
Over 600 receive land titles in Ranau

RANAU: Over 600 villagers received land titles at the Sabah Native Land Grant Presentation Ceremony (Pantas) here on Tuesday. The presentation ceremony was done by Assistant Minister to the Chief Minister of Sabah Datuk Abidin Madingkir, who is also Pagigatan Assemblymen, who described the event as historic for his constituents. 'Land titles are very valuable assets and will be enjoyed by generations to come.' 'It's my priority to work on issuing these titles and we are grateful because we have the Assistant Land Revenue Collectors (PPHT) who is very committed in helping,' he said. Abidin said that the next Pantas land titles will be handed over in Kg Narawang, Waluhu and Lutut in the near future. According to him, the Pantas Program is an initiative of the Gabungan Rakyat Sabah (GRS) government apart from other programs such as Syukur, human capital development programs and so on. 'The government has allocated RM20 million to fund the Pantas Program throughout Sabah. This is among the government programs under the direction of SMJ Development 1.0. All of them are programs to improve the well-being of the people. 'I call on all residents of Kg Sagindai and Kg. Sungangon to continue to give unwavering support to the GRS Government and give a fresh mandate to the GRS Government so that the SMJ 2.0 Development Plan can be continued after the PRN17,' he said. Ranau PPHT, Jaidi Adrian Gulis said, the historic program in Kg. Sagindai Lama, Kg. Sagindai Baru and Kg. Sungangon all came about as a result of Abidin's initiative. 'Due to the lack of land surveying in Kg. Sagindai and due to the problem of overlapping land applications, in 2019, Abidin requested that the Pantas Survey Program be implemented in Kg. Sagindai Lama, Kg. Sagindai Baru and Kg. Sungangon. 'He was willing to give RM10,000 as an initial fund so that this program could be launched in all three villages. 'Despite the initial objections, now the map of Kg. Sagindai has been filled with titled lands that have been surveyed,' he said. He added that on October 18, 2024, the Prime Minister of Malaysia, Datuk Seri Anwar Ibrahim, performed the gimmick of handing over the Pantas titles, and on February 25, 2025, the handover was officially completed by Chief Minister Datuk Seri Hajiji Hj Noor. According to him, the total number of land titles that have been issued and will be handed over to the recipients is 650 for the three villages, namely Kg. Sagindai Baru, Sagindai Lama and Kg. Sungangon. In the meantime, Implementing Chairman, Roslan Sakandal, thanked him for finally having the opportunity to have a land title through the efforts of the People's Representative and also the Ranau Land and Survey Department. He represented the residents, expressing his gratitude for the continuous efforts of Abidin and also the Ranau Land and Survey Department for successfully realizing our dream of owning a land title. Village chief, Didimus Jain, thanked the government for the commitment to realize the management of land grant issuance. High Court affirms father's right to access despite maintenance arrears
KUALA LUMPUR: A father's failure to pay child maintenance should not prevent him from having access to his children, the High Court has ruled. Judge Evrol Mariette Peters said it was important to draw a clear distinction between the issues of maintenance and access, emphasising that they are legally and conceptually separate. She said that if the father had indeed defaulted on maintenance payments as ordered by the court, the mother had legal recourse through committal proceedings. Peters said this during a committal proceeding initiated by a 45-year-old man (the petitioner) against his former wife (the respondent), after she denied him access to their 11-year-old son and unilaterally moved the child to Singapore. The court ruled in favour of the petitioner and imposed a RM20,000 fine on the respondent for contempt of court. According to court documents, the petitioner claimed he had been denied access to the child and had not been provided with any information about the child's whereabouts or well-being since January 2022. It was later discovered that the respondent had relocated and unilaterally moved the child to Singapore, where they were both currently residing. The respondent claimed that the child had expressed unhappiness and refused to meet the petitioner. However, Peters said her judicial interview with the child revealed that the child's perspective was not entirely autonomous, as the responses lacked spontaneity and depth. "The child appeared to echo sentiments that seemed rehearsed or externally influenced. "He was unable to offer any substantial or cogent reasons for his refusal to have contact with the petitioner. "Instead, his justifications centred around relatively minor grievances and a few isolated incidents that he claimed had occurred several years ago," she said in her grounds of judgment dated June 4. Peters said the dynamics of a relationship between a father and child differ from those with the mother. "Parties must be reminded that the role of a father is to ensure that a child is raised in a nourishing environment. "In my view, the child's continued clinging to his mother's influence, to the exclusion of meaningful contact with his father, was not a healthy dynamic. "It is important for the child to benefit from balanced parental input, including the presence of a consistent and positive male role model. "Exposure to both maternal and paternal guidance serves not only to enrich the child's emotional development but also to foster a more balanced and resilient sense of identity," she said. The court said denying the child that opportunity based solely on his current attachment to his mother would not serve his long-term interests and could risk perpetuating a narrow and emotionally limiting environment. "In the present case, there was also no evidence before the court to suggest that the petitioner had ever been abusive, neglectful or otherwise unfit to have contact with the child. "In light of this, I was of the firm view that it was in the best interest of the child's welfare for the petitioner to continue having access."

