
Judicial system is on the front line of the fight to avert climate catastrophe

The case relates to the planning of a
wind farm
. It was the first judgment to consider in detail the nature and scope of the obligation imposed on public bodies under Section 15 of the Climate Action and Low Carbon Development Act 2015. The legislation was amended in 2021, in what the judge described as a 'step change' from a 'have regard to' to a 'comply with' obligation regarding our climate targets. The speed at which the appeal is being heard and the number and experience of judges on the bench are an indication of how important a case it may be.
Our judicial system is increasingly in the front line in the fight to avert catastrophic climate change. Last year, in the so-called
Swiss grannies' case
, the
European Court of Human Rights
ruled in favour of a group of campaigning Swiss women in finding that Switzerland had violated their human rights by not taking sufficient action to mitigate climate change.
Similarly, a German Court, while in the end not awarding damages to the Peruvian farmer taking a case against a large German energy company for its climate emissions, still established a precedent for holding major greenhouse gas emitters liable for climate-related risks under German civil law.
Equally relevant was a decision by the Northern Ireland High Court in Belfast last month to quash permission for a
proposed upgrade of the A5
road, between Derry and Aughnacloy, Co Tyrone. The judge said the authorities had failed to demonstrate how it fit into plans, strategies and policies that map out a realistic and achievable pathway to a net zero target by 2050.

The number of legal challenges in relation to transport projects suggests that it, along with energy, is likely to be one of the key legal battlegrounds. The A5 decision may lead to a rethink within Transport Infrastructure Ireland, because several of its major roads projects go against everything we need to do to meet our climate targets.

Even if we get all the electric vehicles aimed for under our climate plan, we will still need a 25 per cent reduction in daily car journeys in the next five years to get on the right path. To get there, we need easy access to alternative low-carbon options, so we are going to have to reallocate road space to improve walking, cycling and public transport. In a State which has promoted car dependency for decades, that change is going to be hotly contested.
The fact that better low-carbon solutions are now at hand will help. I can understand the frustration for those fighting for the new A5 road on safety grounds. Yes, that road needs to be made safe. But there is also an opportunity to build the new rail line recommended by the recent Strategic Rail Review, running from Portadown to Dungannon, Omagh, Strabane, Letterkenny and Derry. It would take cars off the road, and be a game changer for the whole northwest.
In energy, the political challenge for a non-fossil fuel producer such as Ireland is so much easier because the cleaner alternative is where all the innovation, investment and savings are already happening. It is also a new economy – something we are quite good at, although you rarely hear that perspective. In 2001, the average Irish person was responsible for 19 tonnes of CO2 being emitted. That figure is now down to 10. The next reduction to five tonnes per person is imminently achievable and will be good for us as well as the environment.
Last month, we stopped burning coal in our power system. More wind and solar power will similarly allow us to switch away from expensive and polluting natural gas. In transport, every time we improve the sustainable alternatives, the Irish public responds with a large increase in patronage. Look at how rural bus use went up 165 per cent over the last five years, once we started to provide a proper service. Similarly, Irish farmers showed what is possible when they used 30 per cent less fertiliser in the first year of the Ukraine war and still maintained their productivity. Our carbon tax is an example internationally of how to effectively fund the retrofitting of hundreds of thousands of warmer homes and bring people out of energy poverty.

The idea, popular among those invested in the status quo, that the low-carbon solutions do not work, or are going to cost us a fortune, is perhaps what is on trial, in the end, in so many of these cases. The courts will have to independently decide between those arguing that we should protect business as usual and those asking that we respect their rights under the European Convention on Human Rights and stop the destruction of our natural world.
This transition has been clearly mandated by the United Nations, by our European Union and by the Oireachtas through extensive legislative provision, and well considered policy direction. Recent decisions offer some hope that it may now also have increasing judicial support.

