Two teenagers sentenced for roles in rape of girl at Limerick Racecourse

Two boys who raped a teenage girl in a car at Limerick Racecourse when they were aged just 13 and 15 years old have each been sentenced to six years in detention.
A third defendant (now 18) who was found guilty of aiding and abetting the rapes by moving the car in which it occurred was jailed for three and a half years.

The daytime attack against the girl involved humiliation and degradation and was committed by offenders of a very young age, the Central Criminal Court heard.
The teenage rapists and their families do not accept the verdicts of the jury and there was a heavy garda presence in court for sentencing on Thursday.
Mr Justice Paul McDermott said that had the boys – who are all cousins - been adults at the time of the offending, the headline sentence for the rape offences would have been in the range of 15 years to life imprisonment.
'This was a 16-year-old intoxicated girl in a vulnerable situation subjected to rape and sexual assault,' he said. 'She was raped one after the other by (the two boys) and in the course of these rapes, she was sexually assaulted.'

The girl was repeatedly saying no during the assaults. Further indignity and humiliation was heaped upon her by video footage being taken of the incident, the judge said.
Lack of remorse
Handing down sentence, Mr Justice McDermott noted there was very little to be said in mitigation for the boys, as they have not expressed remorse or any understanding of the harm caused to the complainant.
They must be sentenced as juveniles under the Children Act, in which detention is a last resort, the court heard.
The judge accepted the third defendant, who aided and abetted the rapes, has taken some responsibility for his involvement but struggles to understand it.

He noted they have no previous convictions and have been subject to some childhood trauma, with mental health difficulties in their families.
They had a lack of understanding in the areas of sexual relations and consent, the court heard.
Mr Justice McDermott sentenced the two rapists to a sentence of seven and a half years of detention, with the final 18 months suspended on a number of conditions, including that they engage in sexual offending programmes and have no contact whatsoever with the complainant.
The judge noted this means that part of their sentence will be served in prison.

He sentenced the third defendant to five years in jail as he is now over the age of 18 years. He suspended the final 18 months of this sentence on the same conditions.
The three boys stood trial at the Central Criminal Court sitting in Cork earlier this year, with two of the boys (now aged 16 and 17) found guilty of sexually assaulting and raping the then 16-year-old girl in a car at the racecourse on December 26th 2022. They were 13 and 15 years old at the time.
The third boy (now 18) was found guilty by the jury of four counts of aiding and abetting the rapes and sexual assaults following the six-week trial. The court heard he moved the car during the course of the attack. He was aged 15 at the time. He was acquitted of one count of false imprisonment.
Video clips were taken of the incident by one of the boys, including one clip of the girl walking away from the car after she had been raped.

When she found her friends, she was extremely upset and immediately told them what had happened to her, the court heard.
The boys denied raping the girl, telling gardaí differing versions of events including one who said he was in Dublin on the day in question. They all eventually claimed it was a consensual encounter.
Detective Garda Lisa O'Regan told Dean Kelly SC, prosecuting, that the girl was socialising with her friends at the racecourse on the day in question.
She was, in her own words, 'really drunk' when she got chatting to the three boys, Mr Kelly said.
The court heard she agreed to go for a walk with one of the boys because she wanted to kiss him. Instead, she found herself in a car belonging to one of the boy's fathers where she was sexually assaulted and raped by two of them.
The third boy moved the car at one point during the attack.
The girl said she told the boys 'No' repeatedly and that she was on her period and had a tampon in. She said she told them she needed to go back to her friends, but they repeatedly said no and that she was 'fine'.
When medically examined later that evening, she was found to have extensive bleeding and bruising. She was a virgin prior to the attack.
The complainant (now aged 18) was not in court for the sentence hearing in Dublin.
In a victim statement read out on her behalf by counsel, she described her fear and anxiety in the aftermath of the attack, during which she was 'begging them to get off me'.

