Fuel levy increase confirmed as EFF's urgent application is dismissed

The 4% fuel levy increase is set to take effect on Wednesday after the Western Cape High Court dismissed the EFF's urgent application to interdict the fuel levy increase.
The EFF had filed a Notice of Motion, challenging the Minister of Finance Enoch Godongwana's decision to increase the general fuel levy.
They sought to have the application heard as an urgent matter, dispensing with the usual requirements for forms and service on Tuesday.
The party through Advocate Mfesane Ka-Siboto had argued that the increase would unfairly burden the working class and poor, worsening inequality and violating constitutional rights.
He said the minister's decision lacked both rationality and parliamentary oversight.
Ka-Siboto further told the court, in accordance with the Money Bills Amendment Procedure and Related Matters Act, only a law could serve as the proper instrument for the minister to impose a tax.
The EFF claimed that Godongwana overstepped his powers by announcing the fuel levy increase in his Budget speech, without parliamentary approval.
"What is clear is that the minister is imposing tax," Ka-Siboto said, citing the Money Bills Amendment Procedure and Related Matters Act as the legal framework Godongwana should have followed.
The EFF also argued that the fuel levy increase is both economically unjust and unconstitutional, deepening inequality and undermining access to essential goods and services.

"It deepens inequality and undermines access to essential goods and services. We are committed to fighting the fuel levy increase in court and in parliament," the party said.
However, Treasury senior counsel, Advocate Kameel Premhid, argued that the fuel levy increase is not a tax but rather a regulation change.
Premhid maintained that the minister has always had the power to adjust fuel levies as part of the budgetary process.
Premhid told the court that the increase is not a tax but a regulation.
"Regulatory charges bring in money, so they might raise revenue. But that doesn't make it a tax, and just because a tax also raises revenue, the two are not the same thing."
The Western Cape High Court's dismissal of the EFF's bid means the fuel levy increase will go ahead as planned.
The increase will see diesel prices rise by 15 cents per litre and gasoline by 16 cents per litre.
The EFF may still pursue its challenge to the fuel levy increase in Part B of its application, which seeks to review and set aside Godongwana's decision.
EFF National chairperson, Noluthando Nolutshungu, said the fuel levy increase is expected to have significant economic consequences, particularly for low-income households and businesses already struggling with high living costs.
She warned that the increase would place an "unjust burden" on the working class and the poor, who are already reeling from rising living costs, stagnant wages, and ongoing economic hardship.
The party has vowed to continue challenging the decision in court and in Parliament.
Despite the setback, the party says it remains committed to fighting for the rights of the poor and working class, who they believe will be disproportionately affected by the hike.
The EFF argues that the increase is unlawful.
Reacting to the dismissal, EFF Treasurer General Omphile Maotwe said the party approached the courts in defence of the poor and working class.
"The party will study the judgment and consider further legal action. Additionally, the EFF plans to introduce amendments to relevant legislation to prevent the National Treasury from imposing taxation without parliamentary approval," Maotwe said.

Malema lambasted the dialogue using money, which the government does not have, yet people do not have services needed. 'While it was disorganised, it was just government elite that was all over the place. It really did not serve any purpose. If anything, it was saving the egos of certain people, and therefore it was a waste of money. 'NGOs and people who participated in that preparations suggested that it must be postponed, because they are not ready only to go and embarrass themselves the way they did. 'We don't support this convention. We don't support the national dialogue. We know the demands of our people. We cannot spend R700 million of the money that we don't have. Our people need services, they don't want the talks, they are tired of talking,' said Malema. The National Dialogue kicked off on Friday at UNISA in Pretoria, despite the withdrawal of former President Thabo Mbeki, several legacy foundations, Government of National Unity (GNU) partners, and civil society organisations. The Economic Freedom Fighters (EFF) leader Julius Malema has denounced the National Dialogue, calling it a waste of state resources. Malema made the remarks on Saturday during the Siyabonga rally in Seshego, Polokwane, Limpopo, where the party celebrated its by-election victory in July. The EFF won the ward 13 by-election with 57% of the vote, while the African National Congress (ANC) secured 39%. Malema accused the government of ignoring community challenges while wasting millions on the National Dialogue. 'It served no purpose. It only protected the egos of certain people, and it wasted money. NGOs and other participants told organisers to postpone because they were not ready, but they went ahead and embarrassed themselves. We don't support this convention, and we don't support the National Dialogue. We already know what our people demand. Government cannot waste R700 million that it does not have,' Malema said. Malema expressed confidence that the EFF will win more votes in Limpopo during the 2026 local government elections. 'We are ready to win wards in Bela Bela and across Limpopo. Mayibongwe Maqhina | Published 2 weeks ago Parliament has named the MPs that will serve on the Ad Hoc Committee tasked with investigating the serious allegations made by KwaZulu-Natal police commissioner, Lieutenant-General Nhlanhla Mkhwanazi. This comes almost a week after the National Assembly unanimously resolved to establish the committee after adopting the report from the portfolio committees on Police and Justice and Constitutional Development, which made the recommendation. The committee will be constituted by 11 members, with four members from the ANC, two each from the DA and the MK Party, one member from the EFF, and two representatives to be recommended by other parties. Parliamentary spokesperson Moloto Mothapo said on Thursday that parties have nominated MPs who will serve on the committee. The ANC has nominated its chief whip, Mdumiseni Ntuli, Khusela Sangoni-Diko, Soviet Lekganyane, Xola Nqola, as full members, with Thoko Khanyile as an alternate member. The DA has fielded Ian Cameron and Glynnis Breytenbach as full members, while Diane Kohler Barnard and Lisa Schickerling are alternate members. The MK Party is represented by Sibonelo Nomvalo and David Skosana, with Vusi Shongwe as an alternate member. EFF leader Julius Malema will represent the EFF, and Leigh-Ann Mathys is an alternate member. The small parties are represented by IFP's Albert Mncwango and Patriotic Alliance MP Ashley Sauls. Freedom Front Plus MP Wouter Wessels and ActionSA's Dereleen James are alternate members for the small parties. The committee has until October 31 to report to the National Assembly. The committee's terms of reference include the alleged unlawful decision by Police Minister Senzo Mchunu to disband the Political Killings Task Team. It will also examine the alleged unlawful removal of 121 case dockets from the Political Killings Task Team on the direction of Deputy National Commissioner Shadrack Sibiya and the alleged moratorium by Mchunu on filling vacancies within the SAPS Crime Intelligence Unit. The committee will also scrutinise the nature and the implications of the relationship between SAPS senior leadership and certain members of the public. It will also probe whether the awarding of the R360 million contract to Vusumuzi Matlala's company for the provision of healthcare services to SAPS was irregular. The alleged interference by the Investigative Directorate Against Corruption in police matters, including judicial issues, will form part of its focus, as well as consider the need for legislative policy and institutional reform to restore public confidence in the criminal justice system.
