Five years in jail for man who made hoax bomb threat to skip work
The Bellville regional court on Monday convicted Ferdinand Fortuin, 50, who had contacted the Bellville police on Sunday, November 10 2024, telling them he had planted bombs at the department of water & sanitation offices, Transnet Park building and the Bellville taxi rank.
'He gave police hours to evacuate the premises. The accused made these threats after heavy drinking on Sunday and decided that he did not want to go to work on Monday, November 11, 2024,' National Prosecuting Authority spokesperson Eric Ntabazalila said.
Fortuin left his home in Mamre with the hope that the roads leading to Bellville would be closed because of his bomb threats.
'They were not and he worked the whole day.'
In his plea and sentencing agreement, Fortuin confessed he had bought a cellphone from a drug user, which he used to make hoax calls to the police and a toll-free emergency number regarding the placement of explosive devices in the buildings, including the one where he worked.
This resulted in the deployment of substantial state resources and the evacuation of thousands of people from the sites he mentioned.
At the water & sanitation department offices on Voortrekker Road, police — assisted by three bomb disposal technicians, the K-9 Dog Unit using explosive detection canines and visible policing unit members — evacuated 164 people. Meanwhile, 151 people were evacuated from the department's Bellville South offices.
Police also evacuated 250 people from the Transnet Park Building offices, and 3,000 people were evacuated from the taxi rank.
'The taxi rank was closed and roads leading to and out of the taxi rank were closed, resulting in huge panic in the area.'
Fortuin was arrested and charged with four counts of contravening the Protection of Constitutional Democracy Against Terrorism and Related Activities Act (Pocdatara) and for contravening the Explosives Act.
The prescribed minimum sentence for contravening Pocdatara is 15 years' imprisonment unless the court finds substantial and compelling circumstances to deviate from the prescribed sentence.
'He was convicted on three counts of Pocdatara and, for purposes of sentencing, the charges were taken together and he was sentenced to five years' direct imprisonment.'
The court found that he was a first offender, he had pleaded guilty, had strong personal circumstances, had shown remorse and his acknowledgment of guilt made him a good candidate for a rehabilitative sentence.
'The NPA accepts the sentence of the court and warns that anyone who makes such threats will face tough consequences,' Ntabazalila said.

The mother of a four-year-old girl who was allegedly raped and murdered by her father could not hold back her tears as she appeared in the Protea magistrate's court on Tuesday. The mother, who was visibly emotional, appeared on a charge of defeating the ends of justice. The couple appeared in court separately in connection with their daughter's rape and murder. 'The father was charged with murder, rape, compelled rape, child abuse and assault, while the mother of the deceased was charged on a separate docket, with failure to immediately report a sexual offence against a minor child,' National Prosecuting Authority spokesperson Phindi Mjonondwane said. The father was arrested on Wednesday after a report to the Eldorado Park police following a video in which the child can be heard screaming as she is assaulted went viral. 'Following further investigations, the mother was also arrested. It is alleged that the mother of the deceased knew about the sexual assault but failed to report to the authorities, as per duty in terms of the Sexual Offences and Related Matters Amendment Act,' Mjonondwane said. A neighbour is said to have heard the child screaming from the couple's home and, on arrival, found the father allegedly beating the child and captured the incident on a phone. 'The video was circulated, leading to police being summoned to the scene.' During his arrest, his daughter was found injured and bleeding. She was taken to the hospital but later died from her injuries. They were both remanded in custody until August 18 for them to apply for bail. 'The recent spike in parents facing allegations of killing and abusing their children is of grave concern to the NPA, and we remain resolute in our efforts to promote children's rights and safety. Our children are dependent on us to be their voice, and we will stop at nothing to ensure that justice prevails,' Mjonondwane said.

Benoni man accused of raping and impregnating daughter denied bail
The Tsakani magistrate's court on Tuesday denied bail to a 39-year-old man from Lindelani, Benoni, who is accused of raping and impregnating his daughter, who was 15, in 2022. The man had applied for bail on Friday. 'The alleged abuse began in March 2022 when the victim lived with her parents and younger brother in Tsakani,' National Prosecuting Authority spokesperson Lumka Mahanjana said. On the day of the first incident, the mother was at church and left her daughter with her father and brother. The father allegedly called the victim into the house and sent her brother to buy chips. 'When the victim got inside the house she found the father in her room. The father allegedly locked the door behind her, undressed both himself and the victim, raped her, and left her in her room.' Upon the mother's return, she found the victim crying on her bed. 'She told her mother what had happened but the mother did not believe her.' The abuse allegedly continued when the mother was not around and the child stopped telling her mother as she still did not believe the victim. The child became pregnant the same year. The mother brought a concoction and told the child to drink it in an attempt to abort her baby, which failed. The parents then moved the victim to Limpopo to live with her paternal grandmother, where she gave birth to a boy in December 2022. 'After turning 18, the victim opened a case in Limpopo on July 7 2025, resulting in the father's arrest on July 19 2025.' In court, the father sought R1,000 bail, citing his role as the primary caregiver for his three children aged one, 12, and 18 since his unemployed wife could not support them. Prosecutor Sindi Leonora Sejake called investigating officer Sgt Tebogo Lephoto, who opposed the accused's release on bail because the state had a strong case. Lephoto said DNA evidence revealed that the accused was the father of the victim's three-year-old child. 'The investigating officer testified that the accused was likely to interfere with witnesses since he went to Limpopo from Gauteng in attempt to confront the child after he realised that the child had opened a case against him and was speaking about the matter on social media.' Magistrate Tebogo Lekgau denied bail, noting the severity of the charge and the likelihood of a life sentence if convicted. She emphasised the strong state case, the accused's potential to evade trial and the community outcry that prompted the family's relocation. 'Moreover, the magistrate said, the vulnerable child was failed by her father as he repeatedly raped her, while her mother also failed to protect her by refusing to believe her.' The case was postponed to August 28.

According to police, the man was arrested on Wednesday, August 6, 2025 after officers responded to reports of screams coming from a backyard shack. Inside the home, police discovered the young girl with severe head injuries, bruises, and a swollen eye.
