
ICE official says no plan yet on Abrego Garcia deportation
'We don't work cases not in ICE custody preemptively because our docket officers are worried about the cases they have now,' Thomas Giles, who manages ICE's 25 field offices across the country, told a federal judge. Abrego Garcia was returned to the United States last month after being mistakenly deported to El Salvador in March. He has been detained on human smuggling charges since his return, but he could be released ahead of his trial as soon as Wednesday.
A frustrated U.S. District Judge Paula Xinis had ordered the government to produce a witness to provide answers about the next steps for the man, as his lawyers push Xinis to issue an order preventing the administration from swiftly deporting their client again. Xinis is an appointee of former President Obama.
Giles finished testifying after several hours, but the judge has yet to hear the lawyers' legal arguments before she issues a ruling. The hearing will resume Friday morning, a court official told reporters.
Giles testified that ICE has already issued an immigration detainer requesting custody if he's released, which is expected to be honored. That would enable the transfer to happen in a 'secure environment' within the Tennessee jail, Giles said.
But until that happens, Giles said ICE does not determine how to proceed with an individual's immigration case.
'No decision has been made,' Giles said.
The administration has outlined two potential options for deporting him. Officials could look to lift the 2019 immigration ruling protecting Abrego Garcia from removal to El Salvador, which was issued over gang threats to his family's pupusa business.
Or, the administration may try to deport him to a country where he has no ties, known as a third country removal. 'It can be a few days to a few weeks' before the country is identified, Giles said.
In their latest attempt to stave off Xinis from taking any action, government attorneys hours before the hearing agreed to abide by certain procedures before deporting him to a third country.
But Abrego Garcia's lawyers said those guarantees don't alleviate their concerns.
'It leaves open the critical question of whether my client will receive effective notice and an opportunity to be heard in a court before he is removed to an as-yet unidentified third country,' attorney Jonathan Cooper said.
The procedures provide two tracks. If a foreign government agrees to take in migrants and assures they won't face persecution, and the State Department finds the assurances credible, the migrant can be removed without any further procedures. Giles testified that is the situation for Mexico and appears to be so for South Sudan, where eight migrants with serious criminal records were deported on Independence Day.
For other countries, the migrant upon raising claims of persecution is entitled to a credible fear interview with an immigration officer.
Abrego Garcia's lawyers also raised concerns about where he would be held in ICE custody before any deportation.
After his March arrest in Maryland, officials swiftly moved him to a Louisiana facility before deporting him to El Salvador. Abrego Garcia's lawyers want him returned to Maryland this time if he's placed in ICE custody.
Giles testified the decision is made based on bed space availability, which changes every day, so there's no indication of where Abrego Garcia would end up. On cross-examination, Giles conceded he did not ask the relevant field office whether they had made any preparations given the high-profile nature of the case.
And answering questions from the judge, Giles acknowledged ICE does have some discretion and may take into account the fact that Abrego Garcia still has a pending criminal case in Tennessee.
'It's a possibility it could be anywhere in the United States,' Giles said.

A story trending on social media tells of a growing group of tow truck drivers in Los Angeles who are reportedly 'stalking,' or should we say following ICE convoys around the city so they can tow away unmarked ICE vans and SUVs when they park illegally—as they invariably do—and start to conduct their 'abductions' of people off the street. Tow truck drivers to the rescue! Imagine that. It sounded great but unfortunately the story is exaggerated This sounds like a strong background story for a movie, maybe starring Gerard Butler or Liam Neeson and directed by Paul Greengrass from the Jason Bourne films. If ICE agents are 'disappearing' citizens, then tow trucks drivers can repay in kind and 'disappear' their ICE SUVs. According to Newsweek though, 'The claims, however, appear to be exaggerated.' The publication goes on to say, 'The towing company in the popular viral clip is Oxnard towing service Airport Towing. When contacted by Newsweek by phone, the company confirmed the white SUV was an ICE vehicle that had been parked illegally on Thursday, July 10. However, viral reports that the tow truck driver was 'following' ICE are inaccurate.' According to Airport Towing, the vehicle had been parked illegally on private property for more than an hour when the company arrived to tow it. Check out the video below. Seeing a tow truck driver removing an ICE SUV could not be more satisfying, even if it was just a routine removal and the story of a bunch of ICE vans being stalked by tow trucks was exaggerated. Many readers, I'm sure, were hoping this story to be be true, until fact-checking site Snopes traced the social media report back to a satirical site, saying that it had taken one incident and blown it out of proportion. But we can imagine where the story came from, as citizens are being 'disappeared' by the regime, and a vigilante tow truck resistance would seem like a godsend. Jon Favreau of Pod Save America, and former speechwriter for President Barack Obama, summed up what Americans are battling against and what tow truck drivers could react to, if so inclined. 'You have plain clothes agents, with masks, with guns, sometimes in unmarked vehicles. What are people supposed to do when someone grabs you off the street or grabs someone you're with? You're not supposed to demand to see a warrant? You not supposed to try to stop it? What if it's some bad guy, some criminal who says that they're from ICE [but they're not!]Even if the original story was exaggerated, the underlying premise of tow truck drivers resisting ICE raids is cause for hope, hope that citizens can use whatever limited powers they have to help save innocent fellow residents.

Uber driver accused of sexually assaulting young woman now faces ICE arrest detainer after overstaying visa
FIRST ON FOX: Immigration and Customs Enforcement (ICE) on Friday lodged an arrest detainer against an illegal immigrant from Lebanon accused of kidnapping his Uber passenger in Texas. Sameh Mohamad Chami, 49, was arrested by Friendswood Police Department on Aug. 6 after allegedly sexually assaulting a young woman while working as an Uber driver, according to a report from affiliate FOX 26 Houston. The 21-year-old victim fell asleep in the backseat of Chami's car after a late night at a Galveston saloon and reportedly woke up in the front seat of his car parked near a school with her shorts unbuttoned.
