S'gor govt proposes seizure of assets, withhold income of court-ordered "nafkah" defaulters
State Islamic Religious Affairs and Cultural Innovation Committee chairman Dr Mohammad Fahmi Ngah (pic) said other proposed measures include income withholding orders, garnishment orders, and the sale of property belonging to defaulters.
"The selection of an appropriate and efficient mechanism by the party seeking maintenance, especially the ex-wife or children's guardian, is a crucial factor in ensuring the successful enforcement of maintenance orders.
"Failure to choose the right channel or mechanism can cause delays, confusion, and ultimately jeopardise the rights of the maintenance recipient," he told the State Assembly on Monday (July 7).
He was responding to an oral question from Mariam Abdul Rashid (PH-Meru) on efforts by the state government to strengthen state laws and enable stricter action against those who evade maintenance payments.
Mohammad Fahmi said the state government, through the Syariah Judicial Department (JAKESS), is also exploring strategic collaboration opportunities with other agencies such as the National Registration Department, the Inland Revenue Board, and financial institutions to assist in the process of tracing and seizing the assets of individuals who have defaulted on maintenance orders.
"The Selangor Islamic Religious Council (MAIS), together with JAKESS, the Selangor Islamic Religious Department (JAIS), academics, and Syariah legal experts, are currently reviewing and proposing amendments to the Islamic Family Law Enactment (Selangor State) 2003 to improve provisions related to the enforcement of maintenance orders," he said.
He also told the State Assembly that 1,189 complaints of maintenance violations had been received by the Selangor State Family Support Division since 2022 until May 31 this year. - Bernama

Pahang Sultan calls for deeper Syariah enactment reforms
KUANTAN: The Sultan of Pahang, Al-Sultan Abdullah Ri'ayatuddin Al-Mustafa Billah Shah, has called for a thorough review of the state's Syariah enactments, stressing the need for reforms that go beyond superficial changes. He emphasised aligning the legal framework with Maqasid Syariah principles—protecting religion, life, intellect, lineage, and wealth—to address contemporary challenges. Speaking at the 196th meeting of the Pahang Islamic Religious and Malay Customs Council, Al-Sultan Abdullah highlighted the necessity of a robust enforcement structure. 'Improvements in training, human resources, logistics, and technology are crucial to ensure laws are implemented fairly and professionally,' he said in a Facebook post by the Pahang Sultanate. The Ruler also underscored the importance of credible fatwa institutions, urging that rulings remain rooted in Quranic teachings, Sunnah, and scholarly consensus. 'Fatwas must be respected as authoritative guidance, not mere formalities,' he added, warning against undermining valid rulings due to unclear enforcement. Additionally, Al-Sultan Abdullah proposed forming a Mosque Financial Audit Committee under JAIP to ensure transparent management of mosque funds. He stressed that donations must be handled with integrity, reflecting community trust. Kelantan moves to curb marriages using fake divorce, death certificates
KOTA BARU: The Kelantan government is taking steps to strengthen the Islamic Family Law Enactment to address cases involving forged divorce and death certificates used by couples seeking marriage in southern Thailand. State Islamic Development, Dakwah, Information and Regional Relations Committee chairman Mohd Asri Mat Daud said the proposed amendments would be tabled at the next State Legislative Assembly sitting. "This will be presented during the next State Legislative Assembly sitting, where full details will be revealed," he said. He acknowledged that there have been cases involving couples from Kelantan using fake divorce and death certificates to get married in neighbouring Thailand. He added that all individuals involved have been issued compounds by the state religious department. "The Kelantan Religious Department was contacted by its counterparts in southern Thailand, who raised concerns about the matter. "It's not just about Kelantan couples trying to deceive religious officers there to get married, but also involves cross-border marriage syndicates using fake documents for marriage purposes," he said. Asri said state religious officials have adopted a practical approach in handling such cases. "We don't want to create further complications or cause hardship for the children born from these marriages. "So, the department has opted to issue compounds instead," he said. He assured that the issue of forged marriage documents, whether involving syndicates or couples from Kelantan, remains under control and is not considered alarming. It was reported yesterday that the Narathiwat Islamic Religious Council had uncovered several cases involving Malaysian women attempting to deceive its religious officers by submitting forged divorce or death certificates in order to marry new Malaysian partners in southern Thailand. Council deputy president Abdul Aziz Che Mamat said such cases had been detected over the past few years, with most of those involved hailing from Kelantan.
