States try to rein in health insurers' claim denials, with mixed results
Health insurance companies are under increasing scrutiny for allegedly using artificial intelligence bots and algorithms to swiftly deny patients routine or lifesaving care — without a human actually reviewing their claims.
The high-profile killing late last year of UnitedHealthcare CEO Brian Thompson has focused even more attention on so-called prior authorization, the process by which patients and doctors must ask health insurers to approve medical procedures or drugs before proceeding. There had been protests and outrage over the company's practices for months before Thompson's death, and UnitedHealthcare has been accused in a class-action lawsuit of using AI to wrongfully deny claims.
As more patients and doctors voice their frustrations, states are responding with legislation designed to regulate prior authorization and claims reviews. So far this year, lawmakers in more than a dozen states are considering measures that would, for example, limit the use of AI in reviewing claims; exclude certain prescription medications from prior authorization rules; ensure that emergency mental health care is not delayed for more than 48 hours; and require that insurers' review boards include licensed physicians, dentists or pharmacists with clinical experience.
Insurers have long required doctors to obtain their approval before they'll pay for certain drugs, treatments and procedures. They argue it is necessary to rein in health care costs and limit unnecessary services. But many doctors and patients say the practice has gotten out of hand, causing delays and denials of care that are harming and even killing people.
In a survey last year by the American Medical Association, 93% of doctors said that insurers' prior authorization practices delayed 'necessary care' for their patients. Twenty-nine percent said such delays had led to a 'serious adverse event,' such as hospitalization, permanent injury or death.
In 2023, insurers selling plans on the marketplaces created under the Affordable Care Act denied a combined average of 20% of all claims. Of the 73 million in-network claims they denied, only 1% were appealed, according to KFF, a health policy research group.
Under the Biden administration, the Federal Trade Commission and the Department of Justice took a firmer hand against health care corporations alleged to be engaging in behavior resulting in limited and more expensive care for patients. The administration also approved rules requiring that beginning in 2026, Medicare and Medicaid plans create a streamlined electronic process for reviewing claims, making decisions more quickly and providing specific reasons for denying care.
States want to make it harder for health insurers to deny care, but firms might evade enforcement
But it's difficult to hold insurers accountable, according to Timothy McBride, a health policy analyst and co-director of a program at the Institute for Public Health at Washington University in St. Louis.
'Each part of the health care industry — hospitals, pharmaceuticals, insurers — they all have a lot of concentrated power,' McBride said in a phone interview. 'And unless somebody actually takes it on directly, it's going to stay that way. I think the Biden administration tried to take it on, but didn't make a lot of progress.'
It's unclear whether the Trump administration and Congress will reverse course. During his confirmation hearing on March 14, Dr. Mehmet Oz, President Donald Trump's pick to lead the Centers for Medicare & Medicaid Services, defended the use of artificial intelligence in reviewing claims.
'AI can be used for good or for evil, and it to a large extent depends on who's using it and for what purpose,' Oz told members of the U.S. Senate Finance Committee. 'I think AI could play a vital role in accelerating preauthorization.'
In the past, Trump has supported measures to help patients, such as increasing hospital price transparency and lowering prescription drug prices, McBride noted. But 'Republicans and conservatives generally are anti-regulation,' he said. 'My gut feeling would be that they back off on the Biden push on this.'
States have limited power to act on their own. They have authority only over state-regulated health plans, which include Medicaid, plans for state workers and policies residents purchase from the ACA marketplaces. About 90 million people are covered that way. State laws do not apply to the 156 million workers, retirees and dependents who get their coverage through employer-sponsored health plans, which are regulated through a federal law known as ERISA.
Furthermore, health insurance companies are large and have deep pockets, allowing them to easily absorb state fines.
But Kaye Pestaina, the director of the program on patient and consumer protection at KFF, said states have an important role to play.
'Much of the focus around prior authorization at the federal level has kind of originated from state protections, so I imagine there will be continual activity by state legislatures to come at the problem,' Pestaina told Stateline.
Pestaina said states are trying a number of solutions. For example, states such as Arizona, Michigan and Pennsylvania have given their insurance regulators more authority to directly access claims denial information, in order to overturn decisions or potentially enforce state rules. And these efforts have largely had bipartisan support.

In Pennsylvania, Republican state Sen. Kristin Phillips-Hill pushed through bipartisan legislation in 2022 to streamline prior authorization practices for state-regulated health plans after hearing numerous complaints from patients and doctors.
The legislation created an Independent External Review organization that allows Pennsylvanians to submit an online form to request a review if their insurer denies a service or treatment. If the review organization decides the service should be covered, the insurer must do so. Before then, patients could turn only to a federal review process, which may have been more challenging to navigate and taken more time.
