Delhi HC denies bail to Kapil Wadhawan in Rs 34,615-crore bank fraud case

The Delhi High Court has denied bail to Kapil Wadhawan, former chairman of DHFL, in connection with a Rs 34,615-crore bank loan fraud case. The court cited the seriousness of the allegations, Wadhawan's central role in the conspiracy, the risk of witness tampering, and the magnitude of the funds siphoned off as reasons for the denial. Tired of too many ads? Remove Ads Tired of too many ads? Remove Ads The Delhi High Court Monday rejected a bail petition filed by Kapil Wadhawan , former chairman of the erstwhile Dewan Housing Finance Corp in a Rs 34,615-crore bank loan fraud Ravinder Dudeja said that having regard to the nature and seriousness of the allegations, the gravity of the offence, Wadhwan's 'central role in the conspiracy, the potential adverse impact of his release on the trial and the huge magnitude of the funds siphoned of, this court finds no merit in the present (bail) application.'The court cannot permit the release of a person who is prima facie the mastermind of a deep-rooted financial fraud, especially when the trial is at a nascent stage, the judge said, adding that if released on bail, Wadhwan 'may tamper with the evidence or worse flee from justice. Many of the witnesses in this case are stated to be either ex-employees or associates of DHFL and as such there is a high risk and possibility that the petitioner might try to influence the witnesses.'The judge said that economic offences of such magnitude not only destroy public confidence in the financial system but also eat away the economic foundation of society. 'They require a firm judicial response guided by the rule of law and public interest. The applicant has failed to make out a case for bail. The application is accordingly dismissed,' the order court noted that Wadhawan was 'summoned by ED where he did not appear on pretext of Covid-19, while he was caught with his entire family and entourage during complete lockdown and FIR was registered against him.'Besides, the conduct of Wadhawan during custody has not been beyond reproach, according to the HC. 'The allegations regarding manipulation of valuable assets and transactions carried out during judicial custody are grave and suggest that the applicant continues to exercise significant control and influence,' according to the January 24, the Supreme Court had cancelled the default bail granted to Dheeraj and his brother Kapil Wadhawan on the grounds that the HC and the trial court had 'greatly erred' in granting default bail to to a FIR based on a complaint by Union Bank of India , the Wadhawan brothers and other had allegedly entered into a criminal conspiracy to cheat a consortium of 17 banks. The accused persons induced the consortium to sanction loans aggregating to Rs 42,871.42 crore. It was found that the accused persons "siphoned off and misappropriated" a significant portion of these funds by "falsifying" the books of the DHFL and dishonestly defaulted on repayment of the legitimate dues of the said consortium banks, thereby causing a loss of Rs 34,615 crore to the consortium lenders. So far, this is the largest banking loan fraud in India.

Move over incentives, time for 'soft' mandates on EVs: Niti Aayog

After a slew of programmes to facilitate electric vehicle (EV) adoption in India, the central policy think tank Niti Aayog has now recommended that the government has done enough on incentives. It is now time to take the programme a step further with 'strong signals' through regulations and mandates. 'While over Rs 40,000 crore has been spent by way of incentives over the last 10 years, it has only reached a level where 7.6% of annual vehicle sales are electric. It is evident that continuation of incentives alone may not help reach the target of 30% EV sales in the next five years. As such, it is time to give a stronger push for the shift by introducing some gentle mandates and disincentives which will help signal the required direction more firmly. These could be over and above the incentives that currently prevail,' Niti Aayog said in its report, Unlocking a $200 Billion Opportunity: Electric Vehicles in India, on Monday. The Aayog has recommended that the government announce a clear policy, with target timelines, for Zero Emission Vehicle (ZEV) adoption and design a progressively more stringent plan for mandating the production and purchase of EVs, while disincentivising the continued use/production of internal combustion engine (ICE) vehicles. It also sought a mechanism for effective implementation and expansion of Corporate Average Fuel Efficiency (CAFE) norms to a wider segment of vehicles. In his address, Niti Aayog Member and former cabinet secretary Rajiv Gauba emphasised that the mandates should be "soft," as the government does not want to cause disruption. The Aayog suggested that the initial mandates be limited to certain segments of the vehicle fleet and should not be extremely stringent at first to avoid backlash. 'Apart from pushing a certain segment towards EV, they would signal a strong direction and nudge speedier action. They should become progressively more stringent, and have wider application over time,' it said. The think tank recommended starting with vehicles like public transport buses, para-transit vehicles, government vehicles, and the rapidly increasing number of urban freight vehicles. 'These are fewer in number and would be easier to manage, besides offering higher public benefits. Limiting mandates and disincentives to such vehicles to begin with may not attract opposition but would, at the same time, signal the future direction for all,' it said. On demand-side mandates, the Aayog recommended a certain share of the fleet be zero-emission vehicles, stringent vehicle emissions standards, higher registration fees for ICE vehicles, and higher taxes on ICE fuels. It also advocated for a certain share of the production to be ZEVs, setting stringent emission standards for all vehicles manufactured, and a higher input price for ICE vehicles. In other measures to boost EV adoption, Niti Aayog recommended that the government focus on a subset of the vehicle fleet, based on the potential benefits from transitioning such vehicles to electric and the ease of providing the required ecosystem for them. Additionally, it sought the adoption of model cities to focus on saturation in limited geographies rather than on an even distribution across the country. It also suggested enabling finance for e-buses and e-trucks, focusing on services delivered rather than assets procured, shifting capital costs to operating costs, scaling R&D on new battery technologies, strategically scaling charging infrastructure, and enhancing awareness and information systems.
