Tragic recovery: Body of missing boy found at Mdumbi Beach

The body of a young boy who went missing at Mdumbi Beach in the Eastern Cape on Sunday, June 1, has been recovered.
The National Sea Rescue Institute (NSRI) confirmed the body of the seven-year-old boy was located and recovered on Tuesday evening by local fishermen.
The child was reported missing on Sunday after he and three other children were caught in rip currents while swimming during the outgoing tide.
Off-duty lifeguards responded promptly, while volunteers from Mdumbi Backpackers, who had been surfing nearby, noticed the group of children in distress and rescued three girls from the surf using their boards. Sadly, indications suggested a fourth child remained missing in the water.
NSRI spokesperson, Craig Lambinon, said the boy's body was found in the vicinity of where he went missing days earlier.

'The family of the child, police, and Government Health Forensic Pathology Services attended the scene where the body of the child was located and recovered. The body of the child was taken into the care of the police and the Government Health Forensic Pathology Services. Police have opened an Inquest docket. Our thoughts, care, and compassion are with the family and everyone involved. The fishermen, who located the body and raised the alarm, have been commended,' Lambinon said.
A 13-year-old girl, who had been among those rescued, was treated on the beach for non-fatal drowning symptoms and transported to hospital in a serious but stable condition by a family member. Tragically, she died on Monday.

Image: Supplied THE Western Cape High Court has rescinded the R1.25 million defamation judgment Hanks Olde Irish Pub won against Christopher Logan relating to his comments about an alleged racist incident at the venue in December 2022. The rescission application was lodged in December 2024, one month after the ruling was issued. With his notice of intention to defend due Thursday, he is gearing up to contest the case in court. 'The applicant (Logan) must file his notice of intention to defend the main action by Thursday, 14 August 2025. The third defendant (John Papadakis, the owner) in the action to file a plea by 11 September 2025. The Plaintiffs to file replications if any by 02 October 2025. The matter to proceed by means of case management before Judge Erasmus by a date provided by his office,' the court order read. Last year, the court ordered Logan to pay R1.25 million in damages to the owners after he publicly accused the establishment of racism, an allegation they denied. In December 2022, Logan's friend Thabiso Danco alleged that he was denied entry to Hank's Olde Irish Pub because he was not accompanied by a white person. Logan later claimed that the bouncer justified the refusal with a discriminatory remark and stated he was acting on instructions from the owners. The owners pursued legal action arguing that the allegations were not true and their reputation was severely harmed by Logan's public accusations of racism. The court awarded damages to the owners for loss of income and defamation. As a result, Logan was ordered to pay R500,000 to owners' business for loss of income, R250,000 in general damages, and R250,000 to each owner personally, plus interest. A month later he filed an application for rescission. Logan on Tuesday said the original order was a default judgment, granted without him having had the opportunity to present his defence or be heard in court. 'I was never given a fair hearing or the chance to respond to the allegations." 'While I stand by my account of that day and my condemnation of the racist conduct witnessed, I was denied the chance to defend myself in the defamation action that followed. Today's decision restores the principle that such matters must be decided in open court, with all parties having the opportunity to be heard. Lawyers for Hanks and Marèsa Nel said they had reached an agreement with Logan's legal team regarding the rescission of the default judgment, but emphasised that this did not alter their stance, as they still intend to oppose the case. '(On Monday), Hanks, through its legal representatives Advocate Marius Botha and Marèsa Nel, reached an agreement with Logan's legal representatives that the Court may be informed of the parties' consent to the rescission of the Default Judgment granted against Logan in November 2024. 'Hanks' legal team voluntarily agreed to the rescission due to an error in the Default Judgment specifically, the incorrect use of the word 'Bar.' Importantly, this correction does not alter Hanks' case against Logan in any way. The Honourable Court accordingly granted the rescission and issued directions regarding the deadlines for Logan to file his Notice of Intention to Defend in the main action, as well as his plea. 'Should Logan fail to defend the matter once again, Hanks will promptly reapply for Default Judgment. Image: File THE State was dealt a blow in the notorious gang murder trial against the Terrible Josters' alleged gang leader, Elton Lenting, and his 19 co-accused when its application to have a statement admitted as evidence was denied in the Western Cape High Court. A warning statement, which the State sought to have admitted as evidence, by a now-deceased co-accused, was deemed inadmissible by the high court this week. However, Judge James Lekhuleni dismissed the State's application for the admission of the warning statement of deceased Delano Saptoe against accused 3 and 14. Lenting and his co-accused face a plethora of criminal charges, including murder, attempted murder, possession of illegal firearms and ammunition. The application was brought by the State in terms of Section 3(1)(c) of the Law of Evidence Amendment Act 45 of 1988 (the Hearsay Act). Saptoe was never an accused person in the ongoing trial against Lenting and others. 'Ostensibly, he could have been charged with the other accused before this court, but he was not charged due to his untimely demise before the 20 accused were charged and transferred to this court for trial,' said Judge Lekhuleni. The warning statement submitted by the deceased dealt with issues relating to a shooting incident. 'In the disputed statement, the deceased (Delano Saptoe) implicated accused 3 and 14. Saptoe stated that on a date and time he could not remember, he was with Lorenzo Coetzee, also known as 'Draad' (accused 3), and Wandisile, also known as 'The One' (accused 14), and they went through a footpath that leads to another street. He then remained seated on the poles on the footpath and accused 3 and 14 proceeded further,' the court record read. Further in the disputed document, Saptoe stated that he did not know that accused 3 and 14 had a firearm in their possession. 'According to him, accused 3 and 14 went down the footpath… After that, he heard several gunshots going off. When he observed, he saw accused 14 holding a black firearm in his hand, which had a brown handle. Thereafter, accused 3 and 14 came back running, passed him, and told him to run away as the people they were shooting at would come and shoot him. The witness stated that he also ran away. After that, they separated, and that was the last time he saw accused 3 and 14. Saptoe asserted further that he did not shoot anyone, but it was accused 3 and 14 who were shooting,' the judgment read. Judge Lekhuleni said: 'Furthermore, the fact that the deceased did not appear with the 20 accused in this matter is inconsequential. This court accepted several statements of State witnesses in terms of Section 3(1)(c) of the Hearsay Act who were deceased and could not testify in this matter. 'The status of those witnesses whose statements were admitted did not change because they did not testify and are now deceased. They are considered as witnesses even though they are deceased and did not testify. Their status is considered and determined by their position at the time of making a witness statement. 'Saptoe's status as a co-accused of accused 3 and 14 should accordingly be determined at the time he made the statement. 'The warning statement was clearly made by an accused person or suspect who, in this instance, appeared as a co-accused with accused 3 and 14 in the lower court. Consequently, based on the legal principles discussed above, the impugned statement of Delano Saptoe is inadmissible against accused 3 and 14.' Cape Times

Joshlin's mother, Kelly Smith, her boyfriend, Jacquen 'Boeta' Appollis, and Steveno van Rhyn were sentenced on May 29, and are currently serving life plus 10 years for trafficking in persons and kidnapping. On Tuesday, Boeta's lawyer, Fannie Harmse, argued that certain statements had been overlooked by presiding officer Judge Nathan Erasmus.
