Court of Appeal allows govt's appeal in armed forces pension adjustment case
PUTRAJAYA: The Court of Appeal today allowed the appeal by the government and three others to overturn a High Court's ruling that had previously favoured 50 retired Malaysian Armed Forces (MAF) personnel in a pension adjustment dispute.
In a unanimous decision, the three-member panel chaired by Justice Datuk Hashim Hamzah ruled that the military personnel failed to prove that the Malaysian government, the prime minister, the defence minister and the Malaysian Armed Forces Council had breached the provisions under the Federal Constitution.
"We find there is merit in the defendants' appeal that warranted appellate intervention," said Hashim, who sat with Justices Datuk Wong Kian Kheong and Datuk Ismail Brahim.
The judge said the defendants cannot be said to be breaching Article 147 of the Federal Constitution as they have not placed the plaintiffs in a less favourable position.
The court allowed the appeal with no orders as to legal costs.
Wong, who wrote a supporting judgment, said two documents, namely, Garis Panduan Pelaksanaan Pindaan Syarat-Syarat Perkhidmatan ATM dated Jan 17, 2013, and Surat Pelaksanaan Kesetaraan Pangkat dan Penambahbaikan Jadual Gaji Minimum Maksimum bagi Perkhidmatan ATM di bawah SSM dated March 14, 2013, were not salary adjustment but were amendments to the terms of service for serving members of the MAF.
He said that the objective is to improve the salary scheme for serving members and not to discriminate against retirees who retired before Jan 1, 2013.
Wong also said that there was no unequal treatment between pensioners who retired before Jan 1 and those who retired after Jan 1, 2013, as pension adjustments were not made for retirees after Jan 1 that year.
On Feb 5 last year, the High Court ruled that all military personnel who retired before Jan 1, 2013, are entitled to have their pensions adjusted to the rates and methods applied to the retirees who retired after Jan 1, 2013.
The 50 military personnel of various ranks filed an originating summons in the High Court on Nov 17, 2022, seeking a declaration that the government had violated the provisions in Federal Constitution read together with Section 187 of the MAF Act 1972 for their respective failures to implement new pension adjustments for the MAF retirees who retired before Jan 1, 2013.
They claimed that the government's failures to implement the pension adjustments had caused a significant pension gap between the MAF retirees who retired before Jan 1 and those who retired after Jan 1, 2013.
In today's proceedings, Federal Counsel M. Kogilambigai appeared for the government while lawyer Mohamed Haniff Khatri Abdulla represented the retired personnel.
After the court proceeding, Haniff Khatri told reporters that he would study the court's grounds of judgment before deciding whether to bring the matter up to the Federal Court.

Appeals court to hear Anwar's interim stay to suspend trial on Tuesday
On Wednesday, Justice Roz Mawar Rozain dismissed Prime Minister Anwar Ibrahim's application to refer eight questions to the Federal Court as they failed to cross the threshold set out in Section 84 of the Courts of Judicature Act 1964. (Bernama pic) PUTRAJAYA : The Court of Appeal will hear Prime Minister Anwar Ibrahim's application for an interim stay of the trial of a civil suit filed by a former research assistant on Tuesday, pending the outcome of an appeal. Lawyer K Rajasegaran, who appeared for Anwar, said the date was fixed following case management before a court deputy registrar this afternoon. Rajasegaran said the court also fixed July 21 to hear a permanent stay application of the trial until the outcome of Anwar's appeal to set aside the High Court's refusal to refer eight legal questions arising from the suit. Anwar had wanted the Federal Court to determine whether a sitting prime minister could be given protection from 'frivolous and politically motivated' suits while holding office. In the stay application filed yesterday by Messrs Zain Megat & Murad, the solicitors said there existed special circumstances to suspend the assault suit scheduled to begin in the High Court on June 16. They said the appeal to refer the legal questions to the Federal Court would be nugatory if the trial proceeded. 'The adjournment in the High Court is of utmost importance and is necessary to preserve the principles of justice, equality and constitutional integrity,' they said. They said the postponement would allow for complex and high-impact constitutional questions to be properly determined and interpreted. On Wednesday, Justice Roz Mawar Rozain dismissed Anwar's reference application, when it ruled that all eight questions posed failed to cross the threshold set out in Section 84 of the Courts of Judicature Act 1964. She said none of the articles cited in the Federal Constitution, as argued by Anwar's lawyers, gave rise to any real, substantial and justiciable questions of law that require a determination by the apex court. Roz Mawar had ordered for the trial of Yusoff Rawther's suit to begin at 9am on June 16 as scheduled. The prime minister wanted the apex court to rule whether Articles 5(1), 8(1), 39, 40 and 43 of the Federal Constitution grant him qualified immunity from a suit filed by Yusoff four years ago. The suit relates to events which allegedly took place before Anwar took office on Nov 24, 2022. Yusoff, a grandson of the late Penang consumer advocate SM Mohamed Idris, claims he was assaulted at Anwar's home in Segambut in October 2018. He is seeking general, special, aggravated and exemplary damages, as well as interest, costs and other relief deemed fit by the court. Anwar denies the claim and has filed a countersuit.

Thai PM thanks Anwar for offer to assist in border dispute
BANGKOK: Thai Prime Minister Paetongtarn Shinawatra has discussed the Thai-Cambodia border situation with Malaysian Prime Minister Datuk Seri Anwar Ibrahim in a phone call on Friday, where Anwar expressed readiness to assist both sides in resolving the dispute. "Thank you, PM Anwar Ibrahim, for the call this afternoon to discuss the Thai-Cambodian border situation and to express readiness to help both sides resolve the matter. I reaffirmed Thailand's commitment to a peaceful resolution through existing bilateral mechanisms while safeguarding our sovereignty in accordance with international law," she stated on her official X account. Malaysia, as the current Asean chair, is closely monitoring developments on the border issue. Earlier on Friday, after chairing a National Security Council meeting, Paetongtarn announced Thailand had established a special task force to address security concerns along its border with Cambodia. She said the army had been assigned to coordinate operations and maintain readiness to respond to any developments, prioritising sovereignty protection while ensuring international relations and national security. The meeting was attended by Deputy Prime Minister and Defence Minister Phumtham Wechayachai, Foreign Minister Maris Sangiampongsa, Supreme Commander General Songwit Noonpakdee, National Security Council Chief Chatchai Bangchuad, and the military's commanders-in-chief. On May 28, Thai and Cambodian troops engaged in a brief gunfight in Thailand's north-eastern Ubon Ratchathani province and Cambodia's northern Preah Vihear province, where one Cambodian soldier was reportedly killed. Cambodia has since announced its intention to bring the border dispute to the International Court of Justice (ICJ). Meanwhile, both countries have agreed to discuss the issue through the Joint Boundary Commission (JBC), which is set to meet in Phnom Penh on June 14.– BERNAMA
