Elgar case: SC asks ex-DU prof Hany Babu to move HC or trial court for bail

New Delhi, Jul 16 (PTI) The Supreme Court on Wednesday asked former Delhi University's faculty Hany Babu to move either the Bombay High Court or the trial court for bail in the Elgar Parishad-Maoist links case.
His lawyer then said the high court court had granted bail to five co-accused persons in the case.
When Babu moved the high court, it said the apex court's order permitting the withdrawal of his plea did not reserve his liberty to move the high court and asked him to seek a clarification from the top court.
Babu's counsel on Wednesday submitted he had undergone five years as an undertrial and withdrawn the special leave petition from the top court to move the high court.
The NIA's counsel opposed the plea, calling the application not maintainable for a fresh bail application ought to go before the NIA court.
He said the high court was a court of appeal and the case involved Unlawful Activities (Prevention) Act charges.
The bench then said, 'Your primary ground is, some other accused has been granted bail, that can also be considered by the trial court.' The apex court further remarked that it couldn't direct the high court to consider his bail plea and granted Babu the liberty to seek revival of his previous appeal withdrawn last year.
The high court on September 19, 2022 rejected his bail plea.
The NIA has accused Babu of being a co-conspirator in propagating Maoist activities and ideology on the instructions of leaders of the banned CPI (Maoist) organisation.
Babu was arrested in July 2020 in the case and is currently lodged at the Taloja prison in Navi Mumbai.
The case relates to alleged inflammatory speeches delivered at the Elgar Parishad conclave, held in Shaniwarwada in Pune on December 31, 2017, which police claimed triggered violence the next day near the Koregaon Bhima war memorial located on the city's outskirts.
One person was killed and several others were injured in the violence.
The case, in which over a dozen activists and academicians had been named accused, was initially probed by the Pune Police and later taken over by the NIA. Babu approached the HC in June this year, challenging an order of the special NIA court here which rejected his bail plea earlier this year.
Babu, in his plea, had said the special court had 'erred' in holding that there existed prima facie incriminating material against him.
The NIA had opposed the bail plea, arguing Babu actively participated in activities to promote Naxalism and wanted to overthrow the government. PTI PKS PKS AMK AMK

Solicitor General Tushar Mehta Friday questioned the locus standi of X Corp to approach the Karnataka High Court under the aegis of the right to freedom of speech. He also raised the issue of internet anonymity by raising the example of a fake X account named 'Supreme Court of Karnataka'. X has been arguing in the high court that takedown orders should be issued under Section 69A of the Information Technology Act, and not Section 79 (3) (b) of the same Act. While concluding his submissions, he stated, 'X has no locus standi to file the present writ petition under Article 226 of the Constitution, at least claiming Article 19(1)a rights (freedom of speech), or Article 14 rights (right to equality)… the petitioner is an out and out foreign commercial entity. It is neither a citizen of India nor a natural person… It is for the individual citizens of the country to ventilate their fundamental rights.' He had earlier stated on the topic of anonymity in the online medium, 'We have opened one account in the name of the 'Supreme Court of Karnataka', and Twitter has opened that account… I can post anything in that, and lakhs of people will say that the Supreme Court of Karnataka has said it. I can remain anonymous or pseudonymous…' Senior Advocate K G Raghavan, who represents X, had raised objections to this, pointing out that it had not been put on the record. He stated, 'I am not on who created it, etc… I am only saying, if it is to be relied upon as part of a counsel's submission…' The judge said it had been taken only in the nature of an illustration, adding, 'You can rest assured that this illustration will not prejudice.' Raghavan later stated that the account in question had been taken down. Solicitor General Mehta also made submissions on the topic of the Sahyog Portal. On the question of whether even a metro engineer could be an authorised person to issue notices under the Sahyog Portal, he said, 'He is a designated authority… it is not necessary that police persons are only the designated authority. If this type of situation arises… some authority will have to be designated in each department. What used to happen was anybody used to write a letter. Some police stations in Kolkata etc, would send a letter to Facebook… intermediaries came to us – if you have a portal, intermediaries will know that somebody has authorised this. And the Government will also know about the compliance. It is merely an administrative mechanism. Twitter has chosen not to join… rest of them (intermediaries) have joined the portal.' Nina Kutina, found living in remote Karnataka cave with two kids, did THIS to earn while travelling across 20 countries
Nina Kutina, a 40-year-old Russian woman found living in an isolated forest cave in Karnataka, was rescued by a police team from the Gokarna station on July 9. Her two daughters Preya (6) and Ama (4) were also rescued by the cops. Details of how Kutina and her daughters managed to survive in a dangerous cave in the forested Ramatirtha Hill area of Gokarna for nearly two weeks have now emerged. The trio had travelled from Russia to India on a business visa and reached the sacred coastal town of Gokarna via Goa. The family eventually moved deep into the forest, where they made a natural cave their home amidst dense woods and steep terrain. According to a PTI report, Kutina revealed that she lived peacefully with her two young children, and spent her days painting, singing, and reading books. Describing her life in the cave, she said, 'We woke up with the sun, swam in rivers, and lived in nature. I cooked on a fire or gas cylinder depending on the season, and got groceries from a nearby village. We painted, sang songs, read books, and lived peacefully.' She also alleged that news reports have misrepresented their life. 'Everything shown on TV about us is false. I have videos and photos that show how clean and happy our life was before,' she said. Kutina said she is a trained teacher in art and Russian literature, and that she personally educates her children. 'They are very smart, healthy, and talented. Everyone who meets them says so,' she said, adding that her children have not attended school but will be formally homeschooled with official documents in the future. Kutina told PTI that she is a mother of four and has been travelling for the past 15 years. 'Over the past 15 years, I've been to around 20 countries. My children were all born in different places. I delivered all of them myself, without hospitals or doctors, because I know how to do it. No one helped me, I did it alone,' she said. The Russian woman said she earned by making art and music videos, and occasionally teaches or babysits. 'I earn money through all these activities. And if I don't have any work, if I can't find anyone who needs what I can offer, then my brother, my father, or even my son helps me. So we always have enough money for what we need." Asked why she didn't return to Russia, Kutina replied, 'There have been many complicated reasons. First, there were multiple personal losses – not just the death of my son, but also a few other close people. We were constantly dealing with grief, paperwork, and other problems.' She said she has traveled to four other countries and then came back to India 'because we love India deeply – its environment, its people, everything'. Kutina confirmed that she is now in contact with the Russian Embassy, which is helping her family. Responding to concerns about her current condition, Kutina said, 'We are now kept in an uncomfortable place. It's dirty, there's no privacy, and we get only plain rice to eat. Many of our belongings were taken, including the ashes of my son who passed away nine months ago.' Kutina's ex-husband, an Israeli citizen, is demanding shared custody of their daughters, saying he wants to be a father to them. 'I just want to be able to see my daughters a few times a week and take care of them, too. My concern is that if they go to Russia now, it will get tougher to keep in touch with them. So, I wish they could stay in India,' Goldstein told PTI on July 16. Dror Goldstein (38), who said he lives for nearly six months a year in Goa, said he had been living separately from Kutina for the last couple of years and that he 'lost touch' with them when she took the daughters and left Goa a few months ago. 'I managed to find them on a beach in Gokarna, but Kutina refused to let me be with my children as I don't live with them anymore,' added Goldstein. He said he met Kutina in Goa around 2017 and they had been together, travelling between India and Ukraine, until they split.