RANAU: The 10th anniversary of the Mount Kinabalu earthquake that claimed 18 lives in 2015 was commemorated at Kinabalu Park on Thursday, marking a day of remembrance and reflection for those affected by the tragedy. Sabah Parks Trustees Board Chairman Peter Lintar said while the pain remains, the event spurred significant reforms in mountain safety and disaster response throughout the decade. He paid tribute to the victims - climbers, mountain guides and young adventurers - and acknowledged the enduring grief of their families while commending their strength and resilience. Peter also expressed deep appreciation to mountain guides, porters, rescuers, volunteers and locals whose sacrifices inspired long-term safety improvements, including the formation of Mosar and enhanced rescue protocols. [UPDATED] High Court rejects Anwar's bid to refer constitutional questions to federal court [WATCH]
KUALA LUMPUR: Prime Minister Datuk Seri Anwar Ibrahim has failed in his bid to refer eight constitutional questions to the Federal Court regarding the legal provisions on the immunity of a sitting prime minister. High Court Judge Roz Mawar Rozain dismissed the application, ruling that it did not meet the requirements under Section 84 of the Courts of Judicature Act (CJA). "Having considered the affidavits, the eight proposed questions, and submissions of all parties (both written and oral), this court is not satisfied that the statutory threshold under Section 84 of the CJA is met. "The questions posed are speculative, not necessary to the disposal of this case, and do not concern the interpretation or validity of any constitutional provision," she said in her decision. Anwar's application is linked to a sexual assault lawsuit filed against him four years ago by his former research officer, Muhammed Yusoff Rawther. The trial is scheduled to begin on June 16. Roz Mawar said the proposed constitutional questions failed to meet the statutory threshold under the section, and that not every question referencing the Federal Constitution warrants referral. "The Federal Court is not a forum for speculative advisory opinions. "Furthermore, the defendant (Anwar) has affirmed readiness to proceed with trial and there is no evidence that the suit impairs his ability to perform constitutional duties. "This court finds no special circumstances warranting a stay of proceedings," she said. Roz Mawar awarded RM20,000 in costs to Yusoff Rawther. She also ruled that the June 16 trial will proceed. After the proceedings, Anwar's lawyer Datuk Seri Rajasegaran Krishnan said they will file a notice of appeal at the Court of Appeal. On May 23, Anwar applied to the High Court to refer eight legal questions to the Federal Court, which included whether he possesses immunity from a civil suit filed by Yusoff. Anwar had sought the apex court to rule whether Articles 5,8, 39,40 and 43 of the constitution grant him qualified immunity from Yusoff's suit. Yusoff had filed the suit before Anwar became prime minister on Nov 24, 2022. Anwar had asked the court to decide whether Yusoff's suit would impair the effective discharge of his executive duties and undermine the constitutional separation of powers. Anwar had also requested the court to consider whether the lawsuit impacts his ability to carry out executive duties and undermines the principle of separation of powers guaranteed by the constitution. Previously, Anwar's senior political secretary Datuk Seri Shamsul Iskandar Mohd Akin had said there was no attempt in the application to seek absolute immunity. He said Anwar's application to the Federal Court is a lawful process to seek clarity from the court on his position in carrying out official duties when facing a civil suit based on claims that precede his appointment as prime minister. Shamsul Iskandar had said the issue is whether such civil action could interfere with the efficiency of a prime minister in carrying out the executive functions of the state. He had said it is a legitimate and lawful matter to be referred to the Federal Court, the highest judicial institution in the country, with the jurisdiction to interpret the constitution fairly and objectively.
