Office of Open Records orders Cambria County to search again for 2024 election failure
The state Office of Open Records ruled that the county's original reason for denying Burns' records request, citing a noncriminal investigation, was not valid, requiring the county to either provide the documents or legally attest that they do not exist.
Burns requested any documentation explaining the nature of the voting machine malfunction that led to ballots going unscanned and unaccounted for, as well as a tally of how many ballots were successfully or unsuccessfully scanned on Election Day.
The Nov. 5, 2024, issue reportedly involved voting machines that had passed pre-election testing but failed when used, prompting concerns from voters and lawmakers alike. Burns has continued to push for transparency surrounding the incident, stating that the public still has no clear explanation for what went wrong or how many ballots were impacted.
In response to an inquiry from WTAJ, Cambria County's solicitor, Ronald Repak, provided a statement acknowledging the OOR ruling and outlining the four key parts of the decision.
According to the county, the OOR deemed one of Burns' requests moot after the county turned over the logic and accuracy testing records. The OOR also denied Burns' request for a finding of bad faith, instead stating, 'The County has been timely, attentive, and professional in both its responses to the Requester and to the OOR and has made serious attempts to provide the Requester with the information he is seeking.'
The county confirmed the OOR did grant Burns' request for the number of ballots that failed to scan, which officials say occurred because the ballots did not include TIS (timing) marks required by the tabulation system. The county said this issue affected all ballots when polls opened.
Additionally, the OOR granted Burns' request for documentation explaining the nature of the problem. The county reiterated it has repeatedly said the mistake was due to a clerical error by a county worker who uploaded ballots to the system without the necessary marks. Officials said there was no malicious intent.
'The County has no issue with completing another search to answer questions which the County has already gone to great lengths in answering,' Repak stated.
The OOR has given the county 30 days to provide Burns with the relevant records or a sworn statement that they do not exist.

The change means that those attempting to request a vote-by-mail ballot online will encounter error messages if their driver's license information is out of sync with their voter registration. In-person voting is not affected by the new license changes. But Duval County Supervisor of Elections Jerry Holland told Action News Jax that petitions could also be affected. "If you don't update your registration info and use your new license number on a petition, it can't be counted. So that's where you do want that update prior to putting your new number on a petition form," he said. The Florida DMV said the update was designed to make driver's licenses more secure. The new licenses feature an updated two-digit number within the license number that corresponds to the holder's birth year. The Supervisor of Elections Office, which has been sharing guidance about the change through newsletters and press releases, plans to send postcards as Election Day approaches to remind residents to verify and update their voter registration details. When updating a driver's license, voters should check the box indicating "yes" to update their voter information, even if no other changes are being made. This simple step can prevent problems on Election Day. Holland said he had asked the state whether it would eventually automatically advise election supervisors when a voter's driver's license number changed and that he expected an answer by Monday. ‘Friends Until the End' Review: Left, Right and the Revolution
The political use of the words 'left' and 'right' first emerged when the French Estates-General met in 1789. The clergy and nobility sat to the king's right, the 'third estate'—the commoners—to his left. The former sought to preserve the monarchy, the latter in effect to abolish it. Left and right took shape far more gradually in the Anglophone world, but there, too, the French Revolution precipitated the rift. Or so I reflected on reading 'Friends Until the End,' James Grant's account of the long-enduring political alliance and friendship between the British statesmen Edmund Burke (1729-97) and Charles James Fox (1749-1806). Burke is commonly thought of as the father of modern conservatism, though the term 'conservative' wasn't in currency in his day; whereas Fox is remembered as one of British history's great liberals, especially on account of his eloquent opposition to the slave trade and crucial role in abolishing it. In fact, both Burke and Fox can fairly be called liberals. They both advocated religious toleration and reform to the penal laws in Ireland. Both sought freer commerce between nations, a more humane criminal code and a conciliatory policy toward the American colonies. Both inveighed against the abuses of India's native population committed by the East India Co. And both, though royalists by conviction, believed the crown's furtive influence on Parliament—handing out preferments and sinecures and so on—was baleful. That their 22-year friendship shattered in 1791, publicly and irrevocably, grieved them both. But anyone who knew the two men's feelings about what was then happening in Paris—Burke made