Chandigarh: HC not convinced on Sarangpur site proposal for new court complex
The HC bench of chief justice Sheel Nagu and justice Sanjiv Berry also appeared unconvinced with the administration's argument that the court complex can't be set up in the IT Park area due to environmental concerns. It has asked the administration for documentary proof of environmental objections regarding the IT Park area, and also the no-objection certificates (NOC) issued to the multi-storey Lalit Hotel there.
Asking the Bar Association and UT administration to hold a joint meeting on August 7 to deliberate on the alternative site or taking forward the holistic development plan, the court said, 'Since there is no solution coming forth from either of the parties, it would be appropriate to revert to the possibility of a holistic development plan being made feasible and viable.'
A holistic development plan was prepared for the expansion of the HC with more courts and other facilities. But it had to be put on hold as the Capitol complex, which comprises the high court building, was declared as a UNESCO World Heritage site in 2016. The UNESCO committee has already stalled two other ambitious projects at the Capitol Complex, including an underground multi-level parking lot and an AC chiller plant.
The court was hearing a public interest litigation (PIL) by the Punjab and Haryana high court employees association secretary Vinod Dhatterwal, seeking implementation of the holistic development plan, which envisages setting up of multi-storey buildings to cater to the requirement of additional space.
Over 10,000 cars and thousands of two-wheelers come to the HC daily as there are 10,000 lawyers and over 3,300 court employees, besides the litigants. The court has a sanctioned strength of 85 judges – but at present, it has only 60 judges. If all the sanctioned posts are filled, the administration would struggle to get court rooms for all.
PGI roundabout traffic behind apprehensions over Sarangpur site
During the hearing, the court noted that the alternative site proposed by the administration is not acceptable as no solution has been provided for the perennial problem of traffic congestion at the PGIMER roundabout. It underlined that if the HC is relocated to Sarangpur, the entire traffic of Chandigarh, Panchkula and Mohali will take the PGIMER route for reaching Sarangpur. 'This, in all likelihood, will cause delays and inconvenience to the judges, members of the Bar, employees, litigants and other stakeholders,' the court said.
In July, the HC had asked UT to explore whether land can be allotted in the IT park. However, the administration cited environmental concerns, stating that the Wild Life Board may not grant clearance as the location lies on path of migratory birds which visit Sukhna Lake.
The bench has also asked whether the holistic plan implementation would require the UT administration and heritage committee's approval if the court room requirement is reduced. It has also asked the UT to spell out restrictions, which it had imposed while clearing the holistic plan.

Bikram Majithia's arrest is vendetta, says Harsimrat
The state government is resorting to 'vendetta' politics, Shiromani Akali Dal (SAD) MP Harsimrat Kaur Badal said after tying rakhi (sacred thread) to her brother Bikram Singh Majithia on the occasion of Raksha Bandhan in Nabha jail on Saturday. Harsimrat Kaur also alleged that the jail administration initially stopped her at the outer gate of the jail and made her wait for hours. (HT Photo) Kaur also alleged that the jail administration initially stopped her at the outer gate of the jail and made her wait for hours. 'When no response came from officials, I attempted to walk inside holding a box of sweets. After that the jail administration allowed the meeting,' she claimed. Speaking to the reporters after the interaction, Kaur said, 'The present government has been indulging in such (vendetta) politics for a long time. People will give them a befitting reply in the upcoming assembly elections.' Notably, the Mohali district court had on July 6 sent Majithia, the former cabinet minister, to 14 days of judicial custody in a disproportionate asset (DA) case relating to alleged laundering of ₹540 crore in 'drug money'. Majithia was arrested by the Punjab Vigilance Bureau from his residence in Green Avenue, Amritsar, on June 25 this year. Responding to the questions about the charges, she claimed that Majithia had been continuously speaking out against the state government, which was why action was taken against him. 'Punjab CM Bhagwant Mann is diverting attention from the real issues by putting Majithia behind the bars. The CM has failed to fulfil his party's pre-poll promises. Therefore they are making efforts to divert attention from the issues concerning Punjab,' said the MP. When asked about Majithia's health, she said, 'My brother is in high spirits. He is doing well. He is concerned about the issues concerning Punjab, including the land pooling scheme.'