'Our reforms created clear rules, clear timelines for the prior authorization process, and it removed ambiguity or uncertainty from the system that at times, insurers could exploit and providers could be confused over,' Phillips-Hill told Stateline. 'Prior to that reform, if you had a denial from your insurer, you had very little recourse.'
The program began in January 2024, and in its first year the Pennsylvania Insurance Department overturned half of 517 denials, which amounted to claims from 259 people.
Jonathan Greer, president and CEO of the Insurance Federation of Pennsylvania, said his trade group worked with lawmakers to come to an agreement on how to change the prior authorization process in a way that worked for insurers and patient advocates. Greer says he thinks Pennsylvania could be a model for other states.
'Prior authorization, I think unfairly, has been characterized as a reason to say 'no' by insurers,' Greer said. 'The purpose of prior authorization is to make sure that you know the care that you get is consistent with the care that you need.'
In North Carolina, Republican state Rep. Timothy Reeder is hopeful that his prior authorization bill will make it across the finish line this year. Reeder's bill would set tight deadlines on insurers' claim decisions and require companies to have licensed practitioners on their claim review boards. Insurers would also have to publicize a list of services they require authorization for.
'I'm not saying that we need to get rid of it completely,' Reeder told Stateline. 'There is a role for some oversight to make sure that things are covered. But right now, I think the system is out of balance.'
But some state laws have proven to be less effective than advertised.
In 2021, Texas enacted a first-of-its-kind law creating a 'gold card' standard, under which physicians whose care recommendations are approved by insurers at least 90% of the time are exempt from the prior authorization process. But as of the end of 2023, only 3% of Texas physicians had earned gold card status, according to the Texas Medical Association.
That's why the group is pushing legislation that would require insurers to report which preauthorization exemptions they granted and denied and how many claims went to independent review. Dr. Zeke Silva of the Texas Medical Association's legislative council said it would be 'in the same spirit' as what Pennsylvania has done.
'Our focus with the [Texas Medical Association] is our physicians being able to provide the best care possible. And we want that to be free of burden,' Silva told Stateline. 'We want to minimize third parties coming in and inappropriately denying care that our physicians and our patients think is in their best interest.'

It offers the lowest cost for conventional deliveries without complications—just $7,500 compared to as much as $27,000 in more expensive states, according to WalletHub. The Peace Garden State was also found to have the third-lowest hourly rate for babysitters, and ranked among the top ten in childcare access and mom support groups. Minnesota came in third, offering the second-lowest health insurance premiums and ranking highly for medical staff availability. With one of the lowest maternal mortality rates and a high number of pediatric professionals per capita, WalletHub said it provides ample healthcare options for new parents. Additionally, the North Star State was found to have the fourth-highest share of nationally accredited childcare centers. Rounding out the top 10 best states to have a baby include: New Hampshire, Maine, Rhode Island, Vermont, Washington, Iowa, the District of Columbia. At the other end of the spectrum, West Virginia, Oklahoma, Florida, Arkansas, New Mexico, Georgia, South Carolina, Nevada, Alabama, and Mississippi were ranked as the bottom 10. After cancer diagnosis, out-of-pocket costs jump, study says
Out-of-pocket costs increased by an average of $592.53 per month in the six months after a cancer diagnosis, according to a recent study published in JAMA Network Open. The study analyzed a sample of over 46,000 patients from the Surveillance, Epidemiology and End Results (SEER) cancer registry, examining responses from 2008 to 2019. The sample consisted of both patients with and without cancer to provide a control group. Within the sample group, breast cancer was the most common form of cancer (74.1 percent), followed by colorectal (14.5 percent) and lung cancer (11.4 percent). On average, out-of-pocket costs rose by a cumulative total of $4,144.71. 'This difference, driven by the onset of cancer diagnosis and its associated treatment, underscores the financial burden of cancer care on patients with insurance who are not yet eligible for Medicare,' the authors write in the study. Cost also increased with stage of diagnosis. Patients with Stage 0 cancer saw an average increase of $462.01 per month, while Stage 4 patients' costs rose an average of $719.97 per month. The authors note that late-stage disease usually is associated with more treatment and higher medical expenditures. This study has implications for policy reform, the researchers argue. New Medicaid federal work requirements mean less leeway for states
