Can't reject insurance claim citing route permit violation: Kerala high court

Kochi: High court has held that even if an insured transport vehicle met with an accident while plying on a route different from that specified in the route permit, the insurance company cannot be exonerated from its liability to pay compensation.
The bench of Justice C Pratheep Kumar made the ruling while setting aside an order of the
Motor Accidents Claims Tribunal
, which had directed the insurance company to recover the compensation amount it had paid to the legal heirs of the deceased from the owner and driver of the transport vehicle involved in the accident. The court was considering a petition filed by Sathi Kumar, a native of Perumbazhuthoor, Neyyattinkara, in Thiruvananthapuram.
In 2005, within the Thiruvananthapuram city limits, an autorickshaw driven by Sathi Kumar collided with a scooter ridden by Sadasivan Nair, a native of Ookkodu. Nair sustained serious injuries and died later on that same day. After evaluating the evidence on record, the tribunal found negligence on the part of Sathi Kumar and awarded a total compensation of Rs 11.10 lakh. It further directed the insurer to pay the amount to the legal heirs of Nair and recover the same from Sathi Kumar and the owner of the autorickshaw, on the ground that Sathi Kumar had taken the autorickshaw into the city limits, where it was prohibited under the terms of the permit.
Considering Sathi Kumar's appeal, HC observed that a transport vehicle operating on a route different from the one specified in the permit does not amount to a fundamental breach of the policy conditions and constitutes only a technical violation. The permit was issued for carrying passengers, and any such deviation was held to be a minor infraction. The court accordingly set aside the tribunal's order to the extent it permitted the insurer to recover the compensation amount from Sathi Kumar and the owner of the autorickshaw.

Raj Kushwaha, along with Vishal Singh, Anand Kurmi, and Akash Rajput, first boarded a train from Indore to Delhi between May 17 and 18 and then took Rajdhani Express from Delhi to Guwahati. Their travel preceded Raja and Sonam's honeymoon to Shillong for which they took a flight from Indore on May 20. Throughout this duration, Raj stayed in direct and discreet contact with Sonam, who used different mobile apps to communicate with him, and shared her live locations which allowed the alleged conspirators to track her and Raja's movement. However, as Raj continues to claim that he was in Indore during the period, police are gathering more evidence to ascertain whether Raj was in Indore or was one of the killers of Raja and to corroborate the confessions of the accused regarding the involvement of each one in the crime. After killing Raja on either May 23 or 24, the accused were back in Indore on May 25, police said.

Nagpur: The Nagpur bench of Bombay high court suspended the sentence of two men convicted under the Protection of Children from Sexual Offences (Pocso) Act, and granted bail, since the survivor had failed to identify them during the trial proceedings in the district court. The two appellants had been sentenced to 20 years of rigorous imprisonment by district court for allegedly threatening, extorting, and forcing a 16-year-old boy into performing oral sex. However, HC observed that the survivor neither identified the accused in court nor gave a clear description during his testimony. Justice Urmila Joshi Phalke, presiding over the single-judge bench, noted that there was no substantial evidence to support the conviction, observing that the survivor could not confirm the identity of the accused and that no medical evidence of sexual assault was presented. The survivor, during the district court trial, had stated that the assailants had their faces covered with scarves during the incident. Additionally, the victim's friend, the only other witness present at the time, also failed to identify the accused in court.

1 2 3 Chandigarh: In a decisive move to enforce the directives of the Punjab and Haryana high court and protect Sukhna catchment area, a demolition drive was successfully carried out in the periphery of Kaimbwala village on Tuesday. The operation was initiated under the orders of the deputy commissioner. The demolition was executed with the help of two poclain machines and one JCB, and was supported by a strong police presence, including lady constables. The entire operation was conducted under the close supervision of SDM central, UT. During the drive, approximately 20 unauthorised commercial shops and showrooms, nine tin sheds, one boundary wall, and two khokhas were demolished. The operation was completed peacefully and without any incident. This action was taken in strict compliance with the orders issued by the HC, which mandates the preservation of the Sukhna catchment area to help restore Sukhna Lake to its original state. The court has prohibited the development of housing colonies or any construction activity within this ecologically sensitive zone. It has also empowered enforcement agencies to halt ongoing constructions and demolish any unauthorised structures without prior notice. The Supreme Court has reinforced that no construction is permitted in this area after May 21, 2012. Any violations will result in immediate action against the offenders.
