Safety and security mayco member JP Smith has called on the State to reconsider it's stance in deciding not to oppose bail for an accused cop killer.

De Lilly, a taxi driver, is alleged to have shot and killed traffic cop Van Rooyen in his patrol car.

De Lilly was arrested along with his taxi guard and two other men shortly after the shooting in Acre Road, however a month later the case was provisionally withdrawn.
The accused returned to the dock making a brief court appearance on Monday facing Schedule 6 charges of murder, the unlawful possession of a 9mm pistol and the unlawful possession of 14 cartridges.
The court heard that the warrant for his arrest was issued back in March 2025.
The State said that the investigation is complete and that it will not oppose bail.
In a statement, Smith called for the State to reconsider their decision on his bail.
Smith said: "While the reasons for the unopposed bail application are unclear at the stage, we call on the courts to use their discretion when the matter returns to court next week.
"We believe that individuals accused of murdering officers in the line of duty should not be allowed to roam our streets while on trial. If we cannot protect our officers, we cannot protect the public."
Smith added: 'We hope this arrest brings the family some comfort and we call on the courts to act diligently.
'We hope this serves as a lesson to those who callously kill officers executing their duties. If we cannot protect our officers, we cannot protect the public.'
'The case was postponed to July 28 for bail information and for a lawyer to represent the accused."
De Lilly is alleged to be a member of the 26 gang, has a criminal record dating back to 1999 and had been convicted of robbery, kidnapping and rape.

Image: SAPS Taxpayers are coughing up the legal costs for the 12 South African National Defence Force (SANDF) members who are facing multiple charges, including the murder of Directorate of Priority Crime Investigation's (DPCI) senior investigator, Lieutenant-Colonel Frans Mathipa. Mathipa was killed while he was investigating the abduction of two Ethiopian men, Abdella Hussein Abadiga and his bodyguard, Kadir Jemal Abotese, who were abducted and allegedly taken to Zwartkop Military Base, and their whereabouts are still unknown. This was disclosed by Defence Minister Angie Motshekga when she was responding to parliamentary questions from DA MP Chris Hattingh and Maliyakhe Shelembe. Motshekga said the legal costs were paid on the basis of the Defence Act which provides for legal representation for SANDF members. 'The SANDF has the authority to provide legal assistance to its members in certain circumstances. The 12 members of the SANDF facing charges related to the death of Lt Col Frans Mathipa are receiving State-funded legal assistance in accordance with the Defence Act, 2022. This assistance was made available from the outset of the legal proceedings,' she said. Asked about the legal cost incurred to date in providing to the accused SANDF members, Motshekga said the defence could not confirm the total costs as the court case was currently ongoing and legal proceedings still in progress. 'The department will continue to provide the necessary support and the final costs will be determined once the matter is concluded.' She would provide the estimated cost that may be incurred should the case proceed to full criminal trial. 'The cost will depend on various factors, including the duration of the trial, the number of witnesses, and the complexity of the legal arguments. As such it is not feasible to provide a reliable estimate of the total costs, including legal fees and other relevant expenses, at this stage,' Motshekga said. The members of the SANDF special operations unit were each granted R10 000 bail by the Randburg Magistrate's Court following their arrest last month following Mathipa's death in August 2023. The National Prosecuting Authority has indicated that it will appeal the court's decision to grant bail to the SANDF members facing serious charges that include murder, kidnapping, fraud, obstructing the administration of justice, making false statements under oath and theft of a motor vehicle. Asked if SANDF has a framework to guide the provision of legal assistance to members charged with serious criminal offences, Motshekga said the process of acquiring legal representation at the State's expense starts with an application by an individual to the department's legal services division. 'The request includes an acknowledgement and undertaking by the member that any expense incurred maybe recouped if it is subsequently determined that the member did not qualify for legal representation at State expense.' However, she said the SANDF policy on legal assistance may differ depending whether the proceedings are held in military or civilian courts. Motshekga said members facing charges in military courts may be entitled to legal representation provided by the SANDF's military defence counsel. 'For proceedings in civilian courts, the SANDF's members, guided by the Defence Act, may be provided with legal assistance under certain circumstances, such as when the member's actions were taken in the course of their duties.' She would not say how much her department spent on legal assistance for SANDF members over the past five years. Motshekga, however, indicated that SANDF has received 26 requests for legal assistance at State's expense during the past five years.

Cape Town Mayor Geordin Hill-Lewis recently joined Smith at the city's Observatory College, where the officers were in their final stages of training. READ: CoCT's 'neighbourhood policing' initiative to see metro police officers deployed in every ward Smith explained some of the training the officers had to endure. "The candidates completed an 18-month-long training programme which included traffic officer training, metro police officer training, which included firearm competency, as well as specialised training which included our neighbourhood safety officer training, evidence-based policing, additional tactical training." Smith said the officers were also taught how to use the city's electronic devices. "Officers were also put through their paces using the city's cutting-edge firearms training simulator. Officers will be assigned EPIC hand-held devices for digital coordination and reporting of offences as part of our computer-aided dispatching system." Smith said that five officers per ward would be deployed across Cape Town in spring.

Luthando Nomandindi is facing serious charges after purportedly defrauding the State of more than R1.1 million as a fake prosecutor. A former prosecutor for the National Prosecuting Authority (NPA), is facing serious charges after purportedly defrauding the state of more than R1.1 million. Luthando Nomandindi, 33, appeared in the Mthatha Specialised Commercial Crime Court in the Eastern Cape facing charges of fraud, forgery, and uttering. The charges against Nomandindi stem from his time at Walter Sisulu University (WSU), where he was enrolled in a Bachelor of Laws (LLB) degree programme from 2010 to 2016. Despite being registered for six years, Nomandindi failed to satisfy the academic requirements necessary for graduation. Police spokesperson Warrant Officer Ndiphiwe Mhlakuvana explained that between January 2010 and December 2016, Nomandindi was enrolled for a Bachelor of Law (LLB) degree at Walter Sisulu University, however, he did not meet the graduation criteria. "Despite this, in 2020, Nomandindi apparently submitted a falsified LLB degree certificate and a bogus Legal Education and Development (L.E.A.D) attendance report as part of his application to the NPA's Aspirant Prosecutor Programme, which required a legitimate LLB qualification or proof of final-year status." said Mhlakuvana. Mhlakuvana said based on his fraudulent credentials, in January 2021, Nomandindi was appointed as an Aspirant Prosecutor and later elevated to the position of Public Prosecutor.
