Dara Singh may have to spend more time in jail as Odisha govt defers decision

Bhubaneswar: Dara Singh alias Rabindra Kumar Pal, who has been in jail for the last 24 years over his conviction in the murder of Australian missionary Graham Stewart Staines and his two minor sons, may have to spend more time behind bars with the Odisha government deferring a decision on his release.
The state sentence review board which met on May 17 in Bhubaneswar to decide on the premature release of life convicts as per the guidelines issued by the state government in 2022, deferred its decision on his release despite recommendation by the authorities in Keonjhar prison, where he is lodged as well as the district authorities.
'The Board does not feel proper to recommend the release and suggested deferment of the case to call for further report from the district administration,' said a person familiar with the issue. 'Hs name was among the 86 convicts that were recommended for release by different jail authorities. However, the state sentence review board recommended for release of only 46 persons and rejected the names of others including Dara Singh.' All the 46 persons whose cases were recommended for premature release are murder convicts who have served anything between 9 and 20 years in prison.
Of the 39 convicts whose cases were rejected by the state sentence review board, many were shown to be capable of committing further crimes while in case of Singh, 61, no such reasons were shown except that he was convicted in three murder cases in which he killed five people.
State director general of prisons Sushant Nath who attended the state sentence review board meeting on May 28 refused to comment on the decision. However, one person who attended the meeting, said the decision was more to do with sheer timing of celebration of BJP government's first anniversary next month than anything else. 'The government does not want a controversy over release of Dara at this point of time when the party and the government are geared up to celebrate the first anniversary. Apart from that there is no other pressing reason,' he said.
Singh, a resident of Kokar village in Auriya district of Uttar Pradesh, has been in jail since 2000 after his arrest by police. He was first given death sentence by a CBI court in Bhubaneswar in 2003, which was commuted to life sentence in May 2005 by Orissa High Court. The Supreme Court upheld the life sentence in January 2011. As per police, he came to Odisha along with his friend Chitaranjan Das alas Bapu Das with whom he worked in a shoe factory in New Delhi. After getting sacked from the job, he came to Maliposi village of Keonjhar at the suggestion of Dipu Das brother of Bapu Das. Dipu Das was initially an accused in the Staines' murder case, but courts acquitted him. In Keonjhar, he worked in the grocery shop of Das' father and did odd jobs such as Hindi teacher in the Maliposi school before became a Hindu zealot attacking cow traders and protesting proselytization of tribals in Keonjhar and Mayurbhanj districts.
The Supreme Court in July 9, last year, had issued notice to the Odisha government on the plea for Singh's premature release. Singh said he believes in the Karmic philosophy, and in order to cure the effects of bad Karma he has gained through his actions, he prayed for an opportunity to reform his character. In his plea, filed through advocate Vishnu Shankar Jain, Singh said he had spent over 24 years in incarceration and 'repented' the consequences of his action taken in a fit of 'youthful rage'.
Singh, 61, in his petition said he had undergone more than the qualified period of sentence of 14 years under the April 19, 2022 policy and spent 24 years of actual imprisonment without remission. The April 2022 policy of Odisha home department on premature release of prisoners says every convicted prisoner whether male or female undergoing sentence of life imprisonment and covered by the provisions of section 433 A of the Code of Criminal Procedure, 1973 shall be eligible to be considered for premature release from the prison immediately after serving out the sentence of 14 years of actual imprisonment i.e. without the remissions.
'...it is clarified that upon completion of fourteen years in prison by itself will not entitle a convict to be released automatically from the prison and the State Sentence Review Board shall have the discretion to release a convict at an appropriate time and cases considering the circumstances in which the crime was committed and the other factors, namely: -
(a) whether the convict has lost his potential for committing crime considering his overall conduct in jail during the fourteen years incarceration;
(b) the possibility of reclaiming the convict as a useful member of the society; and
(c) Socio-economic condition of the convict's family...'
Dara in his submission before the Apex court said....he has never been released on parole and even when his mother passed away, and he could not perform her last rites as he was not allowed to be released on parole. 'The petitioner acknowledges and deeply regrets the transgressions perpetrated more than two decades ago. In the fervour of youth, fuelled by impassioned reactions to the brutal history of India, the petitioner's psyche momentarily lost restraint,' Dara's lawyer Vishnu Shakar Jain in his plea said.
Dara Singh's hopes were raised when Mahendra Hembram, 50, who served life sentence with him in Keonjhar jail walked out of prison last month after serving 25 years in prison in the Staines murder case. The State Sentence Review Board had ordered Hembram's release because of good behaviour.

