecution appealed to the COA which found merit in the prosecution's appeal. Hence, the couple was ordered to enter their defence. BATU PAHAT, June 13 — A lorry driver and his assistant died after being involved in an accident at Kilometre (KM) 81.9, North-South Expressway (PLUS), Southbound, yesterday morning. Batu Pahat district police chief, ACP Shahrulanuar Mushaddat Abdullah Sani said those who died in the accident at 8.30am were driver R Pubalan, 45, and his assistant, R Sivasanthiran, 35. According to him, initial investigations found that the incident occurred when the lorry carrying electronic goods, crashed into the back of a timber trailer. 'As a result of the collision, the timber lorry went on to crash into an oil tanker. 'The two victims, who suffered serious head, chest and leg injuries, were confirmed dead at the scene while the driver of the timber lorry who sustained minor leg and chest injuries was taken to the Sultanah Nora Ismail Hospital (HSNI), Batu Pahat. However, the driver of the oil tanker was not injured,' he said in a statement. Shahrulanuar said the case was being investigated under Section 41 (1) of the Road Transport Act 1987 and members of the public who witnessed the incident could come forward to any nearby police station. — Bernama

Acquitted ex-aide Yusoff Rawther gives police seven days to respond over ‘framing' claim, warns of legal action

KUALA LUMPUR, June 13 — Former research assistant Muhammad Yusoff Rawther has given the Inspector-General Of Police Tan Sri Razarudin Husain seven days to respond to a report he lodged last year claiming he was framed, warning of legal action if there is no update. Through a letter issued by the Law Practice of Rafique, Yusoff's legal team demanded that police explain the steps taken to investigate his September 2024 report, which named individuals he alleged were involved in a plot against him, according to a report published today in Free Malaysia Today. 'We await a response from you within seven days from today. Should there be no reply, or should the response fail to adequately address the issues raised herein, we reserve our client's right to pursue further legal action,' the letter read. Yusoff was acquitted yesterday by the High Court of drug trafficking and possession of two imitation pistols, having spent nine months in remand. His lawyer, Rafique Rashid Ali, reiterated that the drugs and weapons were planted and called on police to provide updates on the investigation into his client's allegations. Justice Datuk Muhammad Jamil Hussin ruled the prosecution had failed to establish a prima facie case, citing a lack of credible evidence and failure to prove the key elements of the charges. The judge also criticised two investigating officers for failing to act on Yusoff's claim, made during detention, that he had been framed, saying they had ample time to verify the statement but did not, which had prejudiced the defence. Yusoff's lawyer had first requested updates from authorities as early as November last year, following the initial report.
