Emphasising the potential consequences, the bench said that many of India's highways lack shoulders or warning signs for upcoming speed breakers, making it even more crucial for drivers to remain alert and cautious.

It further clarified that while there might be genuine reasons for a vehicle to stop suddenly, like an emergency or road obstruction, the driver must still make every effort to alert others behind them. The responsibility lies with the driver to ensure they don't endanger fellow motorists by braking without giving adequate warning.
A key takeaway from the court's statement: 'On highways, high speeds are normal. If a driver plans to stop, he must alert others—it is his responsibility." The decision came in a case involving a young engineering student whose leg had to be amputated following a multi-vehicle crash in Tamil Nadu.
A two-judge bench, led by Justices Suddhanshu Dhulia and Aravind Kumar, noted that national highways are designed for steady and swift travel, and any driver intending to pause must ensure trailing traffic is warned in time.
The case stemmed from a 2017 incident in Coimbatore, where the student, S Mohammed Hakim, collided with a car that had come to a sudden stop. Thrown onto the tarmac, he was then struck by a bus approaching from behind. The car driver later explained that he stopped because his pregnant spouse felt unwell.
Blame shared, but driver's actions deemed primary trigger
While the student was criticised for riding without a proper licence and not keeping enough space from the vehicle ahead, the judges agreed that the chain of events began with the car's unannounced halt. The court concluded that the car driver was 50 per cent responsible for the accident. The bus operator was held 30 per cent liable, while Hakim was assigned 20 per cent of the fault for contributory negligence.
Previous findings overturned
Earlier, the Motor Accident Claims Tribunal had cleared the car driver and attributed the fault mainly to the bus driver and Hakim. The Madras High Court later revised this view, placing a greater share of responsibility on the car driver. The Supreme Court's latest judgment has further adjusted the distribution of blame, placing primary responsibility on the car driver.

A bench comprising Chief Justice B R Gavai and Justices K Vinod Chandran and N V Anjaria made the remark while reserving its verdict on pleas filed by the National Highways Authority of India (NHAI) and concessionaire, Guruvayoor Infrastructure challenging the Kerala High Court's order suspending toll collection at the Paliyekkara toll plaza in Thrissur. "Why should a person pay Rs 150 if it takes 12 hours for him to get from one end of the road to the other end? A road which is expected to take one hour, takes 11 more hours and they have to pay a toll as well," the CJI said. During the hearing, the bench was informed about a nearly 12-hour traffic snarl on the stretch on the weekend. The toll suspension was ordered by the high court on August 6 on the ground of poor condition of the Edappally-Mannuthy stretch of National Highway 544 and severe traffic congestion caused by ongoing works. "We will consider everything, reserve for orders," the bench said after hearing Solicitor General Tushar Mehta, appearing for the NHAI, and senior advocate Shyam Divan for the concessionaire. Justice Chandran said the accident which triggered the block was not a mere "act of God" as argued by Mehta, but caused by a lorry toppling into a pothole. Mehta said the NHAI provided service roads where underpass construction was underway but admitted monsoon rains had slowed the progress. He also cited a precedent suggesting proportionate toll reduction rather than suspension. Justice Chandran, however, remarked a 12-hour ordeal was far beyond any proportional adjustment. The concessionaire said it had maintained the 60 kilometer under its control and blamed third-party contractors, including PSG Engineering, for the service road bottlenecks. "My revenue stream cannot be stopped when I am not responsible for the work entrusted to others. The impact on me has already been Rs 5-6 crore in just 10 days," Divan said, terming high court's order as "grossly unfair." The bench said the high court allowed the concessionaire to raise claims against the NHAI for losses. Divan said it was inadequate as day-to-day maintenance costs continued while revenue halted. Appearing for the original petitioners before the high court, senior advocate Jayant Muthraj calling it NHAI's responsibility to ensure a motorable road. He said the toll collection amid such conditions violated public trust while referring to the high court's interim directions before resorting to toll suspension as a "last resort." On August 14, the top court expressed its unwillingness to interfere with the high court order suspending toll collection. The high court on August 6 ordered a four-week suspension of toll collection, observing that motorists could not be charged when the highway was badly maintained and traffic congestion was severe. It said the relationship between the public and the NHAI was one of "public trust" and that failure to maintain smooth traffic flow breached that trust.

