Council had ‘entrenched mismanagement' of busway safety, court hears

A county council showed an 'entrenched mismanagement of safety' for its public transport system which was involved in the deaths of three people, a court has heard.
Jennifer Taylor, 81, Steven Moir, 50, and Kathleen Pitts, 52, all died in separate incidents with Cambridgeshire Guided Busway between 2015 and 2021, and a boy sustained life-changing injuries.
The busway, which involves a modified bus being guided along a track, is a 16-mile route which uses old rail routes to link Cambridge, Huntingdon and St Ives.
Cambridgeshire County Council, which runs the busway, was prosecuted by the Health and Safety Executive (HSE) last year in connection with the incidents.
It admitted two charges under Section 3 of the Health and Safety at Work Act 1974 last September, relating to the public trying to cross the busway at designated crossings and being struck while moving alongside the busway.
Prosecutor Pascal Bates told Cambridge Crown Court on Thursday the busway was involved in 'a number of very serious injuries', including to two children, between the summer of 2011 and spring 2023, but the council 'kept going despite numerous warning signs'.
'[There was] an unpreparedness properly to ask itself relevant safety questions,' Mr Bates said.
The council did not tell the HSE of the risks it identified with the system until 2022, six years after it conducted an initial assessment, the court heard.
Cambridgeshire Guided Busway opened in August 2011 and busways are still 'relatively new and rare concepts' in the UK, the prosecutor said.
The council proposed the creation of the busway and currently runs it, including organising maintenance and control of its infrastructure.
Mr Bates said the council 'never operated the busway fully in compliance with safety law' up to 2023, and that it felt any criticisms of its safety procedures were 'illegitimate'.
Until 2021, the buses travelled at a 'lane speed' of 56mph, meaning it would cover 25 metres a second.
Their routes pass through a variety of rural and urban areas and can often become extremely cramped and in very high demand, the court heard.
The buses are also silent, 'far more quiet' than a bus on tarmac, Mr Bates said.
The court heard a female passenger fractured her skull aboard one of the buses in October 2011, after the driver performed an emergency stop to avoid a cyclist.
Mr Bates said the incident was not reported to the HSE at the time, and HSE was not told about it until 2023.
'We say this should have been a wake-up call,' the prosecutor added.
The council then 'appeared to write off' three other incidents, in which cyclists were admitted to hospital, in 2012, 2013 and 2014, by suggesting the cyclists were to blame, Mr Bates said.
A number of road safety audits were conducted by the council but the quality of these was 'very bad', Mr Bates told the court.
In a statement last September, after the council pleaded guilty to the charges, Cambridgeshire County Council's chief executive Dr Stephen Moir said it was 'truly sorry' for having fallen 'far short' of the appropriate health and safety standards on the busway.
Family members of the three people who died attended the hearing, sitting in the public gallery.

The couple had been driving along a "blackcountry trail" which is known to be a "pretty rough" terrain. ‌ Speaking to PEOPLE, Kaslo Search and Rescue Communication Manager Mark Jennings-Bates said the couple "lost control" of their car and "rolled many, many times" downhill and she suffered "severe" head trauma. ‌ He added: "She didn't realize quite how injured she was." Stacey was taken from the crash by helicopter and placed in an ambulance that rushed her to a nearby hospital. But despite the best efforts from medics, she died following the serious nature of her injuries. Meanwhile, Matthew was propelled from the vehicle at the time of the crash and was found with "no vital signs", according to Mark Jennings-Bates. As yet, the official cause of death has not been confirmed but it has been alleged that the couple lost control of their car and fell down the mountain to their death. ‌ The rescue communications manager estimated that the engaged couple fell 656ft downhill. When speaking about the rescue mission, Mark Jennings-Bates continued that it was "challenging" due to an "uphill journey to get to them." ‌ He went on to say: "From what I understand, it's one of the few patches of the road that doesn't have a forest on the side. " He added: "So anywhere else, they would've been caught by the trees — they would've maybe gotten a bit hurt. But this is the one area where they were gonna go for a big ride if they did go off the side road." In a devastating social media post, Stacey's mother Colleen Tourout confirmed the couple's death. She penned that they died together "in the beautiful mountains of British Columbia that they loved so much." She went on to say: "Please keep us and them in your thoughts and prayers as we navigate this devastating end to an amazing Love Story."

