Hearing set after petition filed by family of Jabari Peoples to see body camera footage
Leroy Maxwell, the attorney for Vivian Peoples, said the petition asks the city of Homewood to turn over evidence including the body camera footage and/or dashcam footage from the incident that could be used in a potential wrongful death lawsuit.
The petition also asks for the city of Homewood to release the names and identifying information of all officers present at the scene and investigative reports. The filing cites Rule 27 of the Alabama Rules of Civil Procedure as it seeks to preserve evidence for use in an anticipated wrongful death action.
The case was originally assigned to judge Patrick Ballard, but has now been assigned to Elisabeth French after Ballard recused himself. A hearing on the matter is set for Aug. 4 at 9 a.m.