'At the age of 16, I had my innocence stripped away from me,' she said. 'These two (boys) took what they wanted with no regrets.'
She said her parents had to hear every 'vulgar' and 'gruesome' detail of what happened to her and that she will 'forever have guilt on my shoulders - not just for how it affected me, but everyone around me'.
'They not only took away the rest of my childhood, they took away the rest of my life,' she said. 'At the age of 16, I was raped. This is always something I will have to carry around.
'But what I can do is live with the fact that I told the truth.'
The court heard the boys, who are all cousins, have no previous convictions. They are all in detention or custody since the guilty verdicts were handed down last April.
The case was previously adjourned for a number of weeks for preparation of probation reports.
Cathal McGreal, BL, defending the youngest of the three boys, said his client was then aged 13 and had no previous convictions.
He said that a report before the court described him as mild-mannered, introverted and vulnerable from a mental health point of view.
Counsel said his client made admissions and described him as 'not a particularly mature 13-year-old, and this was his first sexual experience'. The court heard that the boy's father and his family do not accept the verdict.
Mr McGreal said his client wants to pursue his Junior Certificate and is interested in becoming a mechanic or a builder. He is against drugs and alcohol and wants to marry his girlfriend.
Vincent Heneghan SC, defending the then 15-year-old boy, said his client comes from a 'good supportive family' and they are concerned for him. He stated that his client does not accept the jury's verdict and that this will limit any potential mitigation.
Counsel said his client presents as intermittently distressed since going into custody and is not sleeping well. He said he is engaging in education and sport while in Oberstown.

Mr Henaghan said the defendant has no issues with drugs or alcohol and outlined that there was no pre-planning to this offending. He asked the court to consider the reports that were before the court on behalf of his client and requested that the court be as lenient as possible.
Donal Cronin BL, defending the third boy, said his sexual knowledge at the time was limited. He outlined that his client has no issues with drink or drugs and that sport has formed a major part of his life.
Mr Cronin asked the court to fashion a sentence that would mark the wrongdoing but also include rehabilitation. He asked the court to consider the mitigating factors, including his client's culpability, his involvement and the fact he was a child at the time.

A Post Office boss who backed compensation for Horizon IT scandal victims has left his position as Sir Alan Bates raised 'serious concerns' about schemes. Leader of the Post Office's Remediation Unit, Simon Recaldin, is believed to have opted for voluntary redundancy and left his post this week. It comes as the first part of a public inquiry report into the controversy, analysing the compensation process as well as the affect on victims, is anticipated to be released in the coming weeks. More than 900 sub-postmasters were prosecuted between 1999 and 2015 after faulty accounting software made it look as though money was missing from their accounts. Hundreds are still waiting for payouts despite the previous government announcing that those who have had convictions quashed are eligible for £600,000. A Post Office spokesperson said yesterday Mr Recaldin's departure was a part of an 'organisational design exercise' across the firm. Now Joanne Hanley, who was previously a managing director and global head of client servicing, data and operations for Lloyds', is understood to have taken up a large portion of the former Post Office chief, according to The Telegraph. It comes as Post Office hero Sir Alan Bates accused the government of running a 'quasi kangaroo court' payout system for the scandal's victims last month. More recently, Sir Alan said he would prefer to see the compensation schemes thrown out rather the people working on them. 'We have got serious concerns about the transparency and the parity across the schemes,' he told The Telegraph. Last November, Mr Recaldin giving evidence to the inquiry, apologised after it was unearthed staff who were managing compensation claims had also been embroiled in prosecutions relating to the scandal. When queried about ex Post Office investigators he said: 'So my regret – and it is a genuine regret – is that when I came in, in January 2022, that I didn't do that conflicts check, check back on my inherited team, and challenge that.' It comes as the Sir Alan, who famously won his High Court battle with the Post Office in 2019 revealed that he had been handed a 'take it or leave it' compensation offer of less than half his original claim. Mr Bates, 70, said the first offer, made in January last year, was just one sixth of what he was asking for, adding that it rose to a third in the second offer. He has now been given a 'final take it or leave it offer' - which he said amounts to 49.2 per cent of his original claim. He, alongside 500 other sub-postmasters, will now have to lodge their bid for compensation via the Group Litigation order, managed by the Government. Bates, who led the sub-postmasters' campaign for justice, attacked the government for reneging on assurances given when the compensation schemes were set up The Post Office currently manages the Horizon Shortfall Scheme, which is seperate to the aforementioned. This scheme was organised for victims who have not been compensated but believe they experienced financial loses due to the IT scandal. A Post Office spokesman said: 'As part of the Post Office's commitment to deliver a 'new deal for postmasters', we have undertaken a review of our operating model to ensure we have the right structure in place. 'We have been in consultation with a number of colleagues from across the business, including the Remediation Unit. As a result of this Post Office-wide organisational design exercise, Simon Recaldin has left the business.'

