Nearly 2 years after B.C. wildfire, Lake Okanagan Resort condo owners still can't rebuild

Nearly two years after a catastrophic wildfire tore through the Lake Okanagan Resort near West Kelowna, B.C., dozens of homeowners say they've been left in limbo — unable to rebuild and frustrated by what they call a lack of government support.
Before it was destroyed by the McDougall Creek wildfire in August 2023, the 74-acre resort, located about 20 kilometres outside the city, was both a vacation destination and a year-round community.
Several of the buildings on the property were condominiums with dozens of apartments either owned by Lake Okanagan Resort or by individual owners, either as investment properties or, in the case of Maria Hart, her primary residence.
"This was our home... We were a really tight group of people who lived out here year-round," said Hart.
Now Hart and other condo owners say they are stuck and unable to rebuild until basic utilities like water and electricity, which the resort provided to their buildings before the fire, are restored to the property.
"It seems a bit like we're forgotten," Hart said.
Lake Okanagan Resort was purchased in 2014 by a group of Chinese investors and is owned by a Richmond-based company named DHI Holdings Inc.
CBC News has made repeated requests to speak with the resort managers and DHI Holdings. None have agreed to an interview.
Today, Lake Okanagan Resort sits eerily quiet. Only one hotel building stands, surrounded by industrial fencing. The fire reduced several other condominium and chalet buildings on the resort property to their foundations.
Unable to get utilities reinstalled
While many other wildfire victims in West Kelowna and the surrounding area have begun rebuilding their homes, Hart and other condo owners are unable to move forward.
"Rebuilding on the site cannot occur until critical infrastructure, including utilities like power, water and sewer, is restored," said a spokesperson for the Regional District of Central Okanagan in a statement to CBC News.
"These utilities are privately owned and operated by Lake Okanagan Resort and regulated by the Province."
Since the fire, the strata council that manages Hart's building has been asking the resort for updates on a rebuild plan. However, according to strata council member Heather Ormiston, the managers with the resort company have shared very little with the strata.
"Extremely frustrating is actually an understatement," said Ormiston. "They seem to use all kinds of stall tactics."
According to Ormiston, the resort stopped responding to the strata's emails and phone calls months ago, leaving her and other condo owners in the dark.
Condo owners call for government action
Ormiston and the strata have lobbied their MLA, the regional district and multiple provincial agencies for help.
The condo owners want government intervention — either by forcing the resort to restore utility services or transferring ownership of water systems to the strata.
"The holdup now is the lack of intervention by the government," said Ormiston.
"It's the government ministries that issued these permits, and yet they're not doing anything to hold these utility owners accountable."
Lake Okanagan Resort is located outside West Kelowna's city boundaries and isn't connected to municipal utilities. According to the province, the resort is considered the public utility provider for water and hydro, and in some cases, sewage treatment for the strata buildings located on the property.
The B.C. Utilities Commission (BCUC) and the Ministry of Water, Lands and Resource Stewardship did not agree to interviews with CBC News.
However, in written statements to CBC and in letters to the strata, the government agencies paint a bleak picture of the resort's future.
"Lake Okanagan Resort has indicated that it has no plans to rebuild its wastewater system, and therefore, the extent and timing of future occupancy at the resort is unclear," wrote a spokesperson with the BCUC.
In a letter to the strata last month, the Ministry of Water, Land and Resource Stewardship said the province has no authority to force the resort to transfer ownership of its water systems to the strata.
"The issues facing the residents of Lake Okanagan Resort are complicated, as there are multiple services that need to be restored," the letter reads.
"Without confirmation that the resort intends to rebuild the wastewater treatment plant, there are uncertainties as to how many residents will be able to rebuild and return to the area."
'A very complicated situation'
According to Tony Gioventu, executive director of the Condominium Home Owners Association of B.C., the situation is one of the most complex he's seen.
"This is really the first one in British Columbia that's this extreme," he said.
