The court of additional sessions judge, Rajnish Garg, has acquitted three individuals booked by UT Police in a mobile snatching case, citing significant inconsistencies in the prosecution's evidence. The Chandigarh court noted that the prosecution failed to prove both the recovery of the stolen mobile phone and the identity of the accused beyond a reasonable doubt. (HT photo for representation) The case dates back to April, 2023, when complainant Kamalpreet Kaur, a resident of Phase-1, Mohali reported that her mobile was snatched on the night of April 7-8, 2023, in Sector-37, Chandigarh. She stated that three boys on a Punjab-registered Activa snatched her black VIVO mobile. Sector-39 police had booked Abhishek from Jujhar Nagar, Mohali, and Deepak and Vishal from Daddu Majra Colony, Sector-38. An FIR under IPC Sections 379-A, 34, and 411 was registered on April 10, 2023. SI Jagtar Singh was the investigating officer (IO). The accused were allegedly arrested during a police naka, with the snatched mobile phone being recovered. The court questioned the blue colour of the recovered mobile phone, as the complainant had stated in her complaint that her snatched VIVO mobile was of black colour. The prosecution presented five witnesses, while the accused pleaded innocence, claiming false implication and no recovery from them. The court highlighted an unexplained three-day delay in FIR registration. The incident occurred on April 7, but the complaint was officially moved on April 10. The complainant testified her statement was recorded on the spot on April 7, raising concerns about the suppression of the occurrence's origin. Further inconsistencies arose regarding the timeline of arrests. The court noted that the accused were apprehended and recovery was made within an hour of FIR registration, as per the IO. This suggested the possibility that the accused might have already been in police custody before the case was officially registered, implying the current case could have been 'planted'. The prosecution also failed to prove the accused's identity beyond a reasonable doubt. Although the complainant initially claimed she could identify the accused and provided the Activa scooter number, she couldn't recall it in the court. This discrepancy, coupled with the timing of apprehension, suggested police might have provided the scooter details to the complainant. The complainant's testimony on apprehension was inconsistent; she initially claimed her presence during arrest but later stated that the police showed her the accused at the station on an unknown date. Most critically, the prosecution failed to prove the recovery of the snatched mobile phone. Despite claims, the seizure memo listed the mobile as recovered from Vishal, while the IO and complainant testified it was from Deepak, a significant contradiction. Moreover, the recovered phone was blue, contradicting the complainant's statement and repair bill which stated her phone was black. The prosecution also couldn't establish the complainant's ownership of the recovered phone. The court concluded that the prosecution failed to prove both the recovery of the stolen mobile phone and the identity of the accused beyond a reasonable doubt.

Rickshaw driver hits 63-year-old in Pune, abandons him to die near railway tracks
A 63-year-old man was fatally injured and later died after being hit by a rickshaw in Pune's Balewadi area. The rickshaw driver, who was coming from the wrong side, fled the scene after abandoning the injured victim in an isolated area instead of taking him to a victim, Gopal Govind Wagh, had left his home around 3 pm on Sunday on his Activa two-wheeler. However, when he did not return home until 7 pm, his son, Amitkumar Gopal Wagh, began searching for him. After receiving no updates from relatives or locals, Amitkumar lodged a missing person complaint at the Police reviewed CCTV footage from Balewadi Phata, where Wagh was last seen. Around 4:45 pmon on Sunday, Wagh was crossing the road at Balewadi Phata when a rickshaw coming from the wrong direction hit him forcefully. He suffered serious injuries from the impact. With the help of bystanders, the injured Wagh was placed into the same rickshaw for transport. However, instead of taking him to a hospital, the unidentified rickshaw driver abandoned him unconscious near the Range Hills railway tracks, in a patch of body was discovered on Monday, and he was found to have sustained fatal head injuries. Fined for his own stolen bike: 15 days on, owner waits, cops yet to act
Chandigarh: A city resident received a traffic challan for not wearing a helmet on a motorcycle he had reported stolen a day earlier. Even though he submitted video evidence of two men riding the stolen bike, the police have made no arrests. It's been over 15 days since the incident. The complainant, Iqbal Singh, a resident of Sector 56 and an employee at a private bank in Sector 29, reported that his Honda Livo motorcycle was stolen on the night of July 5. He had parked the bike outside his house along with other vehicles. The next morning, he discovered it missing. Upon reviewing CCTV footage from the area, Singh found that two auto-lifters arrived on an Activa scooter around 1:19 am and stole his bike using duplicate keys. He lodged an FIR at Sector 39 police station and submitted the footage to assist in the investigation. On July 6, Singh received a traffic challan from Mohali police for helmetless riding, issued against his stolen motorcycle. He later obtained additional CCTV footage from Kharar, showing two individuals riding his bike without helmets. This footage was also submitted to Sector 39 police. Despite having visual evidence from both Mohali and Kharar, the suspects remain at large, and the stolen motorcycle has not been recovered. Singh expressed disappointment over the lack of action, stating that the police could have easily traced the culprits if they had shown seriousness in the case. Police officials, however, claimed that the faces of the suspects are not clearly visible in either video, making identification difficult.