The parents of a Florida teen are suing LA Fitness for negligence after their daughter was allegedly sexually assaulted by one of their gym members. Sean Brophy and Yanira Pohlmann filed civil suits last week in Miami-Dade County against both the gym's parent company, Fitness International, and the alleged perpetrator Richard Bosch. According to the complaint, 'Bosch committed an intentional assault, battery, sexual assault and offensive conduct on [the teen] without consent.' The young girl, now 16, only identified as K.B. in the complaint, went to the gym with a group of friends May 2023. Another gym member, identified as 22-year-old Richard Bosch, preyed on the teen by asking her inappropriate questions before he followed her into a workout area and molested her, according to the complaint. The terrified teen said she was able to break free from her attacker and run out of the gym. The panicked young woman immediately called her father who called police before retrieving her. Police arrived at the gym and arrested Bosch, now 24. He was charged with lewd and lascivious molestation on a child 12 to 16 years old. Through a plea deal Bosch pleaded guilty to felony battery and was placed on a four-year probation. In February, he violated the probation and was arrested for criminal mischief, as per NBC6 South Florida. Family attorney Evan Robinson of Leesfield & Partners told Daily Mail that the case shows a 'gross violation of basic safety standards.' 'What makes this case particularly egregious is this disturbing incident was entirely foreseeable,' the attorney said. 'LA Fitness knew that this assailant was a dangerous individual with violent propensities.' The attorney claimed Bosch was acting belligerent at the gym weeks before the attack when he was allegedly 'screaming at the top of his lungs challenging someone to fight him.' Also, Bosch had 'previously received a warning by the gym for similar conduct,' Robinson stated. 'All LA Fitness needed to do to from having this sickening assault from happening was to revoke this guy's membership,' Robinson said. 'But instead they didn't do anything to restrict his access to the gym and did not closely monitor the guy when he was at the gym. The complaint alleges that K.B. has suffered lasting psychological trauma from the experience and was required to undergoe extensive psychiatric treatment. Her family is seeking damages in excess of $5,000,000. Jonathan M. Midwall, one of the lawyers representing Fitness International, told Daily Mail on Friday that 'Fitness does not comment on pending litigation as a matter of policy.' The ugly incident began on May 30, 2023, when the victims father dropped his daughter off at the gym to work out with a few of her friends at around 8pm. The young girl's friends informed her that a man, who was later identified as Richard Bosch, was staring at her and asked her friends how old she was. Uncomfortable by what was taking place the teen walked into a boxing area to continue exercising. Bosch followed her into the isolated room - that reportedly had no working security cameras. He asked her how old she was and when she told him she was 14, he told her that he was 20-years-old when his true age was 22. He then proceeded to ask her inappropriate and disturbing questions such as, 'if she was a virgin?' If she 'had ever tapped out during sex?' and 'whether she had ever been with an older man?' according to the complaint. The panicked young girl tried to move away from Bosch but 'he cornered her and groped her genital area and buttocks,' as per the suit. Bosch proceeded to lift up his shirt and pull down his pants just above his pubic area to show the youngster that he had an erection, the suit alleges. The victim yelled out 'what are you doing?' as Bosch pleaded 'you're so tiny, you're so cute!' the suit states. According to the complaint, Bosch did not respond to her pleas and continued to 'grope her, pin her up on the wall, and proceeded to grab her by her inner thighs, near her genital area.' The victim ran into the next room where Bosch continued to physically corner her and assault her before she was able to run into the women's locker room to safety as Bosch stood outside of the locker room screaming her name, as per the suit. Surveillance footage captured from LA Fitness shows the young girl, dressed in a black hoodie and black bicycle shorts, walking quickly from the locker to the exit of the gym. Video shows Bosch reportedly grabbing her arm to prevent her from leaving before she yells out 'Leave me alone!' as many other gym goers look on, the court documents show. After the incident many witnesses provided statements to police. Robinson shared some of the statement with Daily Mail with one gym member claiming that 'Bosch was always around younger kids 14, 15 and 16 year-olds.' Another witness told police that he once saw Bosch 'corner' another young girl. While another member said that he was 'weird' and that he made his 'girlfriend feel uncomfortable.' Fitness International, LLC operates under the brand names LA Fitness, Esporta Fitness, City Sports Club, and Club Studio and has more than 700 locations across 27 U.S. states and Canada. In July 2024, the company acquired XSports Fitness 35 locations and expanding into the New York, Chicago and Virginia markets.

