
Andiswa Mengo tells tribunal a 'father figure' was abusing her

The Judicial Conduct Tribunal has heard how High Court secretary Andiswa Mengo told a colleague she was being abused by a judge who was a 'father figure'.
The tribunal is hearing sexual harassment allegations brought by Mengo against Eastern Cape Judge President Selby Mbenenge.
Mengo filed the complaint against Mbenenge, stating that his unwanted sexual advances made towards her between 2021 and 2022 were unwelcome.

During Thursday's proceedings, Gqeberha High Court secretary Ntomboxolo Brenda Jobela told the tribunal that Mengo had shown her images she claimed were sent by a judge, including an explicit photo of male genitalia.
Jobela said Mengo had not named the judge.
'I could not immediately at the time when I received the picture,' she said, noting how she could not immediately identify who the pictures belonged to at the time she received them.
'This is also because before she sent the picture, there was a message that she sent before sending the picture. I was also in a bit of shock after receiving the picture'.

Message
Evidence leader Salome Scheepers asked Jobela what message was sent before the picture was sent.
'She said there's an older man or father who is abusing me. She then said he is sending me pictures, and what I hate is the fact that I am in the same age group as his children. She then sent the pictures that I mentioned initially.'
Jobela testified that there was also a message in which Mengo stated that she told the judge that he was 'getting too familiar with me and that she was not that type of woman'.
'I asked her who sent these pictures to her. She said she would tell me when we meet.'
Jobela said she later asked Mengo: 'Is this JP who is sending you these things?', to which Mengo replied: 'You do not disappoint.'
'Male organ'
Jobela said one of the pictures was a screenshot of a 'male organ' and another seemingly downloaded from the internet of a naked white couple, while the third was of a leg, covered with dark striped pants with a pointy shoe visible.
She said it had been taken in an office which she later recognised as Mbenenge's office at the Makhanda High Court.
On Tuesday digital forensic expert Francois Moller testified before the tribunal that no evidence of the 'penis picture' could be found on Mengo's cellphone.
Cross-examined by Mbenenge's advocate Griffiths Madonsela, Jobela said that she was only confirming that Mengo had sent the pictures to her.
While Jobela could not confirm the date of the pictures, she conceded it could have been in late November 2022.

Meeting
Earlier in the proceedings ,Abongile Tshete, a judge's secretary based in Makhanda, told the tribunal that Mbenenge had asked him to approach Mengo, who was a friend and colleague, to set up a meeting to discuss Mengo's allegations, which she had by then made public.
While Mbenenge has admitted to 'consensual' conversations with Mengo, he has vehemently denied sending sexually explicit pictures to her.
Laptop, no laptop
The tribunal resumed with former Judicial Services Commission (JSC) Law advisor Kutlwano Moretlwe wrapping up her testimony.
Moretlwe helped Mengo file her complaint against Mbenenge.
She insisted that Mengo had a copy of the complaint on her laptop, which Mengo denies, as stated by her counsel, Advocate Nasreen Rajab-Budlender.
'Ms Mengo disputes that she had her laptop with her on the 7th and 8th of December [2022] when she came to Johannesburg. And she disputes that she typed any part of that complaint'.
Jobela responded saying: 'That is not correct. She had her laptop as I've indicated because she said that she's going to work. She brought it so that she can finalise a judgment that she was working on'.
Evidence concerning
Rajab-Budlender was not satisfied.
'Ms Moretlwe, I must tell you that I find your evidence concerning and I will argue that your version should not be accepted, particularly as it relates to Ms Mengo'.
Moretlwe responded with: 'I have no comment'.
Mengo was visibly emotional and even crying during proceedings.
After three days of detailed testimony from digital forensic analyst Francois Moller, who examined two mobile devices, and forensic and legal linguist Dr Zakeera Docrat, who analysed the use of emojis, Moretlwe became the third witness to testify before the tribunal about what transpired when Mengo lodged a complaint against Mbenenge.
The tribunal resumes on Friday.

