Delhi High Court stays ₹340-crore damages order against Amazon in trademark case

Mint20 hours ago
The Delhi High Court has delivered Amazon Technologies, a subsidiary of global e-commerce giant Amazon Inc., a major reprieve in a trademark infringement case against it.
On Tuesday, a division bench of the high court stayed a single-judge order that had directed the company to pay nearly ₹ 340 crore ($39 million) in damages to Lifestyle Equities for trademark infringement involving the Beverly Hills Polo Club brand.
The bench of justices Hari Shankar and Ajay Digpaul granted the interim stay without requiring Amazon to make a pre-deposit. However, Amazon has been asked to undertake that it will pay the damages if the final decision goes against it. The court clarified that the stay order would not influence the outcome of the appeal.
The dispute began in 2020, when Lifestyle Equities a UK company that owns and manages the Beverly Hills Polo brand filed a trademark infringement suit against Amazon Technologies and others, alleging unauthorised use of a deceptively similar mark on apparel and other products sold on Amazon platforms.
The company claimed the infringing trademark appeared on apparel manufactured and sold by Amazon Technologies under its Symbol brand, and that Cloudtail India, a major seller on Amazon.in, was also involved in the sales.
In October 2020 the high court issued an interim injunction restraining Amazon and Cloudtail from using the mark and ordered that the infringing listings be removed. Amazon Technologies failed to appear at the proceedings and was eventually proceeded against ex-parte.
Meanwhile, Cloudtail India admitted it had sold infringing products between 2015 and July 2020, earning total sales of ₹ 23.9 lakh with a profit margin around 20%. While Cloudtail offered to settle, mediation attempts failed, leading the court to pass a decree against Cloudtail and awarding ₹ 4.78 lakh in damages to Lifestyle Equities.
In its final judgement on 25 February 2025, the single-judge bench held Amazon liable for about ₹ 340 crore in total damages and costs, saying that its close commercial relationship with Cloudtail made it directly responsible for the infringement.
The court examined the Amazon-Cloudtail brand license and distribution agreement, noting that it granted Cloudtail extensive rights to use Amazon's trademarks and branding, undermining Amazon's defence of being a mere intermediary.
The court awarded $5 million for Lifestyle's additional advertising and promotional expenses incurred to protect its brand reputation, and $33.78 million in compensatory damages for lost royalties, bringing the total to $38.78 million (around ₹ 336 crore) plus litigation costs.
This single-judge order was considered a landmark ruling by experts because it established that e-commerce platforms such as Amazon could be held directly liable for trademark infringement by sellers on their platforms. Platforms have traditionally claimed they are mere intermediaries, but the court held that Amazon's agreements and control over sellers made it accountable.

Jeff Bezos offloads stock: Sells 3.3 million Amazon shares; nets $736.7 million amid wedding fanfare

File photo: Amazon founder Jeff Bezos (Picture credit: AP) Amazon founder Jeff Bezos has offloaded over 3.3 million shares of the tech giant, netting approximately $736.7 million, as per a regulatory filing reported by Bloomberg. The transactions, carried out in late June, coincided with Bezos' lavish three-day wedding to Lauren Sanchez in Venice, a celebration that drew global attention and protests from some locals. The share sale is part of a pre-scheduled 10b5-1 trading plan Bezos adopted in March, allowing him to sell up to 25 million Amazon shares through May 2026. According to CNBC, Bezos implemented a similar plan in early 2024 to sell up to 50 million shares by January this year. Following the latest transaction, Bezos still holds around 905 million Amazon shares, maintaining his status as the company's largest individual shareholder. Since 2002, Bezos has sold about $44 billion worth of Amazon stock, noted Bloomberg, while making only one recorded purchase, a single share in 2022. The billionaire, who stepped down as Amazon CEO in 2021 but remains executive chair, is known to use stock proceeds to fund his ventures, most notably Blue Origin. The aerospace company recently launched its flagship rocket into orbit, though it announced significant layoffs soon after. Bezos has also donated generously. In 2025, he gifted nearly 930,000 Amazon shares to undisclosed nonprofits. According to Bloomberg, he reported donations worth $60 million in March, followed by gifts of $125 million in May and $5 million in June. Most of these contributions support the Bezos Earth Fund, a $10 billion climate initiative and the Bezos Day One Fund, which tackles homelessness and supports early education. The timing of the stock sale with his wedding was widely noted. As per CNBC, the Venice ceremony cost an estimated $50 million. According to the Bloomberg Billionaires Index, Bezos is the world's third-richest individual with a net worth of approximately $241.4 billion. Forbes ranks him fourth with an estimate of $234.4 billion. Stay informed with the latest business news, updates on bank holidays and public holidays . AI Masterclass for Students. Jeff Bezos unloads $737 million of Amazon stock in year's first sale

The sale, which coincided with his star-studded wedding to Lauren Sanchez in Venice, is part of a 10b5-1 trading plan Bezos adopted in March for up to 25 million shares Bloomberg Jeff Bezos sold 3.3 million Inc. shares in recent days, netting $736.7 million. The sale, which coincided with his star-studded wedding to Lauren Sanchez in Venice, is part of a 10b5-1 trading plan Bezos adopted in March for up to 25 million shares. Since then, Amazon's stock price has climbed more than 8 per cent alongside a broader rally in US markets. Bezos, 61, is the third-richest man in the world with a $241.4 billion fortune, according to the Bloomberg Billionaires Index. He routinely uses 10b5-1 trading plans, selling 75 million shares last year for a total of $13.6 billion through the arrangements, which allow company insiders to offload shares at predetermined times. Since 2002, Bezos has unloaded Amazon shares worth about $44 billion, according to data compiled by Bloomberg. He's a much less frequent buyer of the stock, making his first purchase two years ago in records going back to 2002 — a single share for $114.77. Bezos often sells his Amazon shares to fund Blue Origin, the space company he started in 2000. In January, it debuted its new flagship rocket and successfully reached orbit after years in development, but a month later, it cut about 10 per cent of its workforce in surprise layoffs as it looks to cut costs. The stock sales mark Bezos' first for the year, but he has given away nearly 930,000 shares to nonprofits in 2025. In March, Bezos reported gifting shares worth around $60 million at the time to undisclosed charities. In May, he gifted another bundle of shares worth roughly $125 million, followed by another $5 million in June. Bezos typically gives to support his Bezos Earth Fund, which is a $10 billion commitment to fight climate change, and the Bezos Day One Fund, a $2 billion philanthropic initiative focused on homelessness. In previous years, he has also given out a $100 million 'Bezos Courage & Civility Award' to support philanthropists like Dolly Parton and Van Jones.