AAP govt will transform roads leading to all religious sites: Harbhajan Singh ETO
Days after the Sikh clergy at Akal Takht directed the state government to address the condition of the roads leading to historic gurdwaras associated with Guru Teg Bahadur in view of his 350th martyrdom day, cabinet minister Harbhajan Singh ETO on Saturday announced that roads leading to all religious sites will be transformed. Cabinet minister Harbhajan Singh ETO (centre) with AAP leaders at the party's event in Baba Bakala, Amritsar. (HT) While addressing a political conference organised by the ruling AAP on the occasion of Rakhar Punya, a Sikh festival commemorating the discovery of Guru Teg Bahadur as the ninth Sikh Guru by Baba Makhan Shah Lubana, the minister said the AAP government had fulfilled almost all guarantees that were promised to the people before the elections. Except him, no big face of the ruling AAP turned up at the event, despite chief minister Bhagwant Mann and AAP national convener Arvind Kejriwal being in Tarn Taran district. Referring to the 350th martyrdom anniversary of Guru Teg Bahadur, ETO invited the 'sangat' to participate in these programmes, and announced that before September 5, the memorial of Bhai Jaita at Anandpur Sahib, built at a cost of around ₹20 crore, will be inaugurated to formally commence these events. The minister declared that the infrastructure of villages and towns blessed by Guru Teg Bahadur's presence will be transformed. He added that in just three and a half years, the Bhagwant Mann government had accomplished as much work as previous governments could not in 75 years. He highlighted the provision of 600 units of free electricity to every household, major improvements in the power sector, uninterrupted eight-hour daytime electricity supply to farmers and the purchase of a thermal plant from the private sector by the Punjab government. Referring to the 'corrupt coal purchasing practices' of previous governments for their personal gain, he said, 'We have stopped that racket and begun using our own coal mines, which has brought significant economic benefits to the power department. Today, the power department is earning profits of over ₹2,500 crore.' He further announced that soon the chief minister will provide medical insurance worth ₹10 lakh to every household, which will permanently remove the burden of medicine expenses from common people's pockets. Speaking about the war against drugs, the minister said so far, ministers, MLAs, constituency in-charges and other party leaders had visited over 7,000 villages and towns to spread the message against drugs.

HC orders Punjab to promote inspector who fought terrorist in Dinanagar as DSP
Chandigarh: The Punjab and Haryana high court has directed the Punjab govt to promote an inspector with the special operations cell of Punjab Police, , who suffered bullet injuries during the 2015 terrorist attack at Dinanagar police station in Gurdaspur district, to the rank of DSP. Tired of too many ads? go ad free now "The govt in its meeting considered the incident which took place on July 27, 2015, at Dinanagar police station and decided to grant one promotion to each employee. There was a conscious decision to grant promotion which was never withdrawn or modified…This court is of the considered opinion that the petitioner was also entitled to promotion from the rank of Inspector to DSP," observed the HC while directing the state to promote Balbir Singh. In its detailed order released on Friday, the HC also observed that by giving an out-of-turn promotion as DSP to another cop, Bikramjit Singh Brar, the state has considered that an inspector may be promoted out of turn. "The appointment and promotion to the post of DSP is governed by 1959 Rules. Rule 14 empowers govt to relax any provision for the reasons to be recorded in writing," the HC has held. The HC passed these orders while allowing the plea filed by Balbir Singh, who joined Punjab Police in 1992 as an ASI and was promoted to inspector in 2011. During the Dinanagar operation, he played a key role in saving the Gurdaspur senior superintendent of police (SSP) and suffered two gunshot injuries fired from AK-47 rifles by the terrorists. He was admitted to a private hospital in Amritsar where he underwent surgery. On Aug 3, the state govt condemned the Dinanagar terrorist attack and announced a job for the next of kin of martyr cops. It was also announced to promote the injured cops to the next rank. Tired of too many ads? go ad free now Balbir was awarded the medal for gallantry on Independence Day, along with superintendent of police Baljit Singh (posthumously) and head constable Tara Singh. The DGP also awarded him Prakaram Padak and Rs 50,000 monetary help on account of sustaining injuries during the encounter. Later, the state govt promoted all the cops but denied him promotion to the rank of DSP on the grounds that since he was awarded the President's Police Medal for Gallantry, he could not be promoted. On this, Balbir Singh contended that during the pendency of the petition, the state appointed another inspector, Bikramjit Singh Brar, as DSP, who was also awarded the President's Police Gallantry Award. He encountered notorious gangster Vicky Goundar on Jan 25, 2018. He was promoted by the decision of the cabinet. If the similarly situated inspector can be promoted, there is no reason to deny the benefit of promotion to the petitioner, his counsel submitted. After hearing all the parties, the HC observed that the appointment of Bikramjit Singh Brar was not as per the procedure contemplated by the 1959 Rules, whereas it was because of the decision of the council of ministers. While asking the state to promote Balbir Singh to DSP, the HC, however, made it clear that he shall not be entitled to any financial benefits for the period he was not holding the rank of DSP.