When President Trump signed a law adding work requirements for some Medicaid recipients, he may have undercut lawmakers in at least 14 states who were designing their own plans, according to health industry observers. Georgia is the only state with a work requirement in place for Medicaid, but several states have been pursuing such a policy for years, only to be blocked by courts or, most recently, the Biden administration. Some seek state-specific touches to the new rules. Others aim to implement work requirements before the federal law takes effect at the end of 2026. These states' moves and Mr. Trump's massive tax-and-spending law share one demand: To keep their Medicaid health coverage, adults who can work must prove they're logging a minimum number of hours at a job or school, or else qualify for one of the few exemptions. But now, states that jumped ahead need to ensure their proposals, which require federal approval, don't stray too far from Mr. Trump's law. "The statute sets both the floor and ceiling" for work requirements, said Sara Rosenbaum, a health law and policy professor with George Washington University. South Dakota, for example, announced in July that it would not submit an application for work requirements as previously planned amid concerns that the state's laxer rules would not be allowed under the new federal law. The state's Department of Social Services secretary had warned that working on a state proposal while the federal rules are being hashed out could be "an exercise in futility." Arkansas' plan, on the other hand, is more stringent than the federal law. There are no exemptions to its work requirements in the application, which is pending with the Centers for Medicare & Medicaid Services. Arizona's proposal also includes something that's not in the federal law: a ban on "able-bodied adults" receiving Medicaid benefits for longer than five years total in their lives. Arkansas and Arizona government officials said they were working with federal officials to square their plans with the new standards. Andrew Nixon, a spokesperson for the U.S. Department of Health and Human Services, said the department is analyzing how the new federal standards interact with state waivers. The federal health department must release rules by next June that outline how states are to implement work requirements, according to Elizabeth Hinton, who has been tracking such waivers as part of the Program on Medicaid and the Uninsured at KFF, a health information nonprofit that includes KFF Health News. "We don't exactly know what that will cover," Hinton said. It's unclear how federal officials will respond to the states' requests, she added, but "we are aware that some folks think there is no wiggle room here." States can tweak their Medicaid programs through what are known as demonstration waivers, which are subject to federal approval. The waivers are designed to test new ideas in policy gray areas. The states that have filed or plan to file such applications with work requirements include Arizona, Arkansas, Georgia, Idaho, Indiana, Iowa, Kentucky, Montana, New Hampshire, North Carolina, Ohio, South Carolina, South Dakota, and Utah. Congressional Republicans who passed the budget reconciliation bill left room for states to use waivers to fast-track the national standards. Tara Sklar, a professor leading the University of Arizona's Health Law & Policy Program, said she expects states seeking certain stricter requirements to have a chance of approval, while more lenient ones may face denials. Federal officials may look favorably on Arizona's plan, Sklar said, as a five-year lifetime Medicaid limit is different from work requirements. Even if the federal government greenlights stricter work requirements than the federal law calls for, those programs are likely to face legal challenges, she added. The federal law includes an 80-hour-per-month minimum for work or education, with exemptions for certain adults, including people who are medically frail and parents with young, dependent children. Montana is the first state to draft a waiver application since Congress finalized national work requirements. State lawmakers first approved work requirements — called "community engagement" standards under the state plan — in 2019, but the state's application stalled through the end of the first Trump term and the Biden administration. After Mr. Trump was elected again, Montana lawmakers lifted the 2025 expiration date of its Medicaid expansion program, making permanent the program that covered more than 76,000 adults in April, with the expectation that the Trump administration would approve work requirements. In mid-July, state officials released their draft plan to make that a reality "as soon as is practicable." The Montana plan largely aligns with the federal law, but it would create additional exemptions, including for people who are homeless or fleeing domestic violence. Republican state Sen. Gayle Lammers said work requirements that also protect such people who need Medicaid were a big part of persuading legislators to keep the expansion program. At the time, officials didn't know where the federal government would land on work requirements. And now, Lammers said, it makes sense for Montana to stick to its plan. "The state should have a say," Lammers said. "We're very independent, and everyone is different." In South Carolina, state officials are seeking to roll out work requirements for a limited number of newly eligible Medicaid beneficiaries. South Carolina is one of 10 states that has not expanded Medicaid eligibility under the Affordable Care Act, and yet the state submitted a request with the federal government in June for a partial Medicaid expansion that includes a work requirement component that largely reflects the new federal standards. In a letter to Health and Human Services Secretary Robert F. Kennedy Jr., South Carolina Gov. Henry McMaster, a Republican, called South Carolina's proposal "a state-specific solution." The only state with an active work requirement program now wants to scale it back and awaits federal approval to do so. "Georgia Pathways to Coverage" expires at the end of September unless CMS greenlights an extension of the program with a key change: requiring enrollees to document once a year that they're working, not monthly. That's a pivot away from the program's initial design but also differs from the new federal rules, which call for checks every six months. Fiona Roberts, a spokesperson for Georgia's Medicaid agency, said the state is still waiting to hear whether it needs to alter its plan.
