
HC notices to OMC over CBI's appeal for enhancing punishment
Justice K. Lakshman of the HC passed the order issuing notices to OMC after hearing the CBI's plea filed under Section 418 (2) (b) of the BNSS. The officials contended that the punishment awarded by the trial court was grossly inadequate. The punishment of imposing one lakh rupees fine on OMC did not match the gravity of the crime established against the company, the investigating agency said in the plea.
The CBI wanted that the punishment should act as a deterrent for the companies indulging in fraudulent practices. Three months ago, the CBI Special Court held the company guilty under Sections 120-B and 420 of the Indian Penal Code, imposing a fine of one lakh rupees. The judge posted the matter to September 17 for next hearing.

CBI submits final report in custody death case
Madurai: The CBI informed Madras high court on Wednesday that it has filed the final report (chargesheet) before the chief judicial magistrate court in Madurai, in the case pertaining to the custodial death of B Ajith Kumar in Thiruppuvanam in Sivaganga district. A total of 103 witnesses were examined, and the final report filed through online mode before the CJM court on Wednesday according to earlier orders of the court, it said. The CBI also included police constable Ramachandran, driver of the van in which Ajith Kumar was transported, as an accused in the case, apart from the five policemen - Prabhu, Kannan, Sankara Manikandan, Raja, and Anand, who were already arrested. The CBI submitted that though the final report has been filed, further investigation would be held to ascertain the involvement of any other people in the case. This will be based on reports from Central Forensic Science Laboratories in New Delhi and Hyderabad. Additional Advocate General M Ajmal Khan, appearing for the state, submitted that pursuant to the order of the court, an additional compensation of Rs25 lakh was paid to the victim's family. Protection has also been provided to five witnesses under Witness Protection Scheme. He submitted that CBI is yet to receive the files of another case registered in connection with the gold jewellery theft (based on a complaint of Nikitha), which was also transferred to CBI. A division bench of Justices S M Subramaniam and G Arul Murugan observed that Constitutional courts have to maintain a constant vigil against the inaction of authorities in discharging their duties and obligations. It was only when the high court took up the present case of custodial death, the process of investigation accelerated, and CBI investigation commenced. The judges appreciated CBI investigating officer DSP Mohit Kumar and his team for swiftly commencing investigation and filing the final report. The judges directed the state to hand over files pertaining to the jewel theft case to the CBI in a week. Thereafter, the CBI shall register an FIR and commence investigation expeditiously, the judges said. The judges directed the agency to file a status report on further progress in the case on Sept 24. Henri Tiphagne, counsel for a petitioner, submitted that though CCTV cameras were installed at the houses of the witnesses on Aug 19, certain other security doors and fencing are yet to be provided. Taking into account the submissions, the judges directed the state to comply with the orders passed under Witness Protection Scheme in one week. The court was hearing a batch of public interest litigations seeking a CBI probe into the custodial death incident. The hearing in the case was adjourned to Sept 24. 6 Policemen Arrested For Constable's Custodial Torture In Jammu And Kashmir
Srinagar: The CBI on Wednesday arrested six police personnel, including at least two officers, in connection with the alleged custodial torture of a cop, following orders from the Supreme Court last month, officials said here on Wednesday. The arrested cops include a deputy superintendent of police, an inspector, and an assistant sub-inspector, officials said here. The accused cops were directed to submit their weapons and other government articles to the respective District Police Lines. One of the accused cops -- a special police officer working on an honorarium -- has been disengaged and struck off from Special Police Officer (SPO) rolls. Further details were awaited, the officials said. On July 21, the Supreme Court directed the CBI to register an FIR over the "brutal and inhuman custodial torture" of a police constable in Jammu and Kashmir and ordered the UT administration to pay him Rs 50 lakh in compensation. A bench comprising Justices Vikram Nath and Sandeep Mehta said the injuries caused to the constable during his illegal detention, particularly the "complete mutilation of his genitalia, use of pepper/chilly powder and electric shocks on his genitalia", were grave reminders of the inhuman torture meted out to him. "The cumulative effect of all these facts is deeply shocking to the conscience of this court," the bench said, adding that the violation of Article 21 is "not only evident but egregious." The bench observed that the constable suffered life-debilitating injuries in the custody of "fellow state actors" and despite repeated complaints, no effective redressal was provided.

Sahibabad market violence: Trader held over remarks against woman
Ghaziabad: The Ghaziabad police have arrested Bijender Yadav, a trader at Sahibabad vegetable market, for allegedly making insulting remarks against a woman, the wife of a government officer, said officials on Wednesday. A spokesperson of the Congress' city unit has said that trader Yadav is not holding any party responsibility as of now. (HT Photos (Video grab)) On August 14, Yadav, along with 100-150 unidentified people, was booked in an FIR registered at the Link Road police station under the BNS sections for insulting the modesty of a woman, intentional insult with intent to provoke breach of peace, criminal intimidation, and threats that cause fear of death, grievous hurt, destruction of property by fire, or other serious offenses. 'Yadav, named in the FIR, was arrested on Tuesday under section 151 of Bharatiya Nagrik Suraksha Sanhita (BNSS) (to prevent the commission of cognizable offences). The FIR was lodged by the woman. However, even after a lot of persuasion, she or her husband has not come to the police to provide their statements so far. An investigation is underway,' said assistant commissioner of police (Sahibabad circle) Shweta Yadav. The woman alleged in her FIR that Yadav allegedly gave a speech to the Sahibabad vegetable market traders on August 11, and also passed insulting remarks against her and her husband. The incidents later took an ugly turn, and a group of men allegedly opened fire at traders, leaving two men injured. Several purported videos of the speech, firing and violence also went viral on the social media. Later, eight suspects of a group were arrested on August 11 evening for rioting, attempted murder, and violence. Earlier, Yadav, who is also ex-Congress district president, told HT that due to traders' harassment he had made the remarks. A spokesperson of the Congress' city unit said that Yadav is not holding any party responsibility as of now.
