More plaintiffs expected in lawsuits alleging NC State ignored sex abuse

Three more plaintiffs accusing NC State University of ignoring sexual abuse by a former sports trainer may join federal lawsuits that are once again moving forward.
Since August 2022, three former male athletes have filed federal lawsuits accusing the university of not protecting them from Robert Murphy, a longtime director of sports medicine who plaintiffs say abused and harassed them.
Murphy, who resigned in 2022, has never been criminally charged.
A federal judge dismissed two of the lawsuits in 2023, one of which was revived in January after a successful appeal. During a June 18 hearing in a federal courthouse in New Bern, Kerry Sutton, the attorney representing the plaintiffs, said she plans to add three more plaintiffs.
Any of these cases may face an uphill battle. NC State is vigorously challenging whether the plaintiffs have legal grounds to move forward, while stating that its defense in the case is independent of the university's stance against sexual exploitation on campus.
'Sexual misconduct of any kind is unacceptable, prohibited by NC State's policies, and in direct opposition to the mission, culture, and standards of the university,' the university wrote in a court filing seeking to have a case dismissed.
NC State spokesperson Mick Kulikowski declined to comment for this story, saying the university doesn't comment on pending litigation.
In August 2022 former soccer player Benjamin Locke filed a lawsuit against the university and others, contending campus officials failed to protect him from Murphy, who worked at State from 2012 to 2022.
Locke said Murphy abused him during what were supposed to be healing training sessions, touching his genitals dozens of times. Murphy took advantage of his powers to decide when student athletes were well enough to play again, Locke's lawsuit states.
The lawsuit contends campus athletic officials were grossly negligent for failing to take action after then men's soccer coach Kelly Findley reported his concerns about Murphy's behavior in 2016 to Senior Associate Athletic Director Sherard Clinkscales, the lawsuit states.
The school's lack of action after the report violates Title IX, federal civil rights law that prohibits sex discrimination at federally funded schools, the lawsuit states.
Another former student, identified in court filings as John Doe, filed a lawsuit in February 2023 that alleged Murphy abused him twice under the guise of treating his injuries in 2015. A third identified as John Doe 2 filed a lawsuit in April 2023 that accused Murphy of touching a former athlete's genitals twice while the student attended State in 2020 and 2021.
In September 2023, U.S. District Judge Louise Wood Flanagan dismissed the first John Doe lawsuit after challenges from NC State, including that John Doe's alleged abuse took place in 2015 and that the lawsuits don't say the university received alleged notice of the abuse, required for the plaintiffs to be successful in holding the university responsible, until 2016.
Flanagan also dismissed the John Doe 2 case, agreeing with NC State's argument that Findley's alleged warning to Clinkscales about Murphy engaging 'in what he suspected was sexual grooming of male student athletes,' wasn't strong enough language to put the school on notice.
But the U.S. Court of Appeals for the 4th Circuit found in January that the statement did meet the legal standard. 'Findley's report specified wrongful conduct that was sex-based, current, and committed by an employee with authority over student athletes,' the court ruled.
That sent the case back to North Carolina's eastern district court, allowing Benjamin Locke's and John Doe 2's cases to resume.
At a June 18 hearing, Sutton, the plaintiffs' attorney, said she planned to combine the two active cases and potentially revive the first John Doe case, according to a transcript of the hearing. She also plans to add three more plaintiffs to the lawsuits, she stated in court.
Sutton didn't provide any other details.
NC State's lawyers have signaled they have more challenges to offer.
That includes the university's claim that plaintiffs filed the lawsuits too late and that John Doe 2 shouldn't be allowed to stay anonymous.
The school also continues to challenge the alleged warning of abuse, needed for the cases to move forward. In addition to saying the warning's language wasn't strong enough, the university is also expected to argue that the wrong person was told. The university argues that head soccer coach Findley reporting to associate athletic director Clinkscales, and soccer coaches allegedly knowing about the alleged grooming, didn't meet the legal standard of notifying the school of abuse.
'Neither the alleged notice to Clinkscales nor the alleged knowledge of the head and assistant soccer coaches of suspected grooming behaviors is sufficient to establish that an NC State official with the requisite authority to address discrimination and to institute corrective measures had actual knowledge of discrimination,' university attorneys argue in court documents.

