Plea in Uttarakhand HC challenges 2025 amendment to Doon Valley Notification: ‘Destroys very essence'
A Division Bench of Chief Justice G Narender and Justice Alok Mahra Friday sought the government counsel to secure instructions on the same.
The petition, amended to incorporate a prayer to quash the gazette notification, filed by Congress leader Abhinav Thapar, claimed that the new amendment to the Doon Valley notification, 1989, which was notified on May 13, fails the original motive of the notification. The 1989 Doon Valley Notification, a significant instrument which classified industries based on pollution levels under green, red, and orange categories, and prohibited mining, change in land use, and grazing without the MoEF&CC nod in Doon valley.
The May amendment has given the state government the authority to approve tourism plan, grazing plan, master plan of development, land use plan, and any other plan, including zonal master plans. It also makes the orange category industries not covered under the Environment Impact Assessment Notification, 2006, to be considered by the Uttarakhand State Pollution Control Board. The amendment also makes orange category industries, which are now in the red category, continue, and expansion of such orange category industries falling in the schedule of the EIA notification to be allowed under conditions.
According to the petition, the amendment does not take into account the ecological sensitivity of the Doon Valley. 'It allows all the industries to work in the area whether it was originally there in the notification of 1989 or not, destroying the very essence of the notification…by this notification, all the industries which now fall under red category are allowed to operate, which fails the original motive of the notification of 1989,' it says.

This will be Gandhi's second yatra in as many years after he took out Phase 2 of the Bharat Jodo Yatra in February 2024, which saw the Congress revive its organisation, and in some parts of the country, and also translated in some electoral gains during last year's general elections. Among other planned events, the party will take out rallies with the theme 'Vote Thief-Leave the Throne' in all state headquarters from August 22 to September 7. From September 15 to October 15, a 'signature campaign' will be conducted across the country to protect the right to vote. On August 7, Gandhi produced data of alleged dubious voters in Mahadevapura segment of Bangalore (Central) Lok Sabha constituency and claimed that 1,00,250 lakh 'stolen' votes helped the Bharatiya Janata Party (BJP) win the seat in 2024, as the Wayanad MP accused the ECI of 'colluding' with the BJP. Gandhi claimed that in Mahadevapura, there were 11,965 duplicate voters, 40,009 voters with fake and invalid addresses, 10,452 bulk voters who had a single address and 4,132 voters with invalid photos.

HYDERABAD: BRS working president KT Rama Rao on Wednesday described the Supreme Court order on nomination of two MLCs as 'a slap in the face of both the Congress and the BJP'. The apex court issued an order modifying its earlier interim directive on the nomination of Prof M Kodandaram Reddy and Amer Ali Khan to the state Legislative Council under the Governor's quota. In a press statement, Rama Rao said that the Supreme Court declaring invalid the appointments of Kodandaram and Amer Ali as MLCs under the Governor's quota by the state government was a slap in the face for both the BJP and the Congress. He claimed the two Delhi-based parties have been misusing the Constitutional institutions and making a mockery of democracy. Rama Rao criticised the then Governor for ignoring the recommendation of the previous democratically elected BRS government to nominate Dasoju Sravan and Satyanarayana to the State Legislative Council. He alleged that the Modi government at the Centre had used the Governor's office as a tool to trouble the KCR government. He further accused Chief Minister A Revanth Reddy of exposing his anti-BC stance by recommending two other names while the proposals from his own government were still pending. Rama Rao, however, said that the Supreme Court's order made it clear that the actions of both the BJP and the Congress were unconstitutional.

Give proof, don't use dirty phrases like 'vote chori': EC on Rahul's allegations
NEW DELHI: Amid relentless attacks by Congress leader Rahul Gandhi over alleged voter data fudging, the Election Commission on Thursday said instead of creating false narrative by using "dirty phrases" like 'vote chori', proof should be given. In a statement, the EC said the law for "one person one vote" is already been in existence since the first elections in 1951-1952. "If anyone has any proof of any person actually voting twice in any election, it should be shared with ECI with a written affidavit rather than colouring all the electors of India as 'chor' without any proof," it said. The poll authority said that by trying to create a false narrative by using "dirty phrases" like "vote chori" for Indian electors, is not only a direct attack on the crores of Indian electors but also an assault on the integrity of lakhs of election staff. Gandhi, the Leader of the Opposition in Lok Sabha, last week cited data to allege that more than one lakh votes were 'stolen' in the Mahadevpura assembly constituency of Bengaluru Central Lok Sabha in the 2024 elections, resulting in the defeat of a Congress candidate. The Election Commission had directed Gandhi to give a written declaration on his claims.