Three sentenced for Sea Cow Lake kidnapping and murder
TWO of the three men who were involved in the murder of Durban lecturer Chanlall (Shan) Dwarika were sentenced to life imprisonment in the Durban High Court recently. 'Building material was going missing so this was done on condition that the accused would live rent-free on the property to safeguard the material while they assisted with the renovations. They also received some spending money on a casual basis. Despite the accused living on the property, items were still going missing so Chanlall asked them to leave on May 26, 2023,' said Natasha Ramkisson-Kara, NPA regional spokesperson. The deceased's daughter said that the loss of her father has left her with a deep sadness and grief. Judge offers to recuse himself from Senzo Meyiwa murder trial after racial remarks

His apology follows widespread public backlash, including criticism from parliament. The controversy erupted after Mokgoatlheng harshly criticised Advocate Charles Mnisi, who had excused himself from Monday's session to participate in the Comrades Marathon in KwaZulu-Natal (KZN). The judge's comments included a strong condemnation of black lawyers, during which he said: 'This is what happens in a South Africa run by blacks. I can tell you now, even if you call Uncle Tom, I don't think a white advocate will ever have the gall to ask me that.' His remarks prompted calls for the Judicial Services Commission (JSC) to investigate his conduct. Senzo Meyiwa murder trial judge apologises During proceedings at the Gauteng High Court in Pretoria on Monday, Mokgoatlheng publicly apologised for his remarks. 'I have been 26 years on the bench, I have never ever behaved the way I did,' the judge said. He explained that Gauteng High Court Judge President Dunstan Mlambo had reprimanded him, stating that his behaviour was 'not befitting' for someone of his experience and stature. 'I agreed. My conduct was questionable and incorrect. My wife also told me to apologise to the whole of South Africa,' Mokgoatlheng said. 'I wish to tender my sincere apologies. It's contrary to my nature to do that.' 'If people say I am a racist, maybe I'm not aware of that, but if I trampled on anybody's toes because of my racism… I wish to apologise for being a racist. He went on to address the accused directly, saying he would step down from the case if they doubted his fairness. He previously issued an apology following comments about black lawyers, made while criticising the late defence lawyer Thulani Mngomezulu for his absence. Charges Five accused – Muzikawukhulelwa Sibiya, Bongani Ntanzi, Mthokoziseni Maphisa, Mthobisi Mncube, and Fisokuhle Ntuli – are on trial for Meyiwa's murder. The former Bafana Bafana captain and Orlando Pirates goalkeeper was fatally shot on 26 October 2014 while visiting his then-girlfriend, singer Kelly Khumalo, at her family's home in Vosloorus, Ekurhuleni. The accused have been charged with murder, attempted murder, robbery with aggravating circumstances, possession of an unlicensed firearm, and possession of ammunition. Faction of Zulu royal family optimistic SCA will uphold ruling setting aside Ramaphosa's recognition of Misuzulu as king
JOHANNESBURG - A faction of the AmaZulu royal family supporting Prince Simakade says it's optimistic that the Supreme Court of Appeal (SCA) will uphold a ruling that could set into motion the dethroning of King Misuzulu kaZwelithini. Tensions in the royal house reached breaking point after King Misuzulu was crowned as the Zulu monarch following the passing of his father, King Zwelithini and his mother, Queen Regent Mantfombi, in 2021. Prince Simakade, who is King Misuzulu's half-brother, believes he is the rightful heir to the throne, claiming customary protocols were ignored. In December 2023, the High Court in Pretoria set aside President Cyril Ramaphosa's recognition of King Misuzulu as king of the Zulu nation. Less than two weeks ago, the SCA reserved judgment in the appeal over the legitimacy of the kingship. Speaking on the matter on 702's Nguni programme, Siyaxoxa ku-702 , Prince Thokozani Zulu weighed in on what he believes needs to follow. 'We cannot take this matter back to the family for a resolution because there's a court ruling which says the Zulu family would not be able to mediate on the matter without intervention. That way, the President must step in and do what the law requires, by appointing a committee to probe and report back on the allegations that the identification process of Misuzulu was not done in terms of customary laws and customs.'
