Prosecution Plans To Use 911 Call From Alleged Diddy Burglary In Los Angeles During Trial
Diddy is a few weeks away from his trial for racketeering conspiracy, sex trafficking, and more alleged crimes, and another piece of the prosecution's strategy has been revealed online. They plan to use the audio from a 2011 phone call to 911 detailing how the 55-year-old artist allegedly broke into one of his victims' homes in Los Angeles.
'Because this call was made shortly after discovering the break-in… Individual 2's statements are nevertheless admissible because they were made close in time to when he observed the break-in at his home,' AllHipHop reported via Acting U.S. Attorney Matthew Podolsky. Per the prosecution, the phone call conveys the alleged victim's mental state and point to the Bad Boy co-founder running a full criminal operation.
The government also plans to have the controversial mogul's former employees testify against him, as well as introduce text messages and phone recordings as evidence of his misconduct. The prosecution believes this will prove that his former employees were forced to work for him and aid his criminal enterprise.
'At trial, the Government anticipates introducing multiple statements made by the defendant's employees,' Matthew Podolsky added. 'Those statements will be offered as exhibits (including text messages sent by the defendant's employees and recordings of the defendant's employees), as well as through the testimony of witnesses. These statements cover a variety of different topics, but they all center around the employees' core job responsibilities of serving the defendant.'
Another element of the prosecution's strategy is requesting that the court restrict Diddy from using prior statements until they meet specific legal exceptions. Their hope is the defense cannot use anything that will alter how his character is viewed, or suggest that the charges against him are related to anything political or retaliatory.
Diddy's trial will begin on May 5, adding a new chapter to a long and difficult journey for both the rapper and his alleged victims. His ex-girlfriend, Cassie, will take the stand and will testify using her real name, as opposed to testifying anonymously. She has been a key aspect of this entire ordeal as she filed the first rape lawsuit against the 'Last Night' artist in November 2023, and footage surfaced of him assaulting her in 2016 last May.

Sean "Diddy" Combs defense team filed another request for a mistrial on Saturday, arguing to the federal judge overseeing his ongoing racketeering trial that prosecutors hid the fact that witnesses lied on the stand. The letter cites testimony from Combs' ex-girlfriend that describes an incident during which the rapper allegedly dangled fashion designer Bryana Bongolan from the 17th floor balcony of Cassie Ventura's apartment in September 2016, which his attorneys say is another instance in his trial where "the government has presented testimony that it knew or should have known was materially false." Ventura, his lawyers argue, did not witness the Bongolan's violent encounter at her Los Angeles home, despite testifying: 'I saw him bring her back over the railing of the balcony and then throw her onto the patio furniture.' In fact, Combs' defense attorneys say, Ventura discussed hearing about the encounter, not witnessing it, in a text the singer sent to Kristina Khorram, who worked for Combs. "Hey I just found out some crazy shit," his lawyers say the text Ventura wrote to Khorram read. "I'm just finding out right now." "Nonetheless, they allowed Ms. Ventura to continue to insist on cross she had witnessed this incident," Alexandra A.E. Shapiro wrote to Arun Subramanian, the U.S. District Court Judge for the Southern District of New York, who is on the bench for Combs's trial. She continued that the incident could prejudice the jury because the terrifying recall of the patio scene, Shapiro wrote, "is disturbing and powerful evidence, and the government has used it to depict Mr. Combs in an extremely negative light, as an angry and dangerous man who terrified Ms. Ventura and her friends." Combs' defense pointed to Bongolan's "enormous financial motive to lie," citing a $10 million civil suit in Los Angeles Superior Court that claims damages from the injuries she said she sustained during the balcony dangle. Shapiro also pointed to the dates that the fashion designer and Ventura testified to for the balcony incident, which they say took place when his defense says they can prove he was staying at the Trump Hotel in New York City to perform at a concert billed as Puff Daddy's Bad Boy reunion tour in Newark, New Jersey. It is the second mistrial request in as many weeks. In late May, the judge immediately rejected a defense request for a mistrial that cited what they call prosecutors' attempt to imply that the music mogul interfered with the Los Angeles Police Department's investigation into rapper Kid Cudi's firebombed Porsche in 2012. "It bears emphasis that the use of the perjured testimony regarding the balcony incident is just one example of prosecutorial misconduct during this trial," Shapiro wrote. She reminded the judge that he had denied her argument that prosecutors had engaged in an "improper line of questioning related to the 2012 destruction of fingerprints," by the LAPD. Mistrial requests are common during labyrinthine federal trials involving hundreds of pieces of discovery and evidence explained by dozens of witnesses. Testimony in the case resumes Monday.
