Special court stays proceedings in 2022 bank fraud case filed against Choksi

A SPECIAL court Friday stayed proceedings against diamond merchant Mehul Choksi and a co-accused in a bank fraud case, pending before the magistrate court.
The special court said that the magistrate court had in April issued summons to the seven accused in the case, including Choksi, but the order does not reflect any opinion of the court.
Lawyers for Choksi and co-accused, Aniyath Nair, had approached the special court against the magistrate court order.
'The reasons are necessary not only for the litigants before the court but also for the superior courts to know the thought process of the learned trial court. The court expects at least some brief outline of the reasons which leads the Trial Court to form an opinion to issue summons in the case. Therefore, in view of this prima facie error of being no reasons in support of the order of issuance of process, the further proceedings…. pending before the court….are hereby stayed qua the present applicant Nos.5 (Nair) and 2 (Choksi) till next date,' the special court said.
The case relates to a complaint filed in 2022, alleging wrongful losses caused to a consortium of banks led by Canara Bank to the tune of Rs 55.27 crore.
Choksi, two companies— Bezel Jewellery India Ltd, Gitanjali Gems, and four other persons were named as accused by the CBI.
The CBI had alleged that loans granted by the banks for manufacturing and sales of gold and diamond studded jewellery, were diverted by the accused.
The magistrate court had passed an order summoning the accused and issued a non-bailable warrant against Choksi, who is currently facing proceedings in Belgium, where he is detained on an extradition request by Indian authorities, for investigation of the Rs 13,000-crore Punjab National Bank bank consortium fraud case.
The lawyers for the accused, Rahul Agarwal and Jasmin Purani, had submitted that the magistrate court order taking cognizance of the chargesheet filed by the CBI was done 'mechanically', without giving any reasons. They also claimed that the order was passed in a 'lightning speed' on the same day when the chargesheet, running into thousands of pages, was put before the court, without perusal.

A prominent and well-regarded voice in economics in the UK, India, and beyond, Desai was a widely respected academic who wrote over 200 articles published in academic journals and authored over 25 books. A Professor Emeritus of the London School of Economics (LSE), where he had a long and distinguished career, Desai also wrote scores of columns in newspapers in the UK and India, including in The Indian Express. In 2008, he was awarded India's third-highest civilian honour—the Padma Bhushan. Although a celebrated economist, Desai's writings and commentary spanned varied subjects—economics, politics, political and social economy, history, sociology, international affairs, and even cinema. In fact, Desai reportedly counted his biography of the legendary actor Dilip Kumar—Nehru's Hero: Dilip Kumar in the life of India—as his 'greatest achievement'. Desai was an avid watcher of old Hindi films, and also had a passion for cooking. After learning of Desai's passing, Prime Minister Narendra Modi took to social media platform X to express his condolences. Born on July 10, 1940 in Vadodara to Jagdish Chandra, a civil servant, and Mandakini Desai a homemaker, Desai grew up with three siblings. He earned his BA in 1958 and MA in economics in 1960 from the University of Bombay, after which he bagged a scholarship to the University of Pennsylvania, where he completed his PhD in Economics in 1963. Desai, also well-known as Lord Desai due to his membership of the upper house of the British parliament, taught economics from 1965 to 2003 at the LSE. He was appointed as a lecturer at the LSE in 1965, and became a Professor of Economics there in 1983. Desai went on to head LSE's Development Studies Institute from 1990 to 1995, and established and led the LSE Centre for the Study of Global Governance. During his time at the LSE, Desai researched and lectured on a variety of subjects—Marxian analysis, applied econometrics, Indian development and reform, poverty, globalisation, and the role of private markets. In 1971, Desai joined the British Labour Party and was elevated to the House of Lords in June 1991. He was Chairman of the Gandhi Memorial Statue Trust which helped erect the statue of Mahatma Gandhi in London's Parliament Square. In 1991, he was created a life peer as Baron Desai St Clement Danes in the City of Westminster. In 2020, Desai resigned as a member of the UK's Opposition Labour Party over its failure to effectively tackle antisemitic racism within its ranks. He authored numerous books, the most recent being The Poverty of Political Economy: How Economics Abandoned the Poor (2022). His other notable books are Marx's Revenge: The Resurgence of Capitalism and the Death of Statist Socialism, Rethinking Islamism: Ideology of the New Terror, The Route to All Evil: The Political Economy of Ezra Pound, a novel Dead on Time, and The Rediscovery of India.

Jaipur: Disguised as an 'ascetic', with black robes, Purna Ram, a known drug supplier from Rajasthan's Hanumangarh, has been caught by the police after evading arrest for three years. Purna Ram Sharma, 40, was wanted by the police for three years. His name came up when the police busted a heroin racket in March 2023, and three people, Navin, Tarachand and Surendra, were caught with 115 gm of heroin worth Rs 46 lakh. During the investigation, his name came up as the main drug supplier who sold the accused heroin. But as the police went to arrest him, a key figure in the drug supply racket, he went into hiding. Special teams were formed to catch him, but he managed to evade the police for years. Till he came to visit his sister in Haryana's Alinabad, and a tip off led the Hanumangarh police to Purna, who was carrying a reward of Rs 5,000 on his head Police station inspector Subhash Kachchava of Hanumangarh town, who led the arrest, told NDTV, "Purna Ram was in the business of supplying drugs. He does not do drugs himself and is not an addict, but was a part of the supply chain and was probably procuring drugs from neighbouring Punjab to peddle in Rajasthan's Hanumangarh. He was hiding as an 'ascetic' or 'tantrik'. He claims he was repenting and had gone to do spiritual practices, but all this is hogwash; he disguised himself to evade arrest. There are 2 cases against him under the NDPS Act in Hanumangarh." Purna Ram lived in a hut in Madhya Pradesh, close to the Ujjain temple. He also lived near the Kamakhya temple in Guwahati and the Tarapeeth temple in West Bengal, and also stayed near the Kaal Bhairav temple in Varanasi, temples known for occult practices. Rajasthan's Hanumangarh and Ganganagar are on the border with Punjab; the areas have been reporting a spike in drug hauls. In the past two months alone, heroin worth six crores was seized in Hanumangarh. Over 90 cases have been registered under the NDPS Act, and 113 people were arrested for drug-related offences.
