Perth and Kinross councillor calls for urgent review of national planning policy on retail developments

The Planning and Placemaking Committee convener believes the current policy on retail developments "lacks coherence" and risks "stifling competition"
Perth and Kinross Council's (PKC) planning convener has written to the Scottish Government saying there is an "urgent need" for a review of national planning policy regarding retail.
SNP councillor Ian Massie - who wrote to Public Finance Minister Ivan McKee on behalf of PKC's Planning and Placemaking Committee - said the current policy "lacks coherence" and "will not strengthen town centre High Streets".

Cllr Massie's committee requested he write the letter after councillors approved a new Lidl supermarket on Perth's Crieff Road, going against the council officers' recommendation of refusal which was based on national policy.

On Wednesday, March 12 councillors voted by nine votes to two to grant Lidl permission to invest £10 million building a second Perth store and creating over 30 jobs.
They rejected council officers' recommendation to refuse the application, arguing the development would give residents "more choice" and supported the National Planning Framework 4's (NPF4) 20-minute neighbourhoods.
The only objector to the application was Tesco, which has a store on the other side of McDiarmid Park from the proposed Lidl site.

At the March meeting, convener Ian Massie pledged to write to Scotland's Public Finance Minister raising the committee's concerns about the conflicting national planning policy.
In response to a request from the Local Democracy Reporting Service, PKC this week shared both Cllr Massie's letter and the response he received from Ivan McKee MSP.
In his letter, Cllr Massie said the current policy could result in "stifling competition".

Referring to the committee's decision over the Lidl application, he wrote: "The officers' recommendation was for refusal on the grounds that it did not meet Policy 28: (a) and (c) as it was not located in an existing city, town or local centre, nor was it in an edge of centre area, or an allocated site within the LDP; (b) was not applicable as it did not meets the terms of (a); and also (c) Small scale neighbourhood development because the proposal could not be classed as small scale.
"Whilst the committee agreed the criteria for Policy 28 (a) and (c) had not been met they went against officers' advice and granted permission stating that the application should be supported because it would provide over 30 jobs in the local area, help families on limited income afford more with what income they have and aligns with the Scottish Government's approach to 20-minute neighbourhoods , as outlined through Policy 15 of NPF4."
He called for planning policy to meet the "specific needs of our communities". The Perth City North ward councillor added: "Currently, the framework for Policy 28 lacks coherence on several crucial aspects, including the balance between High Street regeneration, out-of-town developments, and the promotion of sustainable practices within retail. However fundamentally, there is the lack of a specific reference to what floorspace thresholds should be deemed to define what is small scale neighbourhood development. "Unless there is an early review of the retail policy of NPF4 the likelihood is that the current policy will result in the planning system in Scotland stifling competition in this sector. This will favour those operators who secured consents for out-of-town centre sites over the last 20 years to the detriment of newer and possibly more innovative operators. It will not strengthen town centre High Streets. This is not 'good planning'. "
Ivan McKee thanked Cllr Massie for his letter and said the intent of the national planning policy was "to encourage, promote and facilitate retail investment to the most sustainable locations that are most accessible by a range of sustainable transport modes".
The Minister for Public Finance said there were a "range of factors" which need to be considered in planning assessments and there were no plans to review the policy.
Mr McKee said: " There is no scheduled review of NPF4 at this time, however it is helpful to have your input on the effectiveness of NPF4 policies and I am grateful to you for sharing your thoughts and experiences with us."