A father has described the "petrifying" moment a rollercoaster his son was on derailed a the Coney Beach Pleasure Park on Wednesday evening. 13 children and an adult were treated for minor injuries after the ride derailed at the well-known Porthcawl amusement park. Others at the park said they heard "horrific screams" when it happened. Police said 14 people suffered injuries in the incident, with seven taken to hospital for treatment. The operators of the park said the incident involved a "third-party ride not owned by Coney Beach". One of the children on the ride was Isaac. His Dad, Sam Conibear, said he and the family had visited the theme park with some friends. He said: "It was supposed to be a nice day, and we got there, it was a lovely day, even though the sun went out. We planned to have a nice evening on the ride." According to eyewitnesses, just after 6pm part of the fairground's Wacky Worm ride came off the tracks. "It was loads of screaming - the kids were petrified", Sam said. Sophia, 11, was visiting the park with her friends and her parents. She said: "You just heard screaming. The rollercoaster went up and one of the children hit their face. "We'd just come off the ghost train, and we saw ambulances rushing in. You could hear screams, and you could see that they had hit their face[s]." Sam's friend, John-Paul Baylis, described hearing "horrific screams". His son, Ethan, was on the rollercoaster. "I ran over there as fast as I could," he said. "I jumped on the rollercoaster and got my son off. Something just came over me - I just got on there and brought injured kids down to other dads." Sam Coniber said: "I looked up and I saw Isaac screaming to get him off, and then my mate John flew onto the ride and he got everyone on it. "[He] had his nose pouring with blood; it was shocking. I was absolutely petrified, I was shaking in fear for him, and then I saw this track derailing. I thought he was gonna end up on the floor." Issac said: "I hit my face on the railing, and then, because of how hard it stopped. One of the railings bent up so it was like a really hard crash, and I hit my face on the bar." South Wales Police confirmed 13 children had been injured in the incident. Seven people were taken to the hospital by ambulance. Sam Coniber took his son to the hospital on Thursday morning. He said he was told Issac may have broken his nose in the crash. Eyewitnesses who had children on the ride said the incident has also taken an emotional toll. "[I'm] still shaken up. Yeah, I'm barely on no sleep, just keeping an eye on Isaac," said Sam. John-Paul added: "It was horrible what happened to the little kids, but it could've been a lot worse." The Health and Safety Executive said investigators have visited the site. In a statement, it said: "We are aware of this incident and are being supported by South Wales Police. Our inspectors are attending the site today to commence enquiries." In a statement, the operator of the park said: "Due to an incident on a third-party ride not owned by Coney Beach, we were instructed by the police to clear the site for further investigation. "We apologise for the disruption and will be providing refunds to affected guests as soon as possible. We will be releasing instructions on refunds shortly."

Police conclude investigation into death of Gogglebox's George Gilbey

The 40-year-old had been 'working on a roof when he fell through a plastic skylight, landing on the ground below' in Shoeburyness in Essex last year, a previous inquest hearing was told. Mr Gilbey, of Clacton-on-Sea, suffered traumatic injuries to his head and torso, and died on March 27 last year. Essex Police said on Wednesday that two men, who were arrested on suspicion of gross negligence manslaughter, will face no further action from the force. In a statement the force said: 'Essex Police have confirmed their investigation into the death of George Gilbey last year has concluded. 'Two men who were arrested and released under investigation in connection with the incident in Shoebury on March 27, 2024 will face no further action from Essex Police. 'The thoughts of everyone at Essex Police remain with George's family and friends. 'The criminal investigation remains open and will be led by the Health and Safety Executive.' HSE inspector Natalie Prince said: 'We have been a part of this inquiry from the outset and we will continue to thoroughly investigate George's tragic death as the lead agency. 'This will aim to establish if there have been any breaches of health and safety law. 'We are in regular contact with George's family and our thoughts remain with them at this time.' Mr Gilbey was best known for appearing on the Channel 4 series Gogglebox – where participants watch and comment on TV shows from the previous week. The reality star also appeared on the 14th series of Celebrity Big Brother in 2014, reaching the final.
