A company found guilty of dealing in counterfeit cigarettes has been ordered by the Evander Regional Court to purchase furniture for local schools as part of its sentence.
Uptown Superstore was fined R600 000 and must buy 504 durable, quality double-seater desks for four schools in the Highveld Ridge Circuit.
The company has three months to comply with the court judgment.
Individual charges against three accused persons were withdrawn, but the business entity faced the full weight of the law.
Individual charges withdrawn, company sentenced
Three individuals originally faced charges in their personal capacity. Riaz Moolla, 42, Fatima Moolla, 62, and Suliman Ismail Moolla, 67, had their cases withdrawn from the Evander Regional Court.
However, their company, Uptown Superstore, was not spared.
The business was convicted on multiple charges.
'The company was sentenced for Contravention of the Tobacco Products Act, Contravention of Customs and Excise Act, and Contravention of Value Added Tax Act,' stated police spokesperson Lieutenant Colonel Magonseni Nkosi.
Illicit cigarettes seizure and arrests
The case stems from a major seizure of illicit tobacco products.
Authorities confiscated 4 710 packets of counterfeit cigarettes valued at R107 700 from the business premises.
The first arrest occurred in September 2024.
'During the seizure on 9 September 2024, 42-year-old Riaz Moolla was arrested by the Hawks Secunda based Serious Commercial Crime Investigation after the warrant of arrest against him was issued by the court,' Nkosi explained.
Riaz was released on bail following his arrest. The investigation continued, leading to additional warrants.

Additional arrests and court proceedings
Further arrests followed nearly a year later. On 17 July 2025, warrants were executed against the remaining two accused persons.
According to Nkosic, both Fatima and Suliman were arrested and warned to appear in court.
All three accused appeared before the court on 29 July 2025 for trial.
'The company director, Suliman, entered into a plea agreement, and the matter was rolled over to Wednesday, 30 July 2025,' Nkosi stated.
Community benefit sentence
The court's sentencing reflected a community-focused approach to justice.
While the R600 000 fine addressed the financial penalty, the furniture requirement ensures direct community benefit.
The 504 double-seater desks will be distributed among four unnamed schools in the Highveld Ridge Circuit High Schools.

'Interesting sentencing'
Provincial Head of the Directorate for Priority Crime Investigation Major General Nico Gerber commended the collaborative effort that led to the conviction.
'It is an interesting sentence. Criminals are again out of pocket due to their crimes. The community is benefiting from this sentence, and it will definitely assist the next generation in their needs for a better education,' Gerber stated.
Gerber highlighted the teamwork involved in securing the conviction.
He praised the investigation team, the National Prosecuting Authority, and the judiciary for their combined efforts in bringing the case to a successful conclusion.

Brutal attack in Nongoma On 13 March 2021, Nkosi and Mathe stormed into the home of a taxi owner at Emakholweni, Nongoma. 'The two bloodthirsty men ransacked the house, robbed his wife of an undisclosed amount of money and shot her twice in the head before fleeing from the crime scene,' police said. The victim's husband, a member of the local taxi association, escaped the attack as he was outside at the time. Months later, on 17 December 2021, he survived another attempt on his life when gunmen sprayed him with bullets as he entered his home. He was found carrying a firearm with its serial number filed off and 15 rounds of ammunition. Ballistic analysis revealed that the weapon had been stolen from a police sergeant who was robbed while stranded on the R66 Road in Ulundi. 'Further investigation led to the arrest of Simphokuhle Ayanda Mathe, who was also found in possession of a firearm with serial number erased, and was positively linked to both the murder and attempted murder at Emakholweni,' it said. Nkosi was sentenced to life for murder, 20 years for armed robbery, 20 years for robbing a police officer, 15 years for possession of a prohibited firearm, and five years for unlawful possession of ammunition. Nkosi explains that further investigation led the team to a second address where more mandrax and crystal meth were found. Another undocumented Nigerian national (43) was arrested for dealing in drugs. 'The team moved on to a third house where three South Africans, aged between 33 and 43 years, were nabbed with mandrax and crystal meth.' Nkosi says the estimated value of the recovered drugs is R305 000. The arrested people are expected to appear in the Volksrust Magistrate's Court today. The Hawks will rope in the Department of Home Affairs to further investigate the Contravention of the Immigration Act 13 of 2002. A 24-year-old recycling and art enthusiast, Minenhle Simelane, has transformed his childhood memories and passion for art into a booming business. Simelane, who owns Umlazi Arts and Recycling, started by crocheting recycled plastics into mats in 2023, a skill that he learnt at the feet of his grandmother. The art enthusiast has upgraded his business by adding the production of jackets and trousers using the recycled plastics. The entrepreneur moves around the township and collects the plastics or gets them from a dump site. Simelane's dream was to inspire communities to take full responsibility for protecting townships from plastic waste pollution. In the video below, Simelane shows his products and explains the reason behind expanding the business. Recently, Simelane employed four full-time workers, aiming to address the high unemployment rate in Umlazi and South Africa as a whole. He also received funding and business mentorship from the MTN Group. Simelane believes that expanding his business is demonstrating a commitment to sustainable fashion and creating employment opportunities. He said his jackets and trousers made of recycled plastics are showcasing how waste can be transformed into wearable art and highlighting the importance of responsible plastic disposal. He said it is easy to wash the jackets and trousers as they require hand wash only. Simelane revealed: 'These jackets and trousers can be worn in various conditions and seasons. They are particularly suitable for mild to cold weather and can be a good option for winter, offering warmth and wind resistance.' Usually, each jacket costs R800, but for now they are on sale for R600 each, according to Simelane.
