MyPillow's Mike Lindell wins appeal over 2020 election claim contest
July 23 (UPI) -- MyPillow CEO Mike Lindell got a break Wednesday in one of the multiple lawsuits against the noted conspiracy theorist and ardent supporter of U.S. President Donald Trump.
The Missouri and Minnesota-based 8th Circuit U.S. Court of Appeals, which covers seven states, reversed a lower court decision in a 12-page ruling. It said a previous panel of deciders overstepped by forcing Lindell to pay a man who won Lindell's contest related to his discredited conspiracies surrounding the 2020 election.
The three-judge panel -- two appointed by former President George H.W. Bush and one by Trump -- handed down a unanimous decision by ruling that a past panel of arbiters exceeded power by altering already clear contractual terms.
"Fair or not, agreed-to contract terms may not be modified by the panel or by this court," wrote U.S. Circuit Judge James Loken, a Bush-appointee.
Lindell claimed to be in possession of digital files that, he said, proved China interfered in the 2020 election.
He then held in 2021 the "Prove Mike Wrong Challenge" in South Dakota, in which he vowed to award $5 million to any person who could show that his Internet data was not valid election data.
Robert Zeidman, a contestant and software developer, produced a 15-page report that explained Lindell's "data" was not related to the election. The challenge judges ruled that he did not meet the requirements for the $5 million award.
Zeidman in April 2023 won a filed arbitration lawsuit in the case.
In his opinion, Loken stated that the three judges concluded the panel had "effectively amended the unambiguous Challenge contract when it used extrinsic evidence to require that the data provided was packet capture data, thereby violating established principles of Minnesota contract law and our arbitration precedents."
On Wednesday, Zeidman's attorney Brian Glasser said people can judge for themselves if the 8th Circuit's ruling was "more persuasive, or rings in truth louder, than the unanimous contrary decision of three arbitrators who heard all the evidence, including one appointed by Mr. Lindell," he told The Hill.
It comes weeks just weeks after a federal jury required Lindell to pay more than $2 million in a separate lawsuit to an ex-employee of Dominion Voting Systems in a two-week defamation trial.

Fresh clashes break out in Syria as the interim government struggles to ease tensions
The Syrian government under interim President Ahmad al-Sharaa has been struggling to consolidate control since he led a State television said clashes between government forces and militias belonging to the Druze religious minority rocked the southern province of Sweida on Saturday after Druze factions attacked Syrian security forces, killing at least one member. The state-run Alikhbaria channel cited an anonymous security official who said the cease-fire has been broken. The Defense Ministry has not issued any formal statement. The Observatory said the clashes took place at the strategic Tal al-Hadeed heights that overlook Daraa province next door. Advertisement State media says that aid convoys continue to enter Sweida city as part of a tense truce after over a week of violent clashes in July between Druze militias and armed Bedouin clans backed by government forces. However, humanitarian conditions remain dire, and residents of Sweida have called for the road into the city to be fully opened, saying the aid that has come in is not enough. The clashes that displaced tens of thousands of people came after months of tensions between Damascus and Sweida. The fighting led to a series of targeted sectarian attacks against the Druze minority, who are now skeptical of peaceful coexistence. Druze militias retaliated against Bedouin communities who largely lived in western areas of Sweida province, displacing many to neighboring Daraa. Elsewhere, in the northern Aleppo province, government-affiliated fighters clashed with the SDF. The Defense Ministry said three civilians and four soldiers were wounded after the SDF launched a barrage of rockets near the city of Manbij 'in an irresponsible way and for unknown reasons.' SDF spokesperson Farhad Shami, on the other hand, said the group was responding to shelling by 'undisciplined factions' within government forces on Deir Haffar, an eastern city in the same province. The eastern part of Aleppo province straddles areas controlled by the government and by the SDF. Though the two are slowly trying to implement a cease-fire and agreement that would integrate the areas under Damascus, tensions remain. Advertisement 'The Ministry of Defense's attempts to distort facts and mislead public opinion do not contribute to security or stability,' Shami said in a post on X, formerly Twitter. In Quneitra province, in the south, the Israeli military announced it conducted another ground operation in the area that borders the Israeli-annexed Golan Heights. It said its troops questioned several suspects they accused of involvement in weapons trafficking in the village of Hader, and raided four areas where they found weapons being trafficked. Since Assad's ouster, Israel has conducted numerous strikes and military operations in southern Syria, saying its forces are taking out militant groups that they suspect could harm Israelis and residents in the Golan Heights. Damascus has been critical of Israel's military activity, and the two sides have been trying to reach a security arrangement through US-mediated talks. Syria has repeatedly said it does not intend to take military action against Israel. Those talks intensified after Israel backed the Druze in Sweida during the earlier clashes. Israel struck military personnel near the southern city and most notably launched an airstrike targeting the Defense Ministry headquarters in the heart of Damascus.

