
‘Enforce stricter GPS rules'
Road Safety Council of Malaysia executive council member Datuk Suret Singh said the scheduled industry code of practice audits, which are conducted on all lorries and bus operators, entail the installation of GPS and check if a company has a safety officer.
The audit also determines if journeys taken by the commercial vehicle are monitored and complaints of misconduct are addressed by the company.
'The audit also examines if pre-journey safety checks on the vehicle's condition are carried out and if drivers are fit to undertake the trip.
'Despite all these stringent checks, if some companies opt to install a dummy GPS, then they are sending a message that they do not care about the safety of other road users,' he said.
In such cases, Suret said the authorities should come down hard on these rogue operators, revoke their permits and not let them off with just a warning.
'Stern action such as suspending or revoking the permit should be the new policy.
'Operators who run their fleet of vehicles responsibly and ethically should be given more opportunity,' said the former Malaysian Institute of Road Safety Research chairman.
Road safety expert Law Teik Hua said heavy vehicle operators resort to dummy GPS due to financial and operational factors.
'Some view GPS tracking as an unnecessary cost, particularly if they think they can evade fines.
'Others disable or fake tracking in a bid to hide unsafe practices such as drivers exceeding hours on duty or driving via dangerous shortcuts,' said Law, who heads Universiti Putra Malaysia's Road Safety Research Centre.
Law said GPS tampering enables wrongdoing such as cargo theft or smuggling, adding that the absence of real-time tracking prevents fleet managers from acting fast during emergencies such as breakdowns or accidents.
He said authorities need to conduct random checks to ensure not just the presence of GPS devices but also real-time operability.
'Sanctions for dummy or inoperable tracking systems must be stringent to discourage non-compliance, such as hefty fines or revocation of operating permits.
'Transport businesses, on the other hand, must be incentivised to install tamper-evident telematics systems with capabilities such as automatic notification of signal loss or tampering.'
Law said real-time GPS tracking is a safety measure to prevent accidents, hold drivers accountable and streamline logistics.
'Ghost GPS defeats these advantages, inflicting unwarranted danger on the whole road community.
'With improved enforcement, more transparency and use of improved technology, the industry can transition to safer, more trustworthy means of managing fleets,' said Law.
A ghost GPS is a decoy tracker used to mislead the actual GPS device, usually hidden elsewhere in a vehicle.
Traffic consultant Dr Rosli Azad Khan said the use of dummy GPS devices by heavy vehicle operators is deeply disturbing as it reflects a culture of impunity and disregard for safety regulations.
Rosli said that under the Land Public Transport Act 2010, the use of functioning GPS devices is a legal requirement.
'The purpose is clear to monitor vehicle speed, track location, ensure safe driving behaviour and allow operators to act swiftly when any violations occur,' added Rosli.
To address the issue, he called for the Land Public Transport Agency (Apad) and the Transport Ministry to launch an urgent audit on commercial vehicle operators with random roadside inspections.
Rosli also proposed that criminal charges be levelled against those who install fake GPS systems in heavy vehicles.
'Charges under criminal code, not just transport laws, must be considered,' he said.
Rosli said repeat offenders should be blacklisted from holding any public service vehicle permits and GPS data should be streamed live to a central monitoring system under Apad or the Road Transport Department (JPJ).
'The government should expedite the installation of dashboard cameras or dashcams in heavy commercial vehicles.
'The proposed dashcam regulation must not be delayed beyond the first quarter of next year,' added Rosli.
Issues with dummy GPS came to the surface after a preliminary report of a road crash in Teluk Intan on May 13, which killed nine Federal Reserve Unit officers.
The report revealed that the tipper lorry involved was overloaded by more than 70%, failed its safety inspection and had no seat belts or headrests for passengers.

