Kāinga Ora tenants accused of firing gun, threatening assault keep homes despite eviction bids

The tenant allegedly asked the boy: 'Do you want to die? Are you not scared of dying? I'll come and kill you right now.'
However, the tribunal adjudicator decided there was not enough proof the man made the threats, despite it being confirmed he was facing criminal charges after police found a firearm at his property.
The unsuccessful evictions appear to be speed bumps in Kāinga Ora's new policy of getting tough on state housing tenants.
In January, Housing Minister Chris Bishop declared the 'easy ride' for disruptive Kāinga Ora tenants to be over.
In March last year, the Government told the public housing provider to abandon its 'Sustaining Tenancies Framework'.
That programme first started in 2017 as a pilot in which Kāinga Ora staff were urged to try their best to avoid evicting tenants and instead work with them to overcome their issues.
Part of the policy's belief was that evicted tenants could be left with nowhere else to go, potentially leading them to cause more trouble on the streets or cost taxpayers more through poor health and medical expenses.
The new Coalition Government argued, however, that disruptive and threatening tenants were causing neighbours to live in fear.
They believed the threat of eviction would also 'spark behaviour change', forcing these tenants to behave better.
That tougher stance led to a five-fold increase in evictions.
A Kāinga Ora spokeswoman said about 85% of all its eviction applications to the Tenancy Tribunal were successful.
'Of the 88 applications we made in the past 12 months, 77 were successful,' she said.
However, the Hamilton and Nelson cases showed tribunals weren't rubber-stamping every application.
The spokeswoman said the tribunal needed a 'high standard of evidence'.
'While we always aim to meet that threshold, sometimes the evidence we are able to present isn't quite strong enough,' she said.
In the Hamilton case, tribunal adjudicator Jenny Robson questioned how reliable the neighbour's evidence was.
Robson noted that Kāinga Ora had presented evidence saying the neighbour - who was the grandmother of the teenage boy the tenant was accused of pointing the rifle at – originally gave a statement to police, saying she went outside to confront the tenant.
She told police the tenant then threatened to also kill her and shot off more rounds from his rifle.
But when Robson asked the grandmother what happened during the confrontation, she replied that the tenant ignored her.
'Her oral evidence was contrary to the statement she had given to the police,' Robson concluded.
The woman's grandson also didn't appear at the tribunal, meaning Robson was left to doubt the evidence presented.
The tenant himself refused to comment at the tribunal, saying he had pending criminal proceedings.
In the Nelson case, the tenant's clean record over four and a half years helped save her tenancy despite her admitting she threatened her neighbour.
The drama began when her boyfriend assaulted the neighbour's son on January 9.
The boyfriend was bailed with conditions to stay away following the attack, but allegedly returned to the woman's flat within two weeks.
When her neighbour called police to report the bail breach, the tenant overheard 'inflammatory language' about her boyfriend and confronted the woman, the tribunal said.

'The tenant does not dispute she threatened to assault the neighbour. The video evidence of such a threat was conclusive,' tribunal adjudicator Michael Brennan found.
However, he noted that only one of seven neighbours had complained about the woman and she had not had run-ins before this incident.
He ultimately decided there were enough mitigating factors to let her off.
'I have given the tenant the benefit of the doubt this time, but she should be clear on how any future repeat behaviours … may not result in the tenancy continuing,' he said.