"Reconstruction in major tragedies is not a quick thing. It can take one, three, even five years."
In a case like this involving multiple strata corporations and a private company, Gioventu said legal action might be the only way forward.
"The quickest way to resolve this may be to get into the Supreme Court of B.C., which has a good track record of resolving strata issues," Gioventu said.
'I feel like I'm in limbo'
In the meantime, Maria Hart and other condo owners are paying mortgages and strata fees on homes that no longer exist.
"I feel like I'm in limbo. I'm not sure if I should try and find another place in Kelowna or if I should go to greener pastures or what I should do," Hart said.
"Friends and family ask me, 'What are your plans?' I don't know. Can I move back into my home? Is it going to be rebuilt … ever? I don't know."
For now, Hart and her neighbours are caught between the hope for a future rebuild and the reality of an uncertain road ahead.

Oboist Marc DesRoches said he was trying to dispose of some sensitive papers by burning them in a stainless steel sink outside the home he and his partner once occupied in New London, P.E.I. DesRoches speculates a small leaflet may have blown free amid the windy conditions prevailing on June 2, as shortly after he returned inside to his piano, he realized his deck was on fire. The blaze spread to the home and destroyed two oboes, an English horn that was still being paid off, three pianos and a large collection of other woodwind and brass instruments, including his grandfather's tuba. Other lost treasures include a pair of Chinese vases his partner Glen Gamble has had in his family since the 19th century, as well as the couple's orange cat Tchaikovsky, who they hope has simply wandered off and is still alive. DesRoches said he's hoping to replace at least one oboe and the English horn so he can continue to perform with the orchestra. 'I feel like playing with the symphony is going to be one of the most healing things for me,' he said. Scott Mintie, chief of the New London fire department, said 25 firefighters responded to the call. Crews found a single family home engulfed in flames on arrival and the one person at home was able to get out safely, he said in a statement. 'There were high winds from the south-southwest, estimated about 35 km-h, which did contribute to the rapid spread of the fire. The vehicle in the driveway sustained some damage,' he said. 'Small spot fires caused by blowing embers were quickly extinguished by the crews.' The fire is a 'strong' reminder that emergencies can escalate quickly in windy conditions, Mintie said. 'Situations like today show that seconds do matter. The occupant's ability to exit quickly most likely prevented a far more tragic outcome.' DesRoches said the first thing he did as soon as he saw the blaze was pull out the fire extinguisher from the garage to get the blaze under control. But the fire was spreading, and he could soon feel the flames on his face. 'I ran back to the front of the house because the fire was at the very back, and I just peeked my head in the door to get eyes on the two spots that my cat is usually sitting,' he said, his voice cracking with emotion. 'Unfortunately, I didn't see her, so I couldn't grab her before I ran.' The orange cat, Tchaikovsky, also answers to 'Tchai,' said DesRoches, adding he's had the tabby for about 10 years, since she was a kitten. DesRoches said the couple had insurance for their home, but not enough to cover the cost of replacement instruments. On June 8, a second J-15 tailed a Japanese P-3C for roughly 80 minutes, coming as close as 45 meters on the aircraft's right side. As it disengaged, the jet crossed in front of the patrol plane at the same altitude, just 900 meters ahead. That day, another Chinese fighter also joined the pursuit. Describing the 45-meter proximity, a Japan Air Self-Defense Force (ASDF) pilot said it felt like "a total stranger walking shoulder to shoulder with you — close enough to break a cold sweat." At the time, China had deployed two aircraft carriers to the western Pacific simultaneously for the first time. Reflecting on the maneuver, one ASDF official remarked, "It was as if they were declaring, 'This is China's airspace.'" Frontal crossings like the one on June 8 are especially dangerous, as wake turbulence can trigger engine malfunctions. Japan's P-3C was conducting surveillance on five vessels, including the Shandong . According to reports, the JMSDF aircraft attempted to communicate via radio, asserting that it was "conducting legitimate mission flights in international airspace." While the MOD has not released the full details of the exchange, it stated that a safe distance was maintained from the Shandong . Chinese