Air Corps had to pull out of show in England due ‘significant challenges' for air traffic control
The Air Corps had to pull out of a British air show due to 'significant challenges' in air traffic control at Casement Aerodrome. Irish aircraft had been expected to appear at the RAF Cosford Air Show, near Wolverhampton in the English midlands, on June 8th, but this did not happen. The Irish Times had reported in May how Irish military flight operations were to move to part-time hours, consisting of a five-day-a week daytime-only flying schedule, due to a shortage of trained air traffic controllers. Five personnel were due to depart for the private sector, necessitating the move to a reduced schedule, which was to take effect from June 7th. READ MORE At one point an Irish Air Corps Pilatus PC-12 aircraft had been expected to be on static display at the air show. However, a social media post by RAF Cosford on May 17th said this aircraft would no longer be there. Attendees were told they would still be 'able to get up close' to two Air Corps helicopters, but a further online post on June 5th said: 'We have just been informed that the Irish Air Corps' AgustaWestland AW139 and Eurocopter EC135 [helicopters] will no longer be attending.' Labour Party TD Ged Nash asked Minister for Defence Simon Harris about the matter in a parliamentary question. Mr Harris said the Air Corps' participation in air shows was a 'worthwhile endeavour, with many relationships forged and knowledge shared at such events'. He said requests to take part in overseas exhibitions 'are subject to domestic operational commitments being met'. 'Given the significant challenges being experienced in relation to air traffic control at Casement Aerodrome at the time of this particular air show, and the focus of the Air Corps necessarily being on essential operations, I am advised that attendance at an air show in the UK could not be approved by my officials and this position was accepted by the military authorities,' Mr Harris said. In response to queries, neither the Department of Defence nor the Defence Forces offered information on the levels of air traffic control staffing and flight operations at Casement Aerodrome in Baldonnel, Co Dublin, on the weekend of the air show in June. A Department of Defence statement said: 'Currently the military authorities are operating a seven day-per-week, 12 hour-per-day, air traffic control service at Casement Aerodrome. 'Where required for particular security and operational reasons contingency services can be deployed. Given the sensitive nature of such operations, it would not be appropriate to comment further.' A Defence Forces statement said it did 'not comment on air traffic control-related queries of this nature due to operational security'. Mr Harris has previously promised investment in the Air Corps, including military radar and new aircraft. It is to be renamed the Irish Air Force.

The Irish Times view on the exchequer figures: Ireland should not bank on outperformance continuing
Forecasts over recent years that Ireland's extraordinary reliance on surging corporate tax receipts would, one day, cause the State problems are beginning to sound a bit like the fable of the ' boy who called wolf.' Even with global uncertainty brought on by the policies of US president Donald Trump, this week's exchequer returns for July showed that Ireland's tax take from big business keeps on climbing and could exceed €30 billion this year. Estimates from the Department of Finance and the Fiscal Advisory Council (IFAC) suggest that around half of this total could be what they term windfall receipts. This means that they relate not to economic activity in Ireland, but to tax planning by the big multinationals. Ireland's vulnerability lies in two areas – the longer-term relocation of manufacturing activity, were this to happen due to Trump's policies, and changes in tax planning structures and pricing policies . Perhaps, politically, it is best to take a 'glass half full' approach to these issues, focusing on the money that Ireland is now receiving and the opportunity it creates. A key point here is that putting money away now – as the Government is doing into two funds – does create some leeway for future years both to avoid cutbacks in current spending or higher taxes and to maintain vital State investment. READ MORE However, the ability of the Irish political system to learn the lessons of the past is questionable. The amount which has been put into the two funds is useful, but still relatively modest. And there is already talk of raiding one of them to pay for investment projects under the revised National Development Plan. Meanwhile, a debate is heating up on the October budget, centred on how much money people will get and to what extent taxes will be reduced. A key part of this is whether there should be another 'cost-of-living' package comprised of once-off payments. This would be a mistake. As well as higher investment, it is time to focus on permanent improvements aimed at those who need it – and the provision of better services to the public in areas like health, education and childcare. The political problem is that the State may well have leeway in its budget sums, creating demands for more largesse. But a key goal of Budget 2026 must be to reduce risk. Ireland cannot rely on exchequer returns continuing ahead of forecasts each year. Some day, its luck will turn. Nobody knows whether, in two or three year's time, the €30 billion we may collect this year in corporation tax might be €35 billion or €20 billion. In case the wolf does arrive, this budget cannot afford to spray money around to households again in once-off payments, pretending to address the ' cost of living' but in fact giving cash to many who do not need it, as well as some who do.

