Taiwan detains TSMC staff for alleged theft of key technology trade secrets

Taiwanese authorities have detained three current and former employees of the world's largest chip manufacturer, Taiwan Semiconductor Manufacturing Company (TSMC), for allegedly stealing trade secrets, prosecutors said Tuesday.
Law enforcement officers questioned several suspects and witnesses late last month; searched their homes and detained three of them over 'serious suspicions of violating national security laws,' the intellectual property branch of the Taiwan High Prosecutors Office said on Tuesday.
TSMC produces more than 90% of the world's advanced semiconductor chips that power everything from smartphones and artificial intelligence (AI) applications to weapons, with key clients including the likes of Apple and Nvidia.
The major Taiwanese exporter raised suspicions that its 'core technologies' may have been illegally accessed by former and current staffers with authorities after an internal investigation.
The prosecutor's office said it will probe the motives behind the alleged theft of trade secrets and whether TSMC's proprietary information had been leaked to other parties, in the first case of its kind since Taiwan tightened its national security law to protect its key technologies in 2022.
Nikkei Asia first reported on Tuesday that TSMC had fired staffers suspected of illegally obtaining business secrets related to the manufacturing technology for the company's 2-nanometer chip, the most advanced processor in the semiconductor industry that is expected to go into mass production this year.
Super-advanced semiconductor chips are difficult to make because of the high cost of development and the level of knowledge required, meaning much of the production is concentrated in just a handful of suppliers, such as TSMC, Intel, Samsung and Rapidus.
TSMC said it discovered the potential trade secret leak after unauthorized activities were detected during routine monitoring.
'TSMC has taken strict disciplinary actions against the personnel involved and has initiated legal proceedings,' the company said in a statement. 'Such violations are dealt with strictly and pursued to the fullest extent of the law.'
Taiwanese local media reported that a former TSMC employee now works at top chip manufacturing equipment supplier Tokyo Electron Ltd., and that the Japanese firm's Taiwan office was raided by investigators.
Tokyo Electron's Taiwan office told CNN it has no comment.
A breach of TSMC's key trade secrets, if proven true, could have national security implications for Taiwan, as it could narrow the technological lead the company has over its competitors in advanced chip manufacturing.
TSMC's technological prowess is what fuels the commonly held belief in Taiwan that the island's global dependence on its semiconductors serves as a 'silicon shield' – a deterrent against a potential Chinese invasion, and a leverage in global diplomacy.
The tightened legislation, which raised penalties for theft of core technologies and banned the use of them in foreign countries, came after years of incidents of Chinese companies obtaining chip manufacturing knowhow by poaching Taiwanese engineers.

Estée Lauder Companies, Inc. (NYSE:EL) shares plummeted in the premarket session on Wednesday after the company reported fourth-quarter results. The company reported adjusted earnings per share of 9 cents, which is in line with the street view. Quarterly sales of $3.41 billion (down 12% year over year) outpaced the analyst consensus estimate of $3.397 care sales slumped 16% year over year, makeup fell 11%, fragrance grew 4%, and hair care decreased 15% on a reported basis in the quarter. In mainland China, the company gained prestige beauty share across all categories and channels in the fourth quarter, led by La Mer and TOM FORD, with full-year gains also driven by La Mer and Le Labo. In Japan, it captured share in every quarter of fiscal year 2025 and reinforced its #1 fragrance ranking in the fourth quarter through Le Labo, Jo Malone London, and KILIAN PARIS. In the U.S., share trends improved notably in the second half of fiscal year 2025, led by The Ordinary, Clinique, and Estée Lauder, though the fourth quarter saw a modest loss. Gross profit in the quarter under review fell 12% to $2.456 billion. Gross margin expanded to 72% from 71.8% in the year-ago period. Quarterly adjusted operating income slumped 61% year over year to $137 million. Outlook Based on current information and net of planned mitigation actions, Estée Laude expects tariff-related headwinds to impact fiscal 2026 profitability by approximately $100 million. 'Despite continued volatility in the external environment, we embarked on fiscal 2026 with signs of momentum and confidence in our outlook to deliver organic sales growth this year after three years of declines and to begin rebuilding operating profitability in pursuit of a solid double-digit adjusted operating margin over the next few years,' said CEO Stéphane de La Faverie. The company has provided its financial outlook for fiscal year 2026, projecting EPS to range between $1.90 and $2.10, well above the analyst consensus estimate of $1.48. The company expects sales to reach between $14.613 billion and $15.042 billion, surpassing the analyst forecast of $14.321 billion. In its fiscal 2026 guidance, Estée Lauder has reflected several key assumptions. The company anticipates global prestige beauty growth to fall between 2% and 3%. Additionally, Estée Lauder plans to implement stricter inventory controls and a substantial reduction in discounts to better align retail and net sales growth. In terms of regional performance, Estée Lauder is forecasting mid-single-digit growth in mainland China, signaling early signs of market stabilization. The company also expects a modest recovery in its global travel retail business, particularly in the first half of fiscal 2026, driven by improved shipment levels in Asia travel retail. However, the company cautions that volatility in this sector, including weak conversion rates, could temper overall performance. Excluding mainland China, Estée Lauder is projecting low-single-digit growth in most other markets, with year-over-year growth rates improving compared to fiscal 2025. For the first quarter of fiscal 2026, the company expects a low-single-digit decline to slightly positive growth, driven by strong results in global travel retail and solid performance in mainland China. Mr. Tao Zou, Chief Executive Officer of Kingsoft Cloud, commented, "We resume our growth momentum this quarter, with total revenue increased