Lidl looks set to overtake Morrisons as the UK's fifth- largest supermarket after its market share hit a record high this summer. More than half a million new customers flocked to the discount retailer's 960 stores amid concerns over higher grocery bills. Lidl is now hot on the heels of Morrisons after its slice of the market hit 8.3 per cent over the three months to July 13, according to industry research group Worldpanel. Lidl sales over the period were 11.1 per cent higher than a year earlier when its share of the market was 7.8 per cent. The surge saw it further narrow the gap with rival Morrisons, whose market share has fallen from 8.7 per cent to 8.4 per cent in the past year, the report showed. Morrisons has already lost its position as the fourth-biggest grocer in Britain to Aldi. Nearly two thirds of households told Worldpanel they are very concerned about the cost of their grocery shopping. Price increases on key goods including cocoa and beef have ramped up pressure on supermarket chains locked in a bitter battle to retain shoppers. Morrisons' slip comes as boss Rami Baitieh attempts to engineer a recovery at the private-equity owned group. Last month, he said it had 'bounced back' after its technology supplier Blue Yonder was hit by hackers in November, throwing its stock systems into disarray. Morrisons has lost sales and market share to cheaper rivals since its takeover by Clayton, Dubilier & Rice (CD&R) in a debt-fuelled £7billion deal in October 2021. After Labour piled on costs for retailers at the Budget last year, Morrisons cut more than 350 jobs across its cafes, convenience stores, florists and fresh food counters, in March. The figures also underscored the woes facing Britain's third-largest grocer, Asda. The firm, also owned by private equity, saw sales plunge 3 per cent from £4.4billion to £4.25billion over the past three months, while its market share fell to 11.8 per cent. The dire performance came after executive chairman Allan Leighton insisted the 'green shoots' of recovery are appearing as it slashes the price of thousands of products and improves stock levels. A spokesman for Lidl said the record market share was 'a clear signal that shoppers are voting with their feet. 'This milestone reflects our long-standing position as the fastest-growing bricks-and-mortar supermarket in the UK, as well as our commitment to offering high quality, affordable produce – which is why we've attracted more than half a million new customers.' Meanwhile, Tesco improved its share to 28.3 per cent as sales grew by 7.1 per cent, the fastest rate since December 2023. And Britain's number two supermarket Sainsbury's saw sales climb by 5.3 per cent, putting its market share at 15.1 per cent. Tesco boss Ken Murphy has warned that Tesco was ready to take a £400million hit to profits this year as the competition hots up.

Balmanno House sale funds £1m boost for local charities

Balmanno House was a registered charity that provided residential care in the city's west end for more than 200 years. The home went into administration in April 2023, and efforts were made to ensure a smooth relocation of residents to other care facilities. The undisclosed sale amount ensured all creditors at the time of administration were paid in full, including statutory interest, redundancy pay, and other entitlements for former staff. Blair Milne and James Fennessey, joint liquidators and partners with accountancy firm Azets, are overseeing the distribution of the surplus funds to various charities, in line with the wishes of the Balmanno House trustees. Mr Milne, head of restructuring and insolvency in Scotland at Azets, said: "It gives me great pleasure to see such a substantial sum being made available for distribution to charity. "It is very rare for all creditors to receive full repayment together with interest from any insolvency process, let alone such a substantial sum being made available to charities." Allan Carrick, speaking on behalf of the board of trustees, said: "The former trustees of Balmanno House are delighted with the outcome of the administration and subsequent liquidation and are very pleased that so many deserving charities of their choice will benefit from the distribution of the surplus funds." Mr Milne thanked the trustees for their role in the process. He said: "I would like to express my thanks to the board of trustees for their actions and their support prior to the administration appointment and throughout the insolvency process. "The actions of the trustees, particularly seeking early advice on cash flow management, helped to ensure an orderly winding down of the care home operation, an optimal outcome from sale of the company's property asset, and ultimately a substantial sum being distributed to charity at the end of the process." He acknowledged the challenges faced by the care sector in recent years, saying that many care homes had no choice but to enter insolvency due to rising costs, insufficient funding, staff shortages, and unstable occupancy levels. He said: "As can be seen from the outcome achieved with Balmanno House, taking early advice on restructuring and insolvency ensures that all options remain available, either to restructure and preserve the business or to maximise the value available to stakeholders from a sale of the company's assets." The charities benefiting from the funds include Glasgow East End Community Carers, able2sail, St Francis Care Home, CrossReach, Association for the Relief of Infirmity in the West of Scotland, Ayrshire Hospice, Tenovus Scotland Strathclyde, Glasgow Children's Hospital, and The Prince and Princess of Wales Hospice.