Fox News bemoans ‘dangerous' Dublin - with some questionable data
A Fox News show has reported on Dublin as being among the most dangerous cities in Europe , basing some of its claim on the findings of a betting website. An item on Monday's Will Cain Show, which featured media commentator and author Douglas Murray talking about open borders migration , claimed Dublin had gone from being one of the safest cities in Europe to one of its most dangerous. An on-screen graphic linked to a headline on the Sunday World website from January 2024 – 'Dublin ranks among the top ten most dangerous major cities in Europe, survey claims'. The source for the Sunday World article was the Online Betting Guide (OLBG) in a survey entitled European Nightlife Index Casinos. READ MORE In it, Dublin was ranked ninth in Europe with Birmingham, Naples and Paris placed among the most dangerous. The Sunday World article stressed that OLBG did not include the methodology it used. An OLBG spokeswoman told The Irish Times the figures came from another website, Numbeo, which describes itself as the 'world's largest cost of living database and a crowdsourced global resource for quality of life data'. The results of the OLBG survey were posted by Conor McGregor on X on February 26th this year and quoted by Fox News presenter Will Cain on Monday's show. Yesterday, Trump singled out Irish Pharmaceuticals for new Tariffs. Also yesterday, Fox News did a hit job on Ireland… citing 2024 headlines about crime statistics and bringing on Douglas Murray as a panel guest to discuss it. If your business depends on American tourists…… — Nick Delehanty (@Nick_Delehanty) Other crime figures quoted on the show cited the Central Statistics Office (CSO) as a source. One stated that robbery had increased by 18 per cent in the first quarter of 2024 and violent crime by 10 per cent in the same period. CSO crime statistician Felix Coleman questioned the Fox News figures as it was unclear what the robbery numbers from Q1 2024 were being compared to. There was a decrease in robberies from 1,038 in Q1 2023 to 1,009 in Q1 2024, a fall of 2.6 per cent, rather than the increase of 18 per cent reported by Fox. The Q1 figures for 2025 show 824 robberies, a decrease of 18 per cent. Mr Coleman said there was no category in the CSO statistics for violent crime and it was unclear where those figures on Fox News came from. The show further stated there had been a 114 per cent increase in murder and assault attempts in Dublin in 2024, citing figures from the Garda Dublin Metropolitan Region, but they did not say which period they were comparing the data with. A Gript website article from March this year stated there had been a 114 per cent increase (Gript revised it upwards to 131 per cent) in attempts/ threats to murder, assaults, harassments and related offences within the Dublin Metropolitan Region between 2003 and 2024, rising from 3,685 to 8,500. Photograph: Getty Images The same article stated the number of recorded crimes in Dublin had fallen over the past two decades, by approximately 7.5 per cent. The Fox News show correctly stated there had been a 98,700 increase in the population between April 2023 and April 2024, up 1.9 per cent, the highest since 2008. That comprised of net inward migration of 79,3000 combined with a natural increase (births less deaths) of 19,400. According to the CSO, 149,000 immigrants came to Ireland between April 2023 and April 2024. There were 86,800 immigrants who were not returning Irish, or EU or UK citizens. Of the 86,800, nearly 50,000 were Ukrainian, Indian or Brazilian citizens who have arrived in Ireland; fleeing the Russian invasion in the case of Ukrainians, or through work visas in the case of those coming from India or Brazil. Mr Murray claimed the population and alleged crime surge in Ireland was the result of people in the Middle East and Africa coming to Europe to seek the best welfare and housing supports. He provided no evidence to back up his claim. Fox News has been contacted for comment.