military aircraft have repeatedly carried out provocative maneuvers against the United States and other allied forces in recent years. In February, a Chinese J-16 fighter jet closed to within just 30 meters of an Australian P-8A patrol aircraft over the South China Sea and released infrared countermeasure flares designed to evade missiles. According to a 2023 announcement by the US Department of Defense, Chinese aircraft were involved in more than 180 abnormal close encounters over the previous two years. These included incidents where jets flew close enough for crew members' faces to be seen or crossed directly in front of US aircraft at dangerously close range. Around the same time, another Chinese aircraft carrier, the Liaoning , crossed the Second Island Chain — a key US defense perimeter — for the first time. This time, with both Chinese carriers operating simultaneously in the western Pacific, Professor Tetsuo Kotani of Meikai University, a security policy expert, offered this analysis: "This seems to be China's way of sending a warning: 'Don't interfere with our legitimate training in this newly entered area.' In separate press conferences, the governors of the two prefectures expressed their desire to work together on viable solutions to the problem of reckless climbers. A recent series of accidents on Mount Fuji has involved off-season climbers lacking the necessary equipment and preparation. Reasonably considered, individuals who ignore warnings should cover at least part of the costs of their rescue. That is the only way to discourage reckless and off-season climbing of Japan's highest mountain. The two prefectures should move to make the fee a reality. In the process, they should discuss the areas it will cover and what share of the costs rogue climbers would be required to pay. The first time, he ignored that the mountain was not open for climbers. Then, when he found himself unable to move near the summit, he had to be rescued by a Yamanashi Prefecture disaster prevention helicopter. Learning nothing from that experience, he was back on the mountain four days later. He later claimed he had returned to retrieve his smartphone and other personal items left behind on the summit during his earlier failed climb. This time, the Shizuoka Prefectural Police Mountain Rescue Team had to rescue him. In May, two other Chinese men briefly found themselves unable to move, and rescue teams were activated. They eventually managed to get down the mountain under their own power. Even in June, there is an elevated risk of getting in trouble on Mount Fuji due to occasional snow and high winds. For this reason, the official period set for climbing to the summit is limited to between early July and early September. Outside of these periods, the hiking trails are closed. Off-season rescue operations can also be dangerous. Not only do they require considerable effort and expense, but there is also the risk of secondary disasters due to wind gusts and other unexpected complications. The number of climbers showing a shocking lack of common sense and disdain for the rules has, therefore, triggered concern. (©Sankei by Hirao Takashi) It is only natural that local governments would ask such offenders to pay for their rescues. If it costs people a reasonable amount if they get into trouble, they may think twice about such risky behavior. Originally, mountain rescue operations by helicopter were generally conducted by the private sector on a commercial basis. For such rescues, the costs could range from hundreds of thousands to millions of JPY (thousands to hundreds of thousands of USD). Therefore, climbers were advised to obtain mountain climbing insurance before heading for the mountains. However, after the Great Hanshin Earthquake (1995), local governments' use of disaster prevention and police helicopters became widespread. Since then, for the most part, rescues have been a public sector function. In principle, taxpayers pay for such services, and they are free to those rescued. However, all too often these days, people request rescues that are not necessary. Things have started to change in some parts of Japan. Saitama Prefecture, for example, implemented an ordinance in 2018 that requires the collection of a fuel charge. Initially, the charge was set at ¥5,000 JPY ($35 USD) for every five minutes of helicopter rescue operations in certain mountainous areas. That was raised to ¥8,000 ($56 ) for five minutes since April 2024. Such an approach might also work for Mount Fuji. Besides introducing fees, it is also imperative that climber ethics improve. People who get in trouble in the mountains risk not just their own lives. They should bear in mind that their actions also put their rescuers in harm's way.
