
SC clears ambiguity, interprets phrase in Employees Compensation Act
New Delhi, Jul 29 (PTI) The Supreme Court on Tuesday said the phrase 'accident arising out of and in the course of his employment" in a provision of the Employees' Compensation Act would include accidents occurring while commuting between the residence and the place of duty.
The court noted that there is 'considerable doubt and ambiguity" surrounding this phrase in section 3 of the Act insofar as cases concerning accidents occurring to employees while proceeding to work and vice versa.
A bench of Justices Manoj Misra and K V Viswanathan noted that depending on facts, different rulings have interpreted this differently.
Section 3 of the Employees' Compensation (EC) Act, 1923 deals with the employer's liability for compensation.
'We interpret the phrase 'accident arising out of and in the course of his employment' occurring in section 3 of the EC Act to include an accident occurring to an employee while commuting from his residence to the place of employment for duty or from the place of employment to his residence after performing duty, provided the nexus between the circumstances, time and place in which the accident occurred and the employment is established," the bench said.
The top court delivered its verdict on an appeal challenging a December 2011 Bombay High Court order.
The high court had set aside an order of the Commissioner for Workmen's Compensation and Civil Judge, Osmanabad, which had awarded Rs 3,26,140, along with interest, to the family members of a victim who died in an accident while he was on his way to report for duty.
The award was ordered in a claim filed under the EC Act.
In its verdict, the apex court noted that the deceased was employed as a watchman in a sugar factory and his duty hours were from 3 am to 11 am on April 22, 2003, the day of the accident.
The bench said it was undisputed that he was proceeding to his place of duty when the accident occurred at a spot located around five kilometres from the workplace.
'In view of the above, considering that the deceased was a night watchman and was dutifully proceeding to his workplace to be well on time, there was a clear nexus between the circumstances, time and place in which the accident occurred and his employment as watchman," the bench said.
It said as the accident had clearly arisen out of and in the course of employment, the Commissioner for Workmen's Compensation and Civil Judge was justified in ordering the claim under the Act.
While allowing the appeal, the bench set aside the high court order and restored the judgment of the Commissioner for Workmen's Compensation and Civil Judge. PTI ABA RC

ED raids against Bengaluru group in homebuyers fraud case
Bengaluru, Aug 1 (PTI) The Enforcement Directorate on Friday conducted searches against a Bengaluru-based real estate company and its promoters who are accused of duping home buyers worth crores of rupees in the name of selling them flats in their residential project, official sources said. At least ten premises of Ozone Urbana Developers Pvt. Ltd. and its key management personnel were raided in Bangalore and Mumbai under the Prevention of Money Laundering Act (PMLA), the sources said. The main promoter of the group is Satyamoorthi Vasudevan. The company and its promoters were booked by the ED after taking cognisance of multiple police FIRs registered against them related to a residential project named Ozone Urbana in Devanahalli Taluk of Bengaluru. The integrated township project was to be handed over to buyers in 2018. However, till 2024, only 49 per cent of the project was completed, the sources said. The company 'failed" to hand over the project and has neither returned the money to the buyers, they claimed. It is alleged that the accused company and its key management personnel 'cheated" gullible home buyers by promising to pay their bank EMIs (taken for purchase of homes) until completion of the project. The company also promised many buyers 'huge" discounts, if they pay full amount in advance against the bookings and it also allegedly lured them with a 'buyback scheme". It is alleged that the directors of the said company cheated its buyers collectively to the tune of hundreds of crores and misappropriated the funds, the ED sources said. Tribal man found dead in Tamil Nadu forest office, family alleges custodial death
A man belonging to a tribal community was found dead in the toilet of the Udumalaipet Forest Range Office in Tamil Nadu, with his family alleging custodial death, triggering protests by local to a complaint filed by Pandiammal, the wife of the deceased, Marimuthu had been acquitted in a case related to ganja cultivation on July 29. She stated that on the following day, Marimuthu informed the family that he was going to meet his lawyer but failed to return. On the morning of July 31, around 8.30 am, Pandiammal said she was informed that her husband had died by suicide inside the forest her statement to the Udumalaipet Police Inspector, Pandiammal claimed that Marimuthu had been picked up by officials from the Udumalaipet Forest Range and was being illegally detained when he died. She alleged that he had not died by suicide but had been subjected to custodial violence. Sources in the Forest Department stated that Marimuthu had been detained for questioning in connection with the seizure of body parts of endangered species. The seizure was made by Kerala Police during a vehicle check at Sinnaru, after which he was handed over to the Udumalaipet Forest Range Office. Forest officials confirmed that Marimuthu was later found hanging in the of the tribal community, along with supporters from the Communist Party of India (Marxist), staged a protest alleging that Marimuthu had been beaten to death. They demanded that a case be filed against the forest officials under the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
