Expanded list of docs to prove citizenship voter-friendly: SC

New Delhi: The Supreme Court on Wednesday orally remarked that the Election Commission's decision to expand the list of acceptable documents for establishing a voter's identity in the Bihar Special Intensive Revision (SIR) was "actually voter-friendly."A division bench comprising Justices Surya Kant and Joymalya Bagchi orally remarked that the expansion of documents leads to "expansion of choice" giving the voters "more options".Speaking for the bench, Justice Bagchi told one of the counsels for the petitioners that "we can understand your argument on exclusion of Aadhaar card but increasing the number of (acceptable) documents gives the voters more options". The Bench said this in light of contention raised by the petitioners that in the past the list of documents under a revision of rolls was not more than seven as compared to eleven in Bihar's SIR.Weighing in, Justice Kant orally remarked "things would have been different if you (voter) had to submit all the eleven documents. Then it would have been against the voters. But (in the instant case) ECI has given eleven options". The Bench also questioned the contention raised by another counsel for the petitioners that ECI did not have the power to conduct the special intensive revision (SIR).
The Bench referred to Section 21(3) of the Representation of the Peoples Act, 1950, which says "the Election Commission may at any time, for reasons to be recorded, direct a special revision of the electoral roll for any constituency or part of a constituency in such manner as it may think fit."Justice Bagchi added that the residuary power of the Election Commission flows from Article 324 of the Constitution as well. The Representation of the Peoples Act mentions both summary revision and special revision and the Commission has only added the word "intensive".Advocate Prashant Bhushan argued that the Election Commission should publish the list of the 65 lakh voters who were omitted from the list and also the reasons for the omission.Bhushan urged the Bench to issue an interim direction to the Commission to publish the names of persons excluded from the draft, to make the draft list on the website searchable, give names of persons recommended/not recommended by the BLO, and the reasons for deletion.The case will come up for resumed hearing on Thursday when the Election Commission will present its counter. At the last hearing, on Tuesday, the Bench had verbally remarked that "largely it appears to be a case of trust deficiency".The Bench had also told the counsels for petitioners that they should "agree" with the claim of Election Commission that a "detailed inquiry is not required" for the purpose of preparing draft rolls.The Bench had questioned the petitioners if it was their argument that Aadhar card is a proof of citizenship. "Do we presume that it is your argument that Aadhar is proof of citizenship?", the Bench had questioned one of the counsels for the petitioners.
Referring to the Aadhar act, the Bench had said that the Election Commission of India was right in submitting that an Aadhaar card is not a conclusive proof of citizenship. The argument by petitioners that electors in Bihar do not have a majority of documents sought by the ECI as proof did not find favour with the Bench. "Largely, it appears to be a case of trust deficiency..Bihar is an integral part of India. If people in Bihar do not have (the documents) then people in other states won't also have", Justice Kant had orally observed on Tuesday.

NEW DELHI: Several opposition MPs of INDIA bloc parties held a protest in the Parliament House complex on Monday against the Election Commission's voter roll revision in Bihar. Led by Leader of Opposition in Rajya Sabha and Congress president Mallikarjun Kharge, the MPs of INDIA bloc raised "vote chor, gaddi chhor" and "vote chori band karo" slogans. They also held a big banner that read "vote chori" and held posters demanding "stop SIR". Leaders of Congress, TMC, DMK, Left parties and RJD and Samajwadi Party were seen holding posters and banners right outside the Makar Dwar of Parliament. Amid speculation that the opposition is mulling an impeachment motion against CEC Gyanesh Kumar, Congress leader Naseer Hussain told reporters they would use every democratic method to ensure that the Chief Election Commissioner should be a person who is "unbiased". The opposition has been protesting in both Houses of Parliament against the SIR, alleging that the EC's exercise is aimed at "disenfranchising voters" in Bihar ahead of the assembly elections due later this year. They have been demanding a discussion on the issue in both Houses. Barring discussions on Operation Sindoor in the two Houses, Parliament has seen little business ever since the Monsoon session began on July 21 due to repeated adjournments, mostly over the SIR issue.