Iran forms new defense council for handling affairs in wartime

The establishment of the council was approved by the Supreme National Security Council within the framework of Article 176 of the country's constitution, according to reports in Iranian state media agency IRNA and the semi-official Tasnim News Agency. The Iranian government said that the council also aims to review defense plans and centralize military decision-making. The new council will be chaired by President Masoud Pezeshkian and will include the heads of the Iranian Armed Forces and the Iranian Revolutionary Guard Corps, among other ministries, according to the pro-Iranian political blogger Middle East Spectator. In another article, the Tasnim News Agency likened the structure and purpose of the new council to that of the United States' National Security Council, noting that the American agency "plays a coordination in national security and defense policymaking." The move comes in the aftermath of the 12-day war between Iran and Israel earlier this year, which marked one of the most direct and intense confrontations between the two nations in decades. Although both sides claimed victory, Iran emerged from the conflict with significant military and economic setbacks. Israeli strikes reportedly damaged key air defense systems, missile infrastructure, and IRGC command centers in western Iran. Meanwhile, Iran's retaliatory attacks failed to breach Israeli missile defenses in a meaningful way, highlighting vulnerabilities in Iran's conventional military capabilities. Since the conflict, Iran has faced renewed domestic pressure as its economy, which is already strained by international sanctions. Senate confirms former Fox host Jeanine Pirro as top prosecutor

Pirro, a former New York state district attorney and county judge, was confirmed along party lines 50-45 Saturday. She was among a host of staunch Trump backers who claimed the 2020 presidential election was stolen from Trump due to fraudulent voting. There was no evidence to support that claim. Pirro said in a statement that she was "blessed" to have been confirmed by lawmakers and said in a statement to "get ready for a real crime fighter." Pirro used her platform as a host of the Fox New "Justice with Jeanine" host to purvey a baseless conspiracy theory that the election was stolen from Trump, and later became co-host of the Fox show "The Five." In 2021, Pirro was among five defendants named in a defamation lawsuit by Dominion Voting Systems, accusing the network of knowingly promoting false claims about the company's voting machines used to tabulate votes in the election. Fox eventually settled the lawsuit with Dominion for $785 million and acknowledged that claims about a fraudulent election were false. President Donald Trump nominated Pirro in May, calling her a "powerful crusader for victims of crime," and, in a social media post, a person who "excelled in all ways." "Jeanine is incredibly well qualified for this position," Trump wrote in the post. At the end of Trump's first term, he pardoned Pirro's husband, Albert Pirro, Jr., who had been convicted in 2000 on charges of fraud and tax evasion. Criticism of the nomination was swift and exacting. Sen. Adam Schiff, D-Calif., saying "blind obedience to Donald Trump is nearly unrivaled among his ardent supporters." "For an important prosecutorial position like this one, the country has a right to demand a serious and principled public servant," Schiff added. "Jeanine Pirro is not it." The Senate adjourned for a monthlong recess Saturday having failed to advance dozens of other Trump nominees. Trump reacted on social media, telling Senate Majority Leader Chuck Schumer to "Go to Hell!"
