HC allows animal slaughter for Bakri Eid and Urs at Vishalgad

Mumbai: The Bombay high court vacation bench on Tuesday allowed animal slaughter for Eid al-Adha, or Bakri Eid, at a dargah at Vishalgad fort in Kolhapur but set out conditions that it directed should be strictly complied with.

The conditions include that the killing of animals or birds shall only take place inside closed premises — a private land owned by one Mubarak Usman Mujawar — and no slaughter should be done in an open or public place.
The court permitted animal slaughter for Bakri Eid on June 7 and the four-day Urs from June 8 to 12 at the dargah of Hajrat Peer Malik Rehan Mira Saheb within the fort. The vacation bench of Justice Neela Gokhale and Justice Firdosh Pooniwalla, hearing an interim application filed by Hazrat Peer Malik Rehan Dargah Trust, which sought permission to conduct the animal slaughter, stated its order would also apply to dargah devotees who come there to sacrifice animals for Eid.
The trust filed a petition challenging various letters sent by the director of archaeology and museums to the superintendent of police, Kolhapur, and the chief executive officer of the Kolhapur Zilla Parishad for a ban on the slaughtering of animals and birds at Vishalgad in Shahuwadi Taluka. The fort, built in the 11th century, is an ancient and historical monument, said the authorities.
The trust's advocate, S B Talekar, said the dargah is within the fort and the actual sacrifice does not take place in a public place but behind closed doors on private land nearly 1.4 km away from the fort.
On June 14 last year, the high court division bench of Justice BP Colabawalla and Justice Pooniwalla allowed animal slaughter during Bakri Eid and Urs at the dargah. "Considering the fact that the coordinate bench of this court in order dated June 14, 2024, already dealt with the issue and permitted the prayer, the same shall continue for the festival of Bakri Eid, which is on June 7, and the Urs for four days from June 8 to 12.

Needless to state, the same conditions, which were imposed in the June 14, 2024 order, shall apply to the petitioners in the present interim application and also to devotees of the dargah who come to sacrifice animals during Bakri Eid and Urs. The conditions imposed in the June 14, 2024 order shall be strictly complied with," the vacation bench noted in the order and disposed of the trust's application.
Lakhs of devotees, followers, and others visit the dargah on the first day of Urs, said the dargah trust.

THE DELHI High Court on Monday said it will direct the CBI and the Lokpal to maintain strict confidentiality in the Lokpal-ordered probe against Trinamool Congress MP Mahua Moitra in the alleged cash-for-queries row, while hearing a plea by Moitra raising objection to leaks pertaining to the investigation. Represented by advocate Samudra Sarangi, Moitra argued that because of the 'leaks' she 'can't defend these allegations in the public domain, and it's a one sided attack'. The TMC MP requested the court to issue directions to the CBI and Lokpal to maintain confidentiality, as prescribed under the rules. She is expected to make filings based on the CBI probe report before the Lokpal by August 13. Objecting to the leak of the very fact that the CBI submitted its report to the Lokpal, which was made public through media in July, Moitra also expressed an apprehension that she was unaware if the probe report too had been leaked. Relying on a June 5 circular by the Lokpal of India, The TMC leader's counsel highlighted before Justice Sachin Datta that while referring complaints/matters to the inquiry/investigating agencies, absolute confidentiality shall be maintained, in accordance with Lokpal (Complaint) Rules, 2020. Moitra, in her plea before the HC, also referred to a tweet by a journalist who posted a screenshot of an email inbox where it was stated that 'the investigation report in Complaint No. 201/2023 has been submitted by CBI which is under consideration of Lokpal of India'. Justice Datta, orally remarked that 'there is no doubt that confidentiality has to be maintained'. 'I'll direct that confidentiality will be strictly maintained by all concerned as per rules,' he said. The Lokpal of India, in March 2024, ordered a formal investigation by the CBI into the bribe-for-questions complaint against the TMC MP. Moitra stands accused of sharing her Parliament login credentials with businessman Darshan Hiranandani, who allegedly posted questions on affairs related to industrialist Gautam Adani. It is alleged that Moitra did this for bribes, both in terms of cash and expensive gifts, received from Hirananadani. Moitra had denied the allegations. The CBI has already conducted a preliminary enquiry (precursor to an FIR) in the matter which came about on the direction of Lokpal on November 8, 2023.

1 2 Imphal: In a significant development emphasising the importance of safe and accessible road infrastructure, the High Court of Manipur has registered a public interest litigation (PIL) based on a suo motu cognisance initiated at the instance of the registrar general of the high court. The development comes after the Manipur State Legal Services Authority (MASLSA) submitted a detailed report to the registrar general of Manipur high court, revealing widespread and hazardous deterioration of road infrastructure across the state. Among other authorities, the PIL has named the chief secretary, principal secretary (PWD) of Manipur govt; the principal secretary/commissioner of rural development & panchayati raj; the chief engineer (PWD) of Manipur govt, and the chief engineer of Manipur State Rural Roads Development Agency (MSRRDA) as respondents. The division bench of Manipur high court, led by Chief Justice K Somasekhar and Justice A Guneshwar Sharma, issued notices to the respondents through the advocate general, Manipur, returnable by Sept 8. The court also directed submission of a list of all authorities or agencies responsible for the repairing or maintenance of roads, both in the valley and hill districts, so that other necessary parties may be impleaded in the PIL. NEW DELHI: In what could stir a fresh debate among SCs, STs and OBCs, Supreme Court on Monday agreed to examine an important issue - should benefit of quota in government employment and admissions to state-run institutions be first given to those members of quota-covered communities who continue to be the most socially and economically backward. SC had a word of caution - this is a sensitive issue requiring careful consideration. Singh said petitioners do not seek any change in quota percentage for scheduled communities. Justice Kant said many from SC, ST and OBC communities had advanced socially and economically by entering the elite categories of government employment through reservation and could provide best of education and facilities to their children. He said the time had probably come to consider whether such a class of people should continue to avail reservation at the cost of their own community members who are languishing in poverty and facing social issues. The task before the Justice Kant-led bench will not be insurmountable as a seven-judge bench judgment, authored by Justice B R Gavai, only the second member from the Dalit community to become CJI, had on Aug 1 last year permitted states to sub-categorise castes within SC communities based on degrees socio-economic backwardness and and under-representation in government jobs to ensure that the larger pie of 15% quota went to the most backward. The petitioners have argued, "Candidates from affluent SC, ST and OBC families often secure reserved jobs and seats. Individuals from extremely poor backgrounds and needy aspirants seldom get a chance to get a job or admission to government colleges despite the reservation policy. This defeats the purpose of social justice and perpetuates inequality within reserved categories. "By incorporating an economic threshold within reservations, the policy would align with the broader constitutional mandate of creating an egalitarian society. Furthermore, such reforms would prevent monopolisation of benefits by a privileged few, ensuring that affirmative action remains a dynamic and effective tool for socio-economic upliftment," they argued.