A day after the Supreme Court of India ordered that no coercive action be taken against the End-of-Life Vehicle (ELV) owners, the residents of Noida on Wednesday expressed relief saying that the ban should be based on the fitness and emission level of the vehicle rather than its age. To be sure, the ELV bans were first mandated by the National Green Tribunal in 2015 and reinforced by the Supreme Court in 2018 to tackle the NCR's air pollution crisis. (Raj K Raj/HT Photos) According to the Noida transport department data, there are nearly 1 million registered vehicles, including around 40,000 diesel vehicles over 10 years old and 168,000 petrol vehicles older than 15 years in the Gautam Budh Nagar district. Traffic police said 160 ELVs were seized from January to August in Gautam Budh Nagar. Piyush Gupta, who owns a 2005 Tata Indica, is a resident of Noida's Sector 16, said, 'I have read the Supreme Court judgment for ELVs, and for the time being, it is a big relief for me. Recently, when ELVs were banned on the road, I parked my car at home and switched completely to another vehicle.' Gupta's Indica, which was deregistered from Rajasthan and registered again in Noida, is about to expire this October. As the apex court ordered no action for four weeks, he is exploring other options to sell or use the vehicle. 'In my opinion, if any vehicle passes the fitness test, there should be no ban, because if someone is keeping his/her vehicle in good condition, why should it be banned?' He further argued that for the last several years, the technology in cars has advanced as compared to old 20- to 30-year-old vehicles. Despite all additional changes and improvements, the ban is unjustified. To be sure, the ELV bans were first mandated by the National Green Tribunal in 2015 and reinforced by the Supreme Court in 2018 to tackle the NCR's air pollution crisis. Earlier this year, the Commission for Air Quality Management (CAQM) announced that the ELV ban in the National Capital would take effect from July 1, with vehicles identified via Automatic Number Plate Recognition (ANPR) at fuel stations being denied fuel. The same rule was to be implemented in five NCR districts from November 1 and across the rest of NCR from April 1, 2026. ELV owners further stressed that the COVID lockdown period and the emission levels caused by vehicles should also be considered. 'The temporary relief for four weeks is more for people like us who are confused between selling vehicles or buying a new one,' said Vinay Kumar, a resident of Noida, Sector 55, who owns the Mahindra Scorpio 2010 model. A senior traffic police officer, on condition of anonymity, said, 'We are analysing the Apex Court's order on ELVs. As of now, we are only issuing challans against the ELVs in the district.' On Monday, a bench comprising Chief Justice of India Bhushan R. Gavai and Justices K. Vinod Chandran and N.V. Anjaria ordered that no coercive action be taken against ELV owners. The court also issued a notice to the Delhi government and listed the matter for hearing after four weeks.

New Delhi: In a bid to tackle one of the worst sources of air pollution, Delhi has begun testing retrofitting devices that promise to cut harmful emissions from heavy commercial vehicles by more than 70 per cent. The pilot project, led by the Delhi Pollution Control Committee, will see 30 catalyic converter-based devices installed on older BS-III and BS-IV trucks and buses. These devices, fitted next to the exhaust, are designed to trap and neutralise pollutants like particulate matter (PM), carbon monoxide (CO), hydrocarbons (HC), and nitrogen oxides (NOx). Environment Minister Manjinder Singh Sirsa called it a "decisive leap towards tech-driven pollution control." Not only is this a first-of-its-kind effort in India but also a solution that can be replicated in other cities and sectors where fossil fuel engines are a major source of pollution." The move comes as Delhi tightens restrictions on older, more polluting vehicles in line with the Commission for Air Quality Management's directives. But rather than just banning them, the government is testing if technology can give these vehicles a second, cleaner life. The push to clean up truck fumes also comes amid relief for old cars from the Supreme Court. On Tuesday, the court said no coercive action will be taken against those who own diesel vehicles older than 10 years and petrol vehicles older than 15 years. Mr Sirsa said the end-of-life vehicles must not be categorised based on the years of use, but rather the distance traveled, and pollution should be considered as a viable tests and have clocked over 9,000 km in field trials. The pilot will focus on government and autonomous body vehicles meeting BS-IV or earlier norms, with testing done in collaboration with IIT Delhi or ICAT. Sirsa said the project reflects a shift towards permanent solutions rather than short-term fixes. "This pilot is a trial and a statement of our vision, to deploy innovative solutions that clean Delhi's air while keeping essential transport running," he said. If the results match the lab tests, the retrofit technology could be rolled out across Delhi's heavy vehicle fleet, a step that might significantly cut the toxic exhaust clouding the city's air each winter. For now, all eyes will be on these 30 trial vehicles. If they can drive cleaner without losing performance, Delhi could have found a way to fight air pollution without sidelining livelihoods.