The head of the German force leading the fresh searches for Madeleine McCann told a friend who wished him luck: 'Thanks, we need it.' Rainer Grimm, boss of the BKA, Germany 's equivalent of the FBI, is in Portugal overseeing the search which ended yesterday. His apparent lack of confidence in the operation to his pal echoed what many have seen as the 'last throw of the dice' for investigators looking to solve the 18-year riddle. But sources close to the investigation said that 'only animal bones and bits of old adult clothing' have been found in the estimated £300,000 operation. One officer told MailOnline: 'We always knew it was going to be a waste of time but we have to show cooperation. 'What did they expect to find after 18 years? We were happy to work with them but we knew it would be a waste of time.' He was sensationally named by German authorities in June 2020 as the man responsible for Madeleine's abduction and murder, but he has not been charged – and the sands of time are running out. Brueckner, who has vehemently denied the allegations, is currently serving a seven-year sentence for a separate rape case and is due for release in September and has already vowed to leave Germany. As a result, it means prosecutors will have trouble bringing him to court should they charge him in connection with Madeleine's disappearance. His earliest possible release date is September 17 however that is unlikely as he will have to pay 1500 euro in outstanding fines from a series of motor offences to do so. But his legal team say he is broke and so a release date of January 6 looks more likely. Brueckner's lawyer Philipp Marquort told MailOnline:'I haven't had a chance to speak with him yet about the searches and I am not going to comment on what has been happening in Portugal. 'What I will say is that I don't think he will be coming out in September as he doesn't have any money to pay the fines because it went on his legal fees, so I can't see him leaving prison until early next year. 'He will probably see the news on the TV in his cell and he will talk about it when he calls me next time but I still do think when he is freed he will leave Germany.' Last October he was cleared of a series of unrelated sex attacks that took place in the Algarve between 2000 and 2017. Two years ago police also searched a dam close by for evidence but after a week-long operation nothing was found. Brueckner continues to deny any involvement with Madeleine's disappearance. Details of Mr Grimm's downbeat message came as the operation at Atalaia near Praia da Luz was brought to a close after three days. Permission had been given to search the derelict outbuildings on the scrubland close to where Brueckner used to live and where he previously to park his campervan until Friday Meanwhile locals expressed exasperation at the eyes of the world once again being on Praia da Luz with one business owner telling MailOnline: 'What on earth do they expect to find after 18 years ? 'It's been such a long time, of course everyone sympathies with the parents but it's gone on for too long now and to be honest no one here is convinced this German guy did it.' The German police team will fly back on a military plane due to pick them up today and which will also carry two vans brought with them. German officials said they would update the media on Friday or Monday if they had anything significant to say but the feeling was one of disappointment.