Chennai, June 8 (UNI) Amid the widening rift between the father-son duo in the first family of PMK and the continuing reconciliatory efforts by senior leaders stressing unity, its Founder on Sunday said the differences with his son Dr Anbumani on leadership and alliance issue for the 2026 key Assembly polls will be resolved soon, while observing that Union Home Minister and senior BJP leader Amit Shah was right in his assertion that the NDA will form the government in Tamil Nadu in 2026. Dr Ramadoss remarks was seen as a climb down from his hardened stance that led to the differences with Dr Anbumani--who he said was insisting on an alliance with the BJP for 2026 polls--having realised the imperative need for the PMK to face the polls as an united party instead of a divided house. Dr Ramadoss, who had earlier said that every problem has a solution, while referring to the media querieson the ongoing row with his son, said the differences with Dr Anbumani will be resolved soon. "Only then we can face the elections (as a united party)", he added. On Mr Amit Shah's declaration in his address at the BJP Party workers meeting in Madurai that "the change starts from 'corrupt' ruling DMK will be ousted and the BJP-AIADMK led NDA will form the government in Tamil Nadu in 2026", the PMK Founder, who had earlier seemed to be disinclined to have an electoral tie up with the saffron party that widened the differences with his son, said "he (Amit Shah) is right in his remarks that the NDA will form the government in 2026 in Tamil Nadu". This remark of Dr Ramadoss can be seen as a significant shift in his stand, while hinting that the PMK was ready for returning back to the NDA fold. Refusing to make comments about any political party at this juncture, the senior Ramadoss, without taking any names, said "if we are with them, they will talk highly about us (PMK). If not, they will talk in a different way". New Delhi: The National Investigation Agency (NIA) will probe the murder of Hindu activist Suhas Shetty by a group of assailants in Mangaluru, Karnataka, last month, official sources said on Sunday. The Union Home Ministry has asked the federal anti-terror agency to probe the case related to the "targeted killing" of Shetty "with the intention to create terror in the minds of people", they said. Citing a home ministry communique in this regard, the sources said the accused involved in the murder case are allegedly members of the Popular Front of India (PFI), a banned outfit. "The NIA has received an order from the Union Home Ministry to investigate the case. The process to register the case is underway," a source said. The NIA probe is required due to the gravity of the offence, its national ramifications as well as the need to unearth the larger conspiracy, the sources said, citing the home ministry order. Shetty was killed at Kinnipadavu in Bajpe on the outskirts of Mangaluru on May 1. He was travelling in a vehicle with his associates when five-six assailants, who came in a car and a pick-up vehicle, intercepted him. The assailants attacked Shetty with sharp weapons, causing grievous injuries. He was rushed to a hospital, where he succumbed to his injuries The gruesome attack was captured on a CCTV camera, which showed the assailants attacking him with machetes and swords. Shetty was reportedly associated with various local Hindutva groups and had several cases registered against him, including for assault, murder and unlawful assembly, according to the local police. Karnataka Police on June 3 arrested Abdul Razak (59), a resident of Mangaluru, for allegedly conspiring and sheltering the prime accused in Shetty's murder case. The total number of arrests made in this case stood at 16, police said. According to police, Razak is the father of Mohammed Muzammil, one of the key accused, and the father-in-law of Nausad Vamanjoor alias Chotte Nausad, another suspect in the case. He allegedly conspired with them and others at his residence to plan the murder and later helped the accused evade arrest, according to the police. Four days after a deadly stampede in Bengaluru, a family in Karnataka's Kolar was handed a financial compensation for the damage that cannot be compensated - the loss of their 24-year-old daughter. Kolar deputy commissioner MR Ravi visited the home of Sahana, one of the 11 people who died in the June 4 stampede that occurred in front of the Chinnaswamy stadium during the Royal Challengers Bangalore (RCB) team's IPL victory celebrations. Forty-seven were injured in the tragedy. Her mother broke down as she was offered the cheque of Rs 25 lakh compensation by the officer. Sahana's father, who was trying to hold back his tears, burst out crying as soon as he touched the cheque. As other family members comforted them, the parents were seen weeping uncontrollably. All the victims of the stampede were in the 20-30 years age group with a 14-year-old being the youngest - Divyanshi (14), Doresha (32), Bhoomik (20), Sahana (24), Akshata (27), Manoj (33), Shravan (20), Devi (29), Shivalinga (17) and Chinmayi (19) and Prajwal (20). Earlier, the Karnataka government had announced a compensation of Rs 10 lakh each, which was later increased to Rs 25 lakh per family. The opposition BJP has been criticising the Congress government in the state, accusing Chief Minister Siddaramaiah and his deputy DK Shivakumar of "apathy". "The police had informed them of the first death by noon. Eight young ones had already died when the event began, yet the programme continued, showing that these leaders have hearts of stone," said Leader of Opposition in Karnataka Assembly R Ashoka. The tragedy has also led to a blame game with the state government suspending police officers, and cops saying that they had flagged concerns about the event. Several officials, including Bengaluru Police Commissioner B Dayananda, have been suspended for alleged laxity that led to the stampede. Four people, including an RCB marketing head, have been arrested so far. A letter accessed by NDTV established that the police force deployed at the Karnataka Vidhana Soudha had warned against the idea of holding the RCB's IPL trophy celebrations at the grand stairs of the premises. In a letter to the Department of Personnel and Administrative Reforms on June 4, Vidhana Soudha's Deputy Commissioner of Police (DCP) MN Karibasavana Gowda pointed out the lack of time for security preparedness to tackle "lakhs of cricket fans" expected at the spot. R Ashoka slammed the government for going on with celebrations both at Vidhana Soudha and the stadium thereafter, despite deaths due to a stampede, and called the Chief Minister and Deputy Chief Minister "inhuman". On Saturday, top senior officials of Karnataka State Cricket Association (KSCA), Secretary A Shankar and Treasurer ES Jairam, tendered their resignations, taking "moral responsibility" for the stampede.