Azalina puts ‘quick-win' criminal law reforms on the table, including end to caning
KUALA LUMPUR, Aug 12 — The Criminal Law Reform Committee (CLRC) has identified several 'quick-win' reforms that can be implemented in the short term to deliver immediate benefits to the public. Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said said these include abolishing caning as a punishment, giving judges greater discretion in sentencing and improving the remand process. 'Other measures involve expanding community service orders for minor offences as an alternative to imprisonment, strengthening the e-Plea of Guilt (e-PG) system, enhancing pre-trial document disclosure procedures and introducing fixed timelines for bail decisions. She was speaking at a Ministerial Briefing on efforts to reform criminal law in Malaysia at the Dewan Rakyat's Special Chambers today. The CLRC, established on March 24, is tasked with a comprehensive review of the Penal Code (Act 574), Criminal Procedure Code (Act 593) and Evidence Act 1950 (Act 56). Azalina said the committee will also examine consequential amendments to the Criminal Procedure Code, the moratorium on the death penalty, the possible introduction of deferred prosecution agreements and issues relating to cybercrime and national security offences. The CLRC has held engagement sessions with stakeholders, including enforcement agencies, the judiciary, civil society organisations and public universities, as well as town hall meetings in Sabah and Sarawak, to gather direct feedback, particularly on specific issues and proposed quick-win reforms. 'In line with the Madani Government's vision, reforms to Acts 574, 593 and 56 aim to ensure our criminal justice system remains relevant and meets the needs of modern society,' she said. Safety at risk from hidden hazards of mileage tampering
PETALING JAYA: Rolling back a car's mileage cheats buyers and hides wear that can compromise road safety, say experts. Universiti Putra Malaysia's Assoc Prof Dr Law Teik Hua warned that tampering can delay critical maintenance on brakes, timing belts and safety systems. 'Sudden failures like brake loss, bursting tyres or engine failure can occur. 'At high speeds, the consequences can be disastrous,' said Law, who heads the Road Safety Research Centre. He noted that suspension, steering and transmission parts have usage limits, and 'if not serviced promptly, their operation in emergencies will be at risk'. Federation of Malaysian Consumers Associations legal adviser Datuk Indrani Thuraisingham said complaints spike during periods of high used-car demand, though many go unreported. Consumers can seek redress under the Consumer Protection Act 1999, Penal Code and Hire Purchase Act 1967, or file a claim at the Tribunal for Consumer Claims for up to RM50,000. She urged a standalone law against odometer tampering and advised buyers to get a Puspakom report, verify service records, 'buy only from licensed dealers and demand a written declaration of mileage authenticity'. Road Safety Council of Malaysia's Datuk Suret Singh said a car averages 12,000km–15,000km a year, and structural integrity declines after 15 years. He recommends buyers pay RM10 to the Road Transport Department for the vehicle's history. Carsome chief business officer Aaron Kee said mileage accuracy is central to trust, with their 175-point inspection designed to detect tampering. 'Around 25,000km annually is normal for most cars, while continental models average about 15,000km,' he said, adding that unusually low readings warrant scrutiny. Singapore law graduate who hid plagiarism in Bar application named after court ruling
SINGAPORE, Aug 9 — A Singapore law graduate who failed to disclose past plagiarism incidents when seeking admission to the Bar — the process to become a qualified lawyer — has been publicly named after the court lifted an anonymity order, according to CNA. Chief Justice Sundaresh Menon on Thursday republished his grounds of decision in the case, identifying Pulara Devminie Somachandra. 'I make this order because, in my judgment, the principle of open justice is the predominant and overriding interest in this case, and there are insufficient grounds for departing from it,' he said in his judgment, as cited by the Singapore-based media organisation. He added that anonymisation orders were 'a derogation' from the general rule that parties' identities be made public. Somachandra had plagiarised in Singapore's Part A Bar examinations in 2020 — a conversion exam for overseas-trained law graduates — and 'on occasion' in university, but did not disclose these offences in her Bar application. The court rejected her admission and imposed a minimum five-year exclusion period before she can reapply. According to CNA, she initially persuaded the court to temporarily withhold her identity, citing mental health risks. She submitted a memo from a private doctor stating she had suicidal thoughts and warning that a non-anonymised judgment posed an 'immediate risk' to her safety. The Chief Justice ordered interim anonymity while awaiting a psychiatric report from the Institute of Mental Health (IMH). The Attorney General's Chambers (AGC) and the Singapore Institute of Legal Education (SILE) argued against continued anonymity. The Law Society proposed she undergo consistent psychological and psychiatric treatment at IMH, with a risk management plan, and that her anonymity be preserved until she reapplied for admission. Somachandra countered that revealing her name would mean her past misconduct would 'come back to haunt her, regardless of the progress she has made or may hope to make'. However, CNA reports that Chief Justice Menon said the 'default rule' of naming lawyers was of 'great importance' because the public must be assured that those admitted to the Bar are 'morally competent' to meet the profession's high standards. He stressed that withholding a name should only occur to 'avert an imminent and credible threat of real harm' — a 'high threshold' that had not been met. 'There is insufficient evidence to suggest that there is a substantial risk that Ms Somachandra's condition will likely deteriorate to such an extent that it would be a disproportionate consequence of lifting the anonymisation,' he said. Addressing her concerns about her past resurfacing, he said: 'It is contrary to the notion of repentance and rehabilitation for Ms Somachandra to now seek to sweep her past misconduct under the rug… While second chances ought to be given, the journey to repentance, rehabilitation and reintegration begins with the willingness to confront and to be honest and open about her past misconduct.' The Chief Justice also rejected the Law Society's suggestion to revisit the issue only if she reapplied for admission in five years, noting that delaying the decision could worsen matters by allowing the fear of eventual exposure to linger. CNA reported that Somachandra graduated from a UK university in 2019. She failed two Part A papers in 2020 and was found to have collaborated with another candidate, who was named as 'Ms Tan', when she resat the exams. The SILE concluded their answers contained matching passages. She passed the Part A exam in 2022 and the Part B exam — the final stage before Bar admission — in 2023, but omitted the plagiarism incidents from her application. In 2024, after the AGC contacted her university, she consented to release of information confirming 'moderate plagiarism' during her studies. The AGC, SILE and Law Society all opposed her admission and recommended the five-year exclusion.