by 24.2% year-over-year to achieve RMB2,349.2 million. AI is still a dominant driver for our revenue growth and this quarter our gross billing of AI business increased by over 120% year-over-year to RMB728.7 million, accounting for 44.8% of our public cloud services. As AI technology enabler, we provide turnkey solutions to customers from computing resources, PaaS platforms to applications. Meanwhile, we have maintained our healthy cooperation with Xiaomi – Kingsoft Ecosystem, evidenced by a 69.5% year-over-year revenue growth to reach RMB628.9 million from ecosystem customers this quarter and reach RMB1,125.0 million in the first half, representing a 40% completion of the continued connected transaction cap amount in the first half of 2025. Among this, our revenue from public cloud services increased significantly by 31.7% year-over-year to RMB1,625.3 million. Our adjusted gross profit was RMB350.6 million, which increased by 8.4% year-over-year and 7.0% quarter-over-quarter. Adjusted gross margin was 14.9% in this quarter, compared with 17.1% in the second quarter 2024 and 16.6% in the first quarter this year. The decrease was primarily due to the higher cost of servers along with the expansion of our AI business, and the upfront costs incurred for certain customers for its future revenue activity. Our adjusted EBITDA profit achieved RMB406.0 million, increased by 570.1% year-over-year. Our adjusted EBITDA margin of 17.3%, increased by 14.1 percentage points, demonstrating our optimized revenue structure and a strong costs and expenses control. Second Quarter 2025 Financial Results Total Revenues reached RMB2,349.2 million (US$327.91 million), increased by 24.2% year-over-year from RMB1,891.8 million in the same quarter of 2024 and increased by 19.3% quarter-over-quarter from RMB1,970.0 million in the first quarter of 2025. The increase was mainly due to the expanded revenue from AI related customers, with AI infrastructure and products keep upgrading. Revenues from public cloud services were RMB1,625.3 million (US$226.9 million), increased by 31.7% from RMB1,234.5 million in the same quarter of 2024 and increased by 20.1% from RMB1,353.5 million last quarter. The year-over-year increase was mainly due to the growth of AI demands, as the AI gross billing reached RMB728.7 million (US$101.7 million), and partially offset by our proactive decrease of CDN services. Revenues from enterprise cloud services were RMB723.9 million (US$101.0 million), representing an increase of 10.1% from RMB657.2 million in the same quarter of 2024 and an increase of 17.4% from RMB616.5 million last quarter. The increase was mainly due to the expanding demands for software IT services of our customers and the accelerated completion of project delivery in this quarter. Other revenues were nil this quarter. Cost of revenues was RMB2,010.4 million (US$280.6 million), representing an increase of 27.8% from RMB1,573.4 million in the same quarter of 2024, which was mainly due to our investment into AI computing resources. IDC costs increased by 10.3% year-over-year from RMB728.2 million to RMB803.1 million (US$112.1 million) this quarter. It was mainly due to the increasing demands for infrastructure, which was in line with our AI business expansion, as well as the basic computing and storage cloud demands brought by AI business. Depreciation and amortization costs increased from RMB265.9 million in the same quarter of 2024 to RMB552.0 million (US$77.1 million) this quarter. The increase was mainly due to the depreciation of newly acquired and leased servers which were allocated to AI business. Solution development and services costs increased by 14.8% year-over-year from RMB491.1 million in the same quarter of 2024 to RMB563.7 million (US$78.7 million) this quarter. The increase was mainly due to the solution personnel expansion of solution architecture and delivery. Fulfillment costs and other costs were RMB25.8 million (US$3.6 million) and RMB65.8 million (US$9.1 million) this quarter. Gross profit was RMB338.9 million (US$47.3 million), representing an increase of 6.4% from RMB318.3 million in the same quarter of 2024. The increase was mainly due to the expansion of our higher margin profile AI business. Gross margin was 14.4%, compared with 16.8% in the same period in 2024. The decrease was mainly due to the higher cost of servers along with the expansion of AI business, as well as the upfront costs incurred for certain customer for its future revenue activity. Non-GAAP gross profit2 was RMB350.6 million (US$48.9 million), compared with RMB323.4 million in the same period in 2024. Total operating expenses were RMB665.9 million (US$92.9 million), increased by 11.7% from RMB595.9 million in the same quarter last year and increased by 20.5% from RMB552.5 million last quarter. Among which: Selling and marketing expenses were RMB132.0 million (US$18.4 million), increased by 5.0% from RMB125.7 million in the same period in 2024 and decreased by 8.6% from RMB144.3 million last quarter. The year-over-year increase was mainly due to the increase of share-based compensation, while the sequential decrease was mainly due to one-time sales bonus incurred in the first quarter. General and administrative expenses were RMB339.6 million (US$47.4 million), increased by 27.5% from RMB266.2 million in the same period in 2024 and 86.6% from RMB182.0 million last quarter. The year-over-year increase was mainly due to the increase in share-based compensation and personnel cost and the sequential increase was mainly due to the increase in personal cost and increase in credit loss expenses resulting from the prepayment made to suppliers related to the procurement of certain servers. Research and development expenses were RMB194.3 million (US$27.1 million), decreased by 4.7% from RMB204.0 million in the same period in 2024 and decreased by 14.1% from RMB226.2 million last quarter. The year-over-year decrease was mainly due to the personnel decrease resulting from our strategic structure adjustment and the sequential decrease was mainly resulted from decrease in share-based compensation. Operating loss was RMB327.0 million (US$45.6 million), compared with operating loss of RMB277.6 million in the same quarter of 2024 and RMB234.2 million last quarter. It was mainly due to the increase of credit loss. Non-GAAP operating loss3 was RMB166.4 million (US$23.2 million), compared with operating loss of RMB188.5 million in the same quarter last year and operating loss of RMB55.8 million last quarter. The fluctuation was mainly due to the increase of credit loss expenses.
