Spanish court overturns soccer player Dani Alves' rape conviction on appeal

Brazilian soccer player Dani Alves won his appeal against a sexual assault conviction as a Spanish court overturned the ruling Friday in a case that lasted more than three years and saw the former Barcelona defender spend 14 months in jail.
Alves was found guilty in February 2024 of raping a woman in a nightclub in December 2022 and sentenced to four years, six months in prison. Alves denied wrongdoing during the three-day trial.
That court ruled Friday that there was 'insufficient evidence' to rule out Alves' presumption of innocence.
'Dani Alves is innocent, and that has been proven,' his defense lawyer Inés Guardiola told Catalan radio RAC1. ' Justice has finally been served.'
The plaintiff's lawyer did not immediately respond to The Associated Press when emailed and messaged asking for comment.
The Alves trial was the first high-profile case since Spain overhauled its laws in 2022 to make consent central to defining a sex crime in response to an upswell of protests after a gang-rape case during the San Fermin bull-running festival in Pamplona in 2016.
The legislation popularly known as the 'only yes means yes' law defines consent as an explicit expression of a person's will, making it clear that silence or passivity do not equal consent.
But the four judges of a Barcelona-based appeals court ruled unanimously to overturn the conviction after reviewing the evidence and testimonies given to the lower court. In their ruling, they wrote that the testimony of the plaintiff 'differed notably' from evidence of video footage taken before the woman and Alves entered the bathroom where she said he forced her to have sex without her consent.
Different versions
Before last year's trial, the alleged victim told state prosecutors that she had danced with Alves at the nightclub and willingly entered the bathroom, but that later when she wanted to leave he would not let her. She said he slapped her, insulted her and forced her to have sex against her will.
Alves denied those accusations at the three-day trial.
'She never told me to stop. We were both enjoying ourselves,' Alves said, while repeating that the woman never asked to leave or made any indication that she did not want to have sex with him. He also denied having slapped or insulted her.
Already out on bail
Alves, now 41, was kept in jail from Jan. 20, 2023 until March 2024 until he was released after paying 1 million euros (then $1.2 million) for bail while awaiting his appeal. He also handed over his passports, with prosecutors having argued against releasing him on bail because of a possible flight risk.
Prosecutors wanted his prison sentence increased to nine years while the victim's lawyer wanted him to stay behind bars for 12 years.
This decision could be appealed to the Spanish supreme court in Madrid.
Alves' playing career
Alves was one of the most successful players of his generation and won dozens of titles with elite clubs including Barcelona, Juventus and Paris Saint-Germain. He also helped Brazil win two Copa Americas and an Olympic gold medal at age 38. He played at his third World Cup, the only major title he hasn't won, in 2022. He played for Barcelona from 2008-16, helping the team win three Champions Leagues and six Spanish leagues, and briefly rejoined the club in 2022. He still has a residence near the city.
He was with Mexican club Pumas when he was arrested. Pumas terminated his contract immediately.

In a post online, he urged them to 'come and get him'. He wrote: "I'm home, if anyone's looking for me. I've never once ran. I've never even left my bit, other than to take my boy on a holiday. "If anyone wants it with me today, get on me. I won't be roped into a slagging match or arguments with fake accounts. I don't do that." Half a mile away - and at the same time -a Range Rover believed to be owned by another associate of Richardson's was firebombed at a property on the capital's Campion Road. Cops are treating both incidents as suspicious. Images taken in the aftermath show the burnt out shells of both vehicles. Tamo Junto were quick to claim responsibility for the attacks in a video. Footage shared by the gang shows flames bursting out of the Range Rover and the Transit van. In one clip a hooded figure can be seen standing with an accelerant canister before he backs away from the fireball. The video plays the song Two Tribes by 80s pop group Frankie Goes to Hollywood and it ends with emojis of a black pawn chess piece and a sand timer appearing side by side. Pictures taken at the time showed windows boarded up in the wake of the attack after men were filmed kicking in the door. McGill has been waging war on Richardson and his cronies in a series of violent attacks since March. We previously told how the pair are locked in a bitter feud after McGill was ripped off in a £500k cocaine deal. Homes, cars and businesses belonging to associates of Richardson have been hit in a series of firebombings and shootings. Machete thugs also pounced on his close ally David McMillan Snr at his home on Pitcairn Grove in the city last month. Police said they are treating the attack on the 56-year-old as attempted murder. It was the third time McMillan had been targeted in recent weeks. On April 17, two masked thugs set fire to his front door while children slept inside. Just three weeks later on May 8, a white Land Rover SUV in his driveway went up in flames after his family returned home from a shopping trip. In April, a carpet and flooring unit owned by Daniel enforcer Craig "Rob Roy" Gallagher was torched in Bishopbriggs. And in Milton, a female pensioner and 12-year-old boy were injured after hoods stormed their home looking for a high-ranking member of the Daniel family. McGill's men went on to target the home of Steven 'Bonzo' Daniel, as well as the properties of his mum Annette, uncle Norman and sister Kelly 'Bo' Green. Last month, two men were attacked with a machete at a garage owned by Robert Daniel in East Kilbride. Othniel Adoma "always had a smile on his face," his side, Crowthorne FC Juniors, said following the tragedy. The youngster died on Thursday, more than three weeks after the single-vehicle crash on the motorway near Reading, Berkshire. A six-year-old boy, who has not been named, also died in the collision. ‌ Othniel was a talented footballer, who Bracknell-based team Crowthorne FC Juniors said possessed "electric pace, dazzling footwork". The club, which is set to hold a vigil on Friday evening, said in a statement: "Everyone at Crowthorne FC is devastated by the tragic passing of one of our own, Othniel Adoma, who sadly lost his life this week. Othniel was a talented young footballer, full of promise, who spent three wonderful years with our club. He was loved deeply by his coaches, his teammates, and everyone whose life he touched. ‌ "He will be remembered not only for his electric pace, dazzling footwork, and the goals and assists he delivered week after week — but more importantly, for the incredible person he was. Othniel always had a smile on his face and brought joy and laughter to those around him." Thames Valley Police continues to investigate the crash and confirmed no arrests have been made. A white Ford Transit minibus overturned on the link road at junction 10 of the eastbound M4 for the A329(M) near Reading on May 11. Five other children who were injured in the collision have now been discharged from hospital. Speaking previously, investigating officer Detective Sergeant Lyndsey Blackaby, of the serious collision investigation unit at Thames Valley Police, said: 'My thoughts, and the thoughts of everyone at Thames Valley Police, are with the family and friends of Othniel Adoma. Othniel's family has released these beautiful pictures of Othniel in his memory. Othniel's family has asked that their privacy be respected at this difficult time."
