ED attaches assets of Karnataka Cong MLA in KOMUL recruitment scam

New Delhi, Jul 17 (PTI) Assets worth Rs 1.32 crore of Karnataka Congress MLA K Y Nanjegowda have been attached in a case related to alleged irregularities in the recruitment for the Kolar-Chikkaballapur District Cooperative Milk Producers Union Ltd (KOMUL) in 2023, the Enforcement Directorate said on Thursday.
Nanjegowda, the MLA from Malur seat in Kolar district, is the chairman of KOMUL.
The ED said the recruitment process was held by KOMUL and it consisted of a written exam and interview. It was 'manipulated" in lieu of money and/or recommendation of political persons, the federal probe agency said.
The recruitment committee, led by Nanjegowda along with KN Gopala Murthy (KOMUL MD), conspired with other directors in the organisation and hatched a plan which resulted into favouring of certain less meritorious candidates and deprivation of the deserving candidates, the ED alleged.
A provisional order has been issued under the Prevention of Money Laundering Act (PMLA) to attach Rs 1.32-crore assets of Nanjegowda, it said.
The ED probe began in these alleged irregularities after it conducted raids in January against Nanjegowda and some others in a different case related to 'illegal" allotment of government land worth Rs 150 crore.
The agency made a reference of the alleged irregularities in KOMUL hiring to the Karnataka Lokayukta Police and also filed a complaint before the special court for trial of MP/MLA cases.
The agency said it seized OMR sheets, both original and tampered, WhatsApp messages received from politicians recommending certain candidates and forwarded by Nanjegowda, and other directors to the staff of KOMUL, during the searches.
It claimed 'procedural lapses" were observed in the entire recruitment process at KOMUL and also at the Mangalore University indicating efforts to hide irregularities.
The agency also claimed that admission by the directors and staff of KOMUL, Mangalore University Registrar Nagendra Prasad and certain candidates who were accommodated in the examination, has unearthed a 'mega scam" in KOMUL recruitment during 2023.
A sum of Rs 1,56,50,000 was generated as 'proceeds of crime" by manipulating the recruitment process both during the written exam and interview stages, in lieu of monetary benefit accepted from the candidates assuring them their selection in KOMUL, it said.
Nanjegowda emerged as the 'principal architect" of the 'scam", leveraging his role as Chairman of KOMUL to control the overall recruitment, the ED said.
Statements and evidence indicate that he played a 'leading" role in fixing the number of 'reserved" seats, orchestrating how bribes would be collected and directing the manipulation of written exam OMR sheets and interview scores to ensure recommended or paying candidates were selected, the agency claimed.
The MLA 'illegally" enriched himself to the tune of Rs 80 lakh (out of the total proceeds of Rs 1.56 crore), the ED alleged. PTI NES KVK KVK KVK