The Opposition INDIA bloc is planning to move an impeachment motion against Chief Election Commissioner (CEC) Gyanesh Kumar. The move will escalate the Opposition's confrontation with the Election Commission amid Rahul Gandhi's 'Vote Chori' allegation. Congress Rajya Sabha MP Syed Naseer Hussain told news agency ANI that the party is ready to use all democratic tools, including an impeachment motion if needed, though no formal discussions have been held so far. "If there is a need, we will use all the weapons of democracy under the rules. We have not had any discussions (about impeachment) as of now, but if needed, we can do anything," Hussain told ANI. While the Congress and other parties are in the ongoing Monsoon Session of Parliament, a 14-day notice period is a requirement for initiating an impeachment process against a President or Vice President in India and the CEC, as per the law. The Monsoon Session of Parliament resumed after Independence Day break on Monday. The INDIA bloc continued to protest against issued, including Bihar Special Intensive Revision (SIR). 'The ECI cannot relinquish its Constitutional duty and evade genuine queries of political parties. The 'Right to Vote' is the most important right, given to us by the Constitution of India. The Election Commission's remarks came on a day when Rae Bareli Member of Parliament (MP) Rahul Gandhi launched his 1,300 km-long 'Voter Adhikar Yatra' from poll-bound Bihar's Sasaram to step up the Opposition INDIA bloc's campaign against its 'Vote Chori' (vote theft) claims. The CEC can only be removed in the same manner as a Supreme Court judge, requiring a motion of impeachment by Parliament, according to Article 324(5) of the Constitution. On 7 August, Rahul Gandhi had alleged 'vote chori (theft)' of 1,00,250 votesin an assembly of a Karnataka Lok Sabha constituency, with 11,965 duplicate voters in the segment, 40,009 voters with fake and invalid addresses, 10,452 bulk voters or single-address voters, 4,132 voters with invalid photos. After Sunday's press conference by CEC, the Opposition, Congress leader Pawan Khera said the remarks sounded like those of a BJP functionary rather than an independent constitutional authority. 'It seemed like BJP was speaking today. Did he give any response about the one lakh voters we exposed in Mahadevapura?' Khera asked. RJD leader Manoj Jha accused the Commission of ducking 'burning questions' while JMM MP Mahua Maji asked the poll body to clarify the authenticity of documents presented by Gandhi in his press conference. The INDIA bloc had moved an impeachment against former Vice President Jagdeep Dhankhar in December. The motion was rejected. Dhankhar quit as Vice President on 21 July. Congress leader Rahul Gandhi on Monday said the Special Intensive Revision of electoral rolls is a "new weapon" of "vote chori" and vowed to protect the 'one person, one vote' principle. He made the remarks in a post on his WhatsApp channel while talking about his meeting with a group of people who had cast their vote in the previous Lok Sabha election but their name had been deleted in the SIR exercise in Bihar. Gandhi met the group at the launch of his Vote Adhikar Yatra in Sasaram on Sunday. In his post in Hindi along with a picture of the meeting, the Leader of Opposition in the Lok Sabha said, "SIR is a new weapon of vote theft. Coincidentally, these people standing with me in this picture are 'living' proof of this theft." "All of them had cast their vote in the 2024 Lok Sabha elections - but by the time Bihar assembly elections came, their identity, their existence was erased from the democracy of India," he said. "Do you know who they are? Embarking on a 1,300 km 'Voter Adhikar Yatra' from Sasaram, Gandhi on Sunday had accused the Election Commission of "stealing" elections in collusion with the BJP and asserted that the INDIA bloc will not let their "latest conspiracy" to steal Bihar polls through SIR of electoral rolls succeed. After 16 days, the yatra will conclude with a rally in Patna on September 1. The yatra is being undertaken in a hybrid mode, on foot and by vehicle, as was Gandhi's Manipur to Mumbai Bharat Jodo Nyay Yatra ahead of the Lok Sabha polls. It will pass through Aurangabad, Gaya, Nawada, Nalanda, Sheikhpura, Lakhisarai, Munger, Bhagalpur, Katihar, Purnea, Araria, Supaul, Madhubani, Darbhanga, Sitamarhi, East Champaran, West Champaran, Gopalganj, Siwan, Chhapra and Ara.
