Court allows termination of pregnancy in Pocso case

Time of India13-05-2025

Surat: A local court on Tuesday permitted the
medical termination of pregnancy
(MTP) for a 23-year-old woman accused of sexually assaulting her 13-year-old tuition student. The woman was arrested on April 30, and medical tests conducted while in police custody revealed she was 20 weeks pregnant. The court directed the investigation officer to ensure the MTP is carried out at the Surat Municipal Institute of Medical Education and Research (SMIMER) and submit a report within a week.In its order, the court observed: "As per the medical opinion, it is opined that if the pregnancy continues, it will cause grave injury to her mental or physical health.
Thus, it appears that the explanation is satisfied in so far as the pregnancy on account of illegal relation is concerned."The court concluded that the pregnancy was a result of an illegal relationship and that the accused woman expressed her unwillingness to continue it. It added that continuation of the pregnancy could harm her mental and physical health and that termination would also be in the interest of the minor victim. The court instructed that the procedure be carried out in the presence of a team of expert doctors and ordered that the fetus be preserved for DNA analysis to aid the investigation."The court considered various arguments about how the pregnancy is risky for the life of the accused and the fetus," said Wajid Shaikh, lawyer of the accused.Earlier, DNA samples had been collected from both the accused and the victim boy.The woman was arrested under various sections of the Protection of Children from Sexual Offences (POCSO) Act. She was initially booked at Punagam police station on April 25 after allegedly fleeing with her 13-year-old student. The police later apprehended her near the Gujarat-Rajasthan border.Investigations revealed that the woman had travelled with the boy to several cities, including Vadodara, Ahmedabad, Jaipur, Delhi, and Vrindavan. Police allege she engaged in physical relations with the minor at her residence and other locations during this period.

"Why are daughters not safe in Delhi despite BJP's four-engine govt ?": Atishi on minor girl's rape and murder in Dayalpur

New Delhi [India], June 10 (ANI): Senior Aam Aadmi Party (AAP) leader and Leader of the Opposition in the Delhi Assembly, Atishi slammed the BJP government over the police's failure to arrest the main accused in the brutal rape and murder of a nine-year-old girl in Dayalpur area in the national capital. She asked why the women are not safe despite 'a four-engine BJP government' in Delhi. 'This incident has shaken not only Delhi but the entire country. Today, the biggest question is why the main accused has not been arrested yet. Delhi Chief Minister Rekha Gupta does not even have time to come here and meet the victim's family,' Atishi told ANI after visiting the family of the minor girl. 'There is a four-engine BJP government in Delhi, so why are our daughters not safe?' she added. Meanwhile, Delhi Minister Kapil Mishra told ANI that Chief Minister Rekha Gupta has spoken to the police officials regarding the incident. 'A nine-year-old girl was called to the house by a man named Naushad... The Chief Minister herself is looking into the matter. She has spoken to the police officials. Naushad is still absconding. The police believe that they will catch him by this evening or tomorrow,' he said yestererday Delhi AAP President Saurabh Bharadwaj also met the family of the victim. 'There is a fear among children here, and they don't want to go to school. The accused have not been caught yet. Delhi CM Rekha Gupta should come here and meet the family,' he told ANI after meeting the family. On Sunday, following the incident, the residents of the Dayalpur area staged a protest. The incident has sparked outrage among locals demanding swift justice for the victim. According to Deputy Commissioner of Police (DCP), North East Delhi, Ashish Mishra, a case has been registered at Dayalpur Police Station under relevant sections of murder and rape. The nine-year-old girl was found dead in the Dayalpur area of northeast Delhi. Doctors said that when the girl was brought to the hospital, she was without a pulse or heartbeat. They noted that her clothes were soaked in blood, and she was bleeding profusely from her private parts. The victim was initially taken to Dr. Aleena Nursing Home by family members before being referred to a higher-level medical facility. Earlier, police said that a call regarding the sexual assault of a minor girl was received at Dayalpur police station on June 7. A case has been registered under sections 103(1), 66, 13(2) of the Bharatiya Nyaya Sanhita (BNS) and the Protection of Children from Sexual Offences (POCSO Act), police added. (ANI)
