Court acquits fruit vendor of assault and obstruction, imposes fine for abusive language

Hyderabad: A local court in Hyderabad acquitted a fruit vendor who had been accused of assaulting traffic police and obstructing their work during a footpath clearance drive in Erragadda, an area under the jurisdiction of the SR Nagar police station, in 2017.

However, the court found the vendor guilty of using abusive language against the police and imposed a fine of Rs 2,000.
The accused was initially booked under Section 353 IPC following a complaint from an official of SR Nagar police station, which pertains to assault or criminal force to deter a public servant from the discharge of their duty. However, during the trial, the court found that the prosecution had failed to provide sufficient evidence to sustain the charge.
Notably, the police claimed that the entire incident had been captured on a body-worn camera, yet they failed to produce the footage during the proceedings. Furthermore, while the FIR alleged that the vendor had assaulted and obstructed the police officers, the officers' statements during the trial omitted any mention of obstruction.
"Though the accused was booked under Section 353 IPC, the traffic police did not mention this in their evidence to the court during the trial.
Therefore, the ingredients under Section 353 IPC do not apply," the court ruled.
Upon examining the available evidence, the court concluded that only the charge under Section 294B of the IPC—pertaining to obscene language—was proven.
Taking a lenient view, the judge imposed a fine of 2,000 rupees, considering the accused's plea that the prolonged legal proceedings had caused him mental distress.

Kochi: Kerala high court commuted the life sentence imposed on Subahani Haja alias Haja Moidheen of Thodupuzha, an accused in an Unlawful Activities (Prevention) Act (UAPA) case for allegedly joining the proscribed terrorist organisation ISIS and fighting for them in Mosul, Iraq, in 2015, to 10 years of rigorous imprisonment. A bench comprising Justices V Raja Vijayaraghavan and K V Jayakumar on Thursday, while considering Haja's appeal challenging his conviction and sentence, upheld the rest of the findings and sentences imposed on him by a special court under various sections of UAPA and IPC. According to the prosecution, Haja travelled to Istanbul in Turkey on a tourist visa in April 2015, crossed the border into Iraq and underwent physical and arms training in Mosul. He was deployed on the war front but sustained an injury during training and was hospitalised. Following repeated requests, he was allowed to return to India in Sept 2015, after which he worked as a salesman-cum-accountant at Kadayanallur, Tamil Nadu, for about a year. In 2016, NIA arrested him upon receiving information about his association with ISIS. Further, it found that the special court had not stated any reason for awarding the maximum sentence under Section 20 of UAPA. Thane: A 10-year-old girl's courageous testimony against her stepfather led to his conviction for sexual assaults and exploitation, with a Thane court sentencing him to ten years of rigorous imprisonment (RI) on Monday. Additional Sessions Judge DS Deshmukh convicted the 35-year-old stepfather under the Pocso Act after the victim consistently described how he sexually assaulted the girl multiple times in their home at a chawl in Thane. The incident came to light in April 2019 when neighbours noticed the child had gone missing for two days along with her elder brother. When she returned on April 11, 2019, concerned neighbours questioned her about her whereabouts, leading to the shocking revelation. The girl told the court that her stepfather sexually assaulted her. She also revealed that he committed similar heinous acts earlier when her mother was ill, showing a pattern of abuse that was ongoing. The child's mother died after giving birth to her younger brother, leaving her vulnerable to the predatory behaviour of the man who was supposed to protect her. The court, calling it a heinous act and a blot on the father-daughter relationship, noted that instead of being a protector, the accused became a predator who sexually exploited the child. The judge said that such a stringent punishment would send a clear message to society about the consequences of child sexual abuse. He was also convicted of using minors for begging and exploitation under the Juvenile Justice Act, receiving a one-year sentence, which will run concurrently. The court imposed a total fine of Rs 12,000 to be paid to the victim as compensation, with all sentences running concurrently.