The Karnataka government will carry out a Social and Educational survey, commonly referred to as the caste census, over 15 days from September 22 to October 7, announced Chief Minister Siddaramaiah on Wednesday. The Karnataka State Backward Classes Commission has been assigned to submit the survey report by the end of October, which will help guide the state's upcoming budget. A preliminary meeting regarding the survey took place on Wednesday, chaired by Chief Minister Siddaramaiah, as reported by PTI. 'The Backward Classes Commission has submitted a proposal to the government to conduct a social and educational survey. Accordingly, a survey of all 7 crore people in the state will be conducted. The main objective of the census is to eliminate caste discrimination,' the CM was quoted as saying by his office in a statement. The survey also aims to gather comprehensive data on the financial status and land ownership. Siddaramaiah said, 'This time, the survey should be a model survey in the country.' 'It has been decided to conduct the survey for 15 days from September 22 to October 7. The survey report should be submitted by the end of October. Instructions have been given to start preliminary preparations for the survey, including training from now itself,' he added. On June 12, the Karnataka cabinet decided to conduct a fresh social and educational survey (caste census), effectively discarding the 2015 survey that cost around ₹ 165 crore, citing legal reasons. The cabinet referred to Section 11(1) of the Karnataka State Commission for Backward Classes Act, 1995, which requires revising the state's backward classes list every 10 years. This decision came following directives from Congress leaders Mallikarjun Kharge and Rahul Gandhi to carry out caste re-enumeration in Karnataka, addressing concerns from communities excluded in the previous survey a decade ago. During the meeting, Siddaramaiah stressed that measures would be taken to prevent complaints and assured that no one would be left out of the survey. 'The Kantharaju Commission had previously conducted the survey manually by preparing 54 questions. This time, more elements will be included in the survey. This time, the survey will be conducted using a mobile app,' he said. Instructions have been given to study the social and educational census conducted in neighbouring Telangana, and it has also been decided to form a high-level committee to oversee the survey work. The CM stressed the need for a scientific and transparent approach, with assistance from an expert committee to finalise the questions to be asked in the survey. Pointing out that human resources, including 1.65 lakh enumerators, are required for the survey work, Siddaramaiah said along with the services of teachers, staff from other departments will also be used for the fresh survey. The CM asked all the departments concerned to work in coordination and make the survey a success. Backward Classes Welfare Minister Shivaraj Thangadgi, Chairman of the State Backward Classes Commission Madhusudan R Naik, Chief Secretary to the Government Shalini Rajneesh , Chief Minister's Legal Advisor and MLA Ponnanna, and senior officials attended the meeting. Various communities, especially Karnataka's two dominant ones -- Vokkaligas and Veershaiva-Lingayats -- had expressed strong reservations about the caste survey that was done in 2015, calling it 'unscientific', and had demanded that it be rejected, and a fresh survey be conducted. This time, the survey should be a model survey in the country. Measures would be taken to prevent complaints and assure that no one would be left out of the survey. There are also strong voices against it from within the ruling Congress.

Bengaluru: The Enforcement Directorate's Bengaluru Zonal Office has filed a complaint against One Sigma Technologies Pvt Ltd (SIMPL) and its Director Nitya Nand Sharma for contravention of the Foreign Exchange Management Act to the tune of Rs 913 crore (Rs 913,75,88,062), an official statement said on Wednesday. The enquiries in the matter were initiated on the basis of credible information that SIMPL has received a substantial amount of Foreign Direct Investment (FDI) from the US, allegedly in violation of the extant FDI policy, the ED statement said. The ED investigation under the provisions of the FEMA revealed that the firm runs its business through mobile application named SIMPL.

BENGALURU: The Directorate of Enforcement (ED), Bengaluru, has filed a complaint against fashion etailer Myntra, and its related entities under the Foreign Exchange Management Act (FEMA), 1999, for allegedly violating foreign investment rules to the tune of Rs 1654,35,08,981 (Rs 1,654.35 crore) under the guise of wholesale trading. The complaint was filed under Section 16(3) of FEMA. In another case, ED filed a complaint under Section 16(3) of FEMA against Bengaluru-based 'One Sigma Technologies Pvt Ltd' (SIMPL) and its director Nithya Nand Sharma, for contravention to the tune of Rs 913,75,88,062 (Rs 913.75 crore). The company is behind the popular Buy Now Pay Later (SIMPL) app, which allows customers to buy now and pay later in instalments. In an official release on Wednesday, the ED stated that inquiry into Myntra's books was initiated on the basis of 'credible information that Myntra Designs Private Limited (Myntra) and its related companies are doing Multi Brand Retail Trade (MBRT) in the guise of 'Wholesale Cash & Carry', allegedly in violation of the extant Foreign Direct Investment (FDI) policy'. The ED investigation revealed that Myntra had 'declared that they were engaged in the business of wholesale cash & carry and invited and received FDI from foreign investors equivalent to Rs 1,654.35 crore, and that they sold a majority of their goods to Vector E-Commerce Pvt Ltd (which sold the goods in retail to the ultimate customer). Vector E-Commerce and Myntra are related parties and belong to the same group or group of companies'. 'Vector was created and continued to be used as a corporate entity to bifurcate the B2C (business to customer i.e Myntra to retail customers) transaction into B2B (Myntra to Vector) and then B2C (Vector to retail customers),' the ED added.