NFL teams are running the ball more productively than at almost any point in the last decade. The running game is back but that hasn't always translated to fantasy football. Entering the 2025 NFL season, there are a handful of players widely expected to be the top scorers at the position. Reigning Offensive Player of the Year Saquon Barkley, Bijan Robinson, Jahmyr Gibbs, Derrick Henry and Christian McCaffrey are among those experts predict will be reliable double-digit scorers week in and week out. Look at the next tier of running backs in fantasy football and you'll find productive players at the position with some question marks. Ashton Jeanty has plenty of hype but is a rookie in arguably the toughest division in the NFL. Bucky Irving had an impressive rookie season but enters Year 2 with a new offensive coordinator. Johnathan Taylor hasn't played a full season since 2021 which negates his solid production when on the field. This list isn't about the first two or even three tiers of fantasy football running backs. This is about finding value beyond the top 15 players at the position entering 2025. That's where mid-round flyers on players could make the difference between competing for a title and hoping to avoid last-place punishments. USA TODAY Sports identified five value picks at running back who could outplay their current average draft position (ADP) in 2025: Fantasy football RB value picks ADP is from FantasyPros and in half-PPR league formats. Kenneth Walker III, Seattle Seahawks ADP: RB17, OVR42 The fourth-year running back has never been down on talent. His issue throughout his career has been availability; he's missed 10 games over his first three seasons in the NFL. The Seahawks had the fifth-worst rushing offense in the NFL a year ago. New offensive coordinator Klint Kubiak will offer schematic improvements that should play to Walker's strengths, specifically in outside zone runs. He's going this low likely because of injury concerns and worries about Seattle's offensive line. The Seahawks spent their first round pick on guard Grey Zabel, showing how committed they are to improving up front. That's enough reason to have optimism about Walker in 2025. Tony Pollard, Tennessee Titans ADP: RB25, OVR61 Pollard managed 1,317 yards from scrimmage and five touchdowns last season in a Titans offense that was a bottom-eight unit in points and yards. Tennessee overhauled a lot on offense this offseason with a new quarterback in No. 1 overall pick Cam Ward, two new starters on the offensive line and a revamped wide receiver room. All of this should see the Titans offense take a step forward on offense to at least get closer to the middle of the pack. That rising tide should elevate Pollard to a solid No. 2 running back. Tyjae Spears' injury will keep him sidelined for the rest of the preseason, giving Pollard the majority of touches with the first-team offense. Kaleb Johnson, Pittsburgh Steelers ADP: RB28, OVR71 Rookie running backs can be hard to predict but Johnson may be in a good situation to outproduce his current draft position. Even with the arrival of quarterback Aaron Rodgers and wide receiver DK Metcalf, offensive coordinator Arthur Smith will still want to run the ball effectively. Johnson fits the bill well as an early-down back in that system. A healthy offensive line in Pittsburgh could take a step this year with center Zach Frazier, right guard Mason McCormick and right tackle Troy Fautanu all entering their second year in the NFL. In his time as a play-caller on offense, Smith has ranked in the top-10 in rushing attempts five times in six NFL seasons. Last year the Steelers were fourth in the league in rushing attempts. The volume is there for Johnson to produce beyond his RB28 status. Jordan Mason, Minnesota Vikings ADP: RB34, OVR92 Minnesota has traditionally had one primary running back during coach Kevin O'Connell's tenure. That's reportedly changed this offseason during training camp as it's been closer to an even split between Aaron Jones Sr. and Mason. The Vikings invested in the offensive line with new starters at center and both guard spots. They're dropping in an unproven quarterback in J.J. McCarthy. This should lead Minnesota to rely more on the running game in 2025 than in years past. The Vikings traded one of their few draft picks for Mason this offseason. Through the first seven games of 2024, only two running backs had more rushing yards: Henry and Barkley. He's been productive when given the opportunity and could usurp the 30-year-old Jones as the Vikings' primary back over the course of the season. Javonte Williams, Dallas Cowboys ADP: RB36, OVR111 Regardless of their playoff chances in 2025, the Cowboys should be a more productive offense on the ground. They spent their top pick on guard Tyler Booker, a mauler in the run game, and brought in Klayton Adams from Arizona to be their offensive coordinator. Adams had a big role in the Cardinals' running scheme which has been one of the most diverse in the league over recent seasons. Williams is currently slated to start for the Cowboys. He played in all 17 games last season for Denver with 11 starts but managed just 859 yards from scrimmage. Williams should have the edge over other running backs in Dallas to start the season. He could easily benefit from the ground game's improvement under Adams and outplay his status as a low-end RB3. The New York Yankees crushed a franchise record-tying nine home runs in a dominant 13-3 win over the Tampa Bay Rays on Tuesday. The players had to wait for almost two hours as rain and lightning delayed the game, before Aaron Judge, Cody Bellinger and Giancarlo Stanton hit consecutive homers in the first inning to set up what would become a blowout. The nine home runs matches the record the Yankees set earlier this season during a 20-9 win over the Milwaukee Brewers in March. The feat means the Bronx Bombers are the first franchise in league history to record two games with nine homers, in the same season or otherwise, according to MLB. 'To do it twice, that's remarkable,' manager Aaron Boone said, per MLB. 'There were some ones that were seriously hit, too. 'Just a really impressive offensive showing against a team that is not always easy to score runs against.' The Yankees were one home run short of matching the MLB's all-time record of 10 in a game, set by the Toronto Blue Jays in 1987. Bellinger, Stanton and José Caballero finished with two homers each, while Judge, Ben Rice and Jazz Chisholm Jr. got one each. 'We have a really good offense,' Bellinger said. 'With the ebbs and flows of a 162-game season, it's not always going to be pretty, but we all believe in each other. 'The talent's there, and we're doing a good job of putting it all together. It's been fun to be a part of.' The win moves the Yankees to 68-57 on the season to the top of the American League Wild Card standings, five games back of the Toronto Blue Jays in the AL East. The Rays, meanwhile, fall to 61-65 and fourth in the division. The second game of the series is Wednesday night in Tampa.
