Education MEC calls for swift justice as suspect appears for rape of northern KZN pupils

The 28-year-old man accused of raping learners at a northern KwaZulu-Natal court was back before the Nkandla Magistrate's Court on Wednesday to face charges in connection with the incidents.
KwaZulu-Natal Education MEC Sipho Hlomuka condemned the crimes and called for swift action by the justice system.
'We stand united in condemning the horrific crime of rape and calling for the full weight of the law to be applied against the perpetrator. Rape is not only an attack on an individual's body, but also a violation of their dignity, humanity, and fundamental rights.
'Justice must be served, and in cases of sexual violence, society has a moral and legal duty to act firmly and without compromise. We therefore call on the justice system to act swiftly in ensuring that this rapist is convicted and held accountable for his heinous crimes,' MEC Hlomuka said in a statement.
The suspect was arrested on May 20 following a coordinated effort by police, community members, and stakeholders, including the Bhekisizwel Taxi Association.
At the time, he was accused of raping learners residing in cottages at the high school, sparking outrage across the province.

The suspect briefly escaped police custody while being transported to a correctional facility but was rearrested. 'When the police were busy assisting him, the suspect escaped and ran into the darkness. A dedicated team was established to track him down,' said KwaZulu-Natal police spokesperson Colonel Robert Netshiunda.
A province-wide manhunt ended successfully when police tracked him to a hostel in Umbilo on May 22.
He was rearrested and later appeared in Pinetown Magistrate's Court on charges of escaping lawful custody.
Following his rearrest, the suspect was set to be transferred back to Ekhombe to face multiple rape charges.
The Department of Education said it had deployed psychologists to support the affected learners and their families and reaffirmed its commitment to ensuring schools remain safe spaces.
'This case is a reminder that rape has no place in our society. The conviction of this perpetrator will not only bring justice but will also serve as a powerful message that those who commit such crimes will face the consequences of their actions,' MEC Hlomuka added.

Van Niekerk said the affected victims lured them by using 'Christ's name' to defraud congregants. She lost everything and where she lives there is no tap. She lives off a R320 Sassa grant and on a previous occasion when I had asked her to be at court, she was unable to afford the traveling costs. 'Another witness said they had invested their own money as well as a friend's funds which came from a deceased estate. The person said they now still owe money to that friend for the money that was lost. This person asked that the accused be imprisoned for a long period. Another victim said they have lost all their money from their pension fund and now, with a sickly spouse, they are unable to pay money for a caregiver. They said they trusted the persons with their money and they asked for a 100 year imprisonment,' said Van Niekerk. In mitigation of sentencing the accused counsel advocate Winston Erasmus called two pastors to the witness stand who held years long relationships with the accused. Theodore Mitchell testified that Davids was a mentor to him and he witnessed the co-pastor's remorse for his actions following lengthy discussions over the last three years. According to Mitchell, Davids should not be imprisoned as he 'could serve greater impact in the community' if he was given a non-custodial sentence. The second witness for the defence, Peter Barnes, echoed the call that a non-custodial sentence is imposed. According to Barnes, Bredekamp had a positive impact on his community and he was missed by congregants who he had previously given advice and support to. During the trial, the State proved that Davids was the sole member of Platinum Forex CC and chief executive officer of the company and Bredenkamp was the marketing manager. They made payments to various forex brokers to conduct forex trading, totalling R87.5 million, the large majority of which was lost. Monthly interest paid to investors and lenders was generated from investments and loans received from new investors and lenders. During trial senior state advocate Jannie Knipe also proved that the three accused and agents acting on their behalf were not entitled and authorised to accept deposits, investments, and loans from the public. National Prosecuting Authority spokesperson Eric Ntabazalila had said: 'They promised to hold in trust such investments and utilise such deposits, investments, and loans for forex trading on behalf of and to the benefit of the complainants. They would pay the monthly interest earned by the complainants on their investments and loans from the profits realised from forex trading. 'They (the accused) further misrepresented that they could provide the complainants with a 2 to 8% monthly return on their investments and loan periods and would reimburse the capital amounts invested and loaned with interest in terms of the agreements concluded with the investors and lenders on their investments and loans from the profits realised from holding in trust and forex trading. "The State alleged that the parties, as part of money laundering, bought property equipment, furniture, which concealed or disguised the nature, source, location, disposition or movement of the said monies.' The accused made their first appearance on 29 November 2017, and the case was postponed numerous times due to various applications. Throughout court proceedings the accused maintained their innocence and pleaded not guilty.

Didiza defends parliamentary legal services amid Mkhwanazi inquiry scrutiny

Image: Supplied National Assembly Speaker Thoko Didiza has come to the defence of the parliamentary legal services after it came under scrutiny in the Ad Hoc Committee inquiring into the allegations made by KwaZulu-Natal Police Commissioner, Lieutenant-General Nhlanhla Mkhwanazi. This comes after members of the inquiry were unhappy with remarks made by a member of the legal team that the allegations made by Mkhwanazi were technically not evidence. The remarks have been used as one of the motivations by some MPs to call for the appointment of an external legal counsel to lead evidence in the inquiry. On Thursday, Didiza said she noted with concern certain remarks made during proceedings of the Ad Hoc Committee, questioning the competence and integrity of the legal team assigned to support the committee. 'However, it is profoundly important to distinguish between debating the merits of advice and launching unjustified personal attacks on the integrity or competence of the legal professionals who provide it. 'To cast aspersions on these officers of the court for how they deliver their legal opinions or for their considered advice is not only unfair and unjust to the individuals concerned, but also poses a serious risk to the credibility of Parliament and the integrity of its processes, including those currently before the Ad Hoc Committee.'

ANCYL slams corruption in Polokwane municipality, calls for arrests over scandals

In an interview with IOL, Malatji said: 'Anyone caught participating in corrupt activities must face the full might of the law. Law enforcement agencies must act urgently and decisively.' Mayor John Mpe is facing growing scrutiny following accusations of irregularly awarding tenders and allegedly giving political and economic favours to foreign nationals. The allegations have triggered public outrage and renewed questions about ethical leadership within the ruling party. Mpe remains in office. He is not charged with any wrongdoing. Malatji did not mince words, stating that those implicated — including leadership — must be "brought to book" without delay. While urging for unity in Limpopo — a historically significant base for the ANC — Malatji stressed that unity cannot exist without discipline and accountability. 'Limpopo is a special province.