Every four minutes, New Zealand Police are called to a family harm incident. That's up to 400 call-outs every single day. It's a staggering and disturbing figure in a country that prides itself on kindness, community, and whānau. Yet, behind too many closed doors, the silent war rages, leaving victims bruised, broken, and often voiceless. Today The Detail looks at the alarming rate of domestic violence in New Zealand, and potential solutions, speaking to Auckland University professor of law Mark Henaghan, who was on the Family Violence Death Review committee for nearly decade, and Emma Powell, CEO of Te Puna Aonui, which has launched the Government's action plan to eliminate domestic and sexual violence. 'I would probably use the words hidden epidemic, basically,' says Henaghan. 'Nearly 50 percent of our murder cases involve family violence. 'We only really detect … about 20 percent [of domestic violence incidents], so there's a whole lot … that doesn't get to the surface.' He says something needs to be done, and immediately. New Zealand's rates of domestic and family violence are among the highest in the OECD. On average, 13 females and 10 males are killed every year. Māori women are particularly at risk – more likely to be killed by a partner and less likely to seek help. The financial cost to the country, Henaghan says, is huge. 'They reckon it's worth, like to the country … between $8 to $10 billion, probably more … in terms of time off work, and how people suffer from it so they can't be productive, how children get into difficulty because all the costs of it, the medical costs, and all the rest of it, are massive. 'But they're never talked about much in any political campaign, I think it's because … we don't want to know about it. 'We do need to hear about it; we need to have our eyes wide open to the realities of it.' Powell, who is also a key member of the Executive Board for the Elimination of Family Violence and Sexual Violence, tells The Detail, 'if you look at the numbers, the rates are stubbornly high', but she says the Government is taking action to address the crisis. Late last year, it launched part two of Te Aorerekura – the National Strategy to Eliminate Family Violence and Sexual Violence – a 25-year strategy designed to achieve intergenerational change. Part one was introduced in 2021. Powell says over the next few years they're keying in on good investment and commissioning, how effective funding is, freeing up frontline workers to get them into the community and more productive places, getting into the regions, intervening earlier, focusing more on children, confronting perpetrators, and building an information sharing platform. 'I really believe that the only way forward is doing things as collectives, and that's tough, it is hard, hard stuff to do, but it's really important,' says Powell. 'I think taken together and executed really well in a community, we should start to see a real shift.' Last week, the Government announced that, as part of the action plan, more training to help staff support in family and sexual violence responses would be rolled out across frontline services, with the goal of reaching 10,000 workers in the next two years. Minister for the Prevention of Family and Sexual Violence Karen Chhour says, 'this will ensure victim-survivors receive best practice support, and will empower staff to safely recognise, refer, and respond to family and sexual violence. 'This training is an important part of our response to family and sexual violence. I am proud of our progress against the second Te Aorerekura Action Plan, it shows the benefits of a multi-agency response and the dedication of government departments to best supporting victim-survivors.' Powell says while change can be slow, a recent experience in Rotorua provides proof that it is starting to happen. 'I was spending time on the ground with a multi-agency collaboration … and I was talking to one of the leads there and she was telling me about just a story – stories that they are starting to see more and more – where 'she has left him', and we don't count that, we don't count that in government as an indicator of success. 'But they are seeing more and more that women are feeling empowered, supported, and safe to actually leave very violent and difficult situations. 'In the words of Leslie Knope from (NBC sitcom) Parks and Recreation, when they shout at me, it's just them caring really loudly.' Langford said the past five years for local government had been intense, mostly due to the amount of change imposed on the sector, such as Three Waters and Local Water Done Well reforms and the Government's plans to replace the Resource Management Act and Building Control Authority. 'Councils that come out the other side are going to look very different, and they are going to have to figure out their purpose and role in supporting the community,' he said. 'As New Zealand, we are one of the most centralised systems of government in the whole of the OECD (Organisation for Economic Co-operation and Development). 'Our Government spends 93% of all taxes, and I think the average across most high income countries is more like a 70 (central) 30 (local) split.' He said Government conversations around rates capping and focusing on the basics sounded good, but 'what does that mean?'. 'Almost all our rates' money is spent on core services already, and the bits that aren't are the bits people really care about and fought to keep. 'We fund the Christmas Parade, and give $100,000 a year to surf lifesaving to help them patrol the beaches and keep our kids safe. That's not core services. 'If we put caps on rates, these are the things that will get hit.' The council achieved an average 2.2% rates rise for 2025/26, the lowest in the country. 'The foundations we've laid here are going to serve the community well. 'Whoever comes in to replace me will like some things I've done and change some of them as well, but, hopefully, they'll keep the momentum going.' Langford said he would be disappointed if the district did not have the lowest rates increase next year as well, while still increasing investment in core infrastructure. There was an 11% increase in the council's infrastructure spend for 2025/26. A major part of the council's role was 'building things', whether it be fixing potholes or putting pipes in the ground, he said. 'There are a lot of armchair engineers out there, but it comes with the territory. 'Anybody who's watched an episode of Bob The Builder thinks they know how to do my job better than I do. 'Like I said before, if you're not up for the criticism, and you're not prepared to rise above it, this job is not for you.' Langford said challenges still lay ahead, such as the future of the NZ International Commercial Pilot Academy. The facility is under investigation by the Civil Aviation Authority, although four planes have returned to service. 'It delivers around $10 million of GDP into our economy, but the goal was also to get a business paying landing fees at the airport, so the ratepayer doesn't have to subsidise it as much. 'The intention was always to get it set up as an investment, and once it's running, sell it. 'Now's the time to hand it over to the private sector, but make sure we keep those benefits.' He said his proudest achievements was forming a citizens' assembly - 'a bold move' - to tackle the future of outdoor swimming in the district, including the Whanganui East pool. The assembly presented two recommendations at a council meeting this month, although the issue was left on the table until August 12. 'There's a heap of lessons we've learned and when council does the next one, it'll be a bit slicker and even better,' Langford said. 'For me, it was seeing the community step up and make the most of the opportunity, and really get engaged with an issue they care about.'
