Allahabad HC quashes Abbas Ansaris conviction in hate speech case

Prayagraj (UP), Aug 20 (PTI) The Allahabad High Court on Wednesday quashed the conviction of Mukhtar Ansari's son Abbas Ansari in a 2022 hate speech case.
Justice Samir Jain set aside a special MP MLA court order sentencing him to two years' rigorous imprisonment.
The special court in Mau convicted Abbas and sentenced him to two years' imprisonment in the speech case on May 31.
Abbas moved the appellate court which rejected his challenge on July 5 following which he moved the high court for the relief.
He was punished under Sections 153-A (promoting enmity among different groups) and 189 (threat of injury to a public servant), Section 506 (criminal intimidation) and Section 171F (undue influence or personation at an election) of IPC.
He was also slapped with a Rs 2,000 fine.
Abbas' election agent, Mansoor Ansari, who was present on stage during the speech, was also convicted in the case and sentenced to six months in jail.
The then MLA of Suheldev Bharatiya Samaj Party from Mau Sadar assembly constituency allegedly threatened state government officials of consequences if Samajwadi Party came to power after the 2022 assembly election.
'I have told Akhilesh bhaiya (former Chief Minister Akhilesh Yadav) that after formation of the government, there will be no transfer or postings of bureaucrats for six months. Everyone will remain where they are. First there will be hisab-kitab (scores to be settled), only then will transfer take place," he allegedly said in the speech.
He won the 2022 assembly election by over 38,000 votes from the Mau seat. PTI RAJ AMK AMK

Poland Accuses Moscow Of 'Provocation' After Russian Drone Breaches Airspace, Explodes In Field

A Russian drone reportedly breached Poland's airspace on Wednesday, before exploding in a field in the eastern part of the country, with Warsaw labelling the incident as a 'provocation". No casualties were reported, but officials told AFP the windows of some houses were blown out. Notably, Poland had been on high alert for objects entering its airspace since a stray Ukrainian missile struck a southern Polish village in 2022, killing two people. 'Once again, we are facing a provocation from the Russian Federation, with a Russian drone," Polish Defence Minister Wladyslaw Kosiniak-Kamysz told reporters. He highlighted that the incident took place when 'peace talks were underway, where there is hope that this war… has a chance to end. Russia provokes once again." Poland To Issue Formal Protest Polish General Dariusz Malinowski said the drone appeared to be a decoy which was designed to self-destruct, while containing a Chinese engine. The drone was believed to be a Russian drone model called Gerbera, which is often used as a decoy in multiple Russian drone and missile barrages against Ukraine. Poland's Foreign Minister Radoslaw Sikorski said his ministry would issue a protest against the airspace violation, but did not name the perpetrator. 'Another violation of our airspace from the East confirms that Poland's most important mission towards NATO is the defence of our own territory." The Russian embassy in Warsaw did not immediately respond to an emailed request for comment. This comes less than a month after a Russian military drone flew into Lithuania from Belarus. It is worth mentioning that Poland has been a major supporter of Ukraine, and hosts over a million Ukrainian refugees and is a key transit point for Western humanitarian and military aid to Ukraine. 'I was sitting in my room at night, around midnight, maybe, and I heard something just bang," a Polish resident told Reuters. 'It exploded so loudly that the whole house simply shook." Not aware of any anti-Bangladesh activities by Awami League in India: MEA
Agency: New Delhi, Aug 20 (PTI) India on Wednesday said it was not aware of any anti-Bangladesh activities in the country by the Awami League party led by former prime minister Sheikh Hasina. New Delhi's comments came after Bangladesh's interim government said that the opening of its offices by the Awami League in Indian cities could adversely impact bilateral ties. The Ministry of External Affairs (MEA) said New Delhi is not aware of any anti-Bangladesh activities by purported members of the Awami League in India or of any action that is contrary to Indian law. 'The government does not allow political activities against other countries to be carried out from Indian soil," MEA spokesperson Randhir Jaiswal said. 'The press statement by the Interim government of Bangladesh is thus misplaced," he said. 'India reiterates its expectation that free, fair and inclusive elections will be held at the earliest in Bangladesh to ascertain the will and mandate of the people," he added. In its statement, Dhaka said on Wednesday that the opening of Awami League offices in Indian cities poses a risk to bilateral ties. 'This development also risks upholding the good-neighbourly relations with India driven by mutual trust and mutual respect, and lends serious implications for the political transformation underway in Bangladesh," Bangladesh's foreign ministry said. It alleged the Awami League has set up offices in India against the backdrop of what it described as 'growing anti-Bangladesh activities" by the leadership of the party from Indian soil. Many senior Awami Party leaders, 'absconding" in several criminal cases in Bangladesh on account of 'grievous crimes", were in Indian territory, it further alleged. Such political activity 'against the interests of Bangladesh" is an 'affront against the people and State of Bangladesh", the Bangladesh foreign ministry said. There has been a sharp downturn in India-Bangladesh relations after deposed prime minister Sheikh Hasina fled Dhaka and took shelter in India in August last year in the face of a massive anti-government protest. Bill on crowd management tabled in Karnataka Assembly
Agency: Bengaluru, Aug 20 (PTI) The Karnataka government on Wednesday tabled a bill on crowd control that proposes stringent punishment for organising unpermitted events, civil disturbance and 'crowd disaster". The Karnataka Crowd Control (Managing Crowd at Events and Places of Gathering) Bill was introduced in the Assembly over two months after the stampede at the Chinnaswamy Stadium on June 4 that killed 11 people and injured many others. According to the proposed legislation, whoever intends to organise any event or function that would attract a mass gathering or a crowd should obtain permission from the jurisdictional authority. When the crowd is fewer than 7,000, the officer in charge of the police station may grant permission upon application from the organisers after due enquiry, it states. If the crowd is more than 7,000, but fewer than 50,000, the Deputy Superintendent of Police of the jurisdiction may grant permission upon application from the organisers after due enquiry. The bill also states that in case the crowd is more than 50,000, the jurisdictional superintendent of police or the commissioner of police may grant permission upon application from the organisers, after due enquiry. It says that whoever organises or attempts or abets the organisation of any unpermitted event should be punished with imprisonment for a term which may extend to a minimum of three years and up to seven years or with a fine up to Rs 1 crore or both. 'Whoever disturbs or attempts to disturb or abets to disturb the orderly crowd in any event or function by way of creating false rumours, statements, acts or causing any breach of peace including a threat of collective violence, destruction of property, or other unlawful acts shall be punishable with imprisonment for a term which may extend to three years or with fine of rupees fifty thousand or both," according to the bill. In the event of a crowd disaster, the person or persons responsible for it, leading to loss of property or life, will be 'liable for imprisonment to a minimum of three years and up to seven years for injuries and imprisonment to a minimum of 10 years up to life sentence for fatalities". Whoever disobeys or abets to disobey lawful directions of any police officer, of and above the rank of sub-inspector of police on duty, to disperse from the place of gathering shall be liable to a fine of Rs 50,000, including, community service for a period of one month, the bill proposes. Once the bill is passed, the offences under this Act will be cognisable, non-bailable and triable by a judicial magistrate first class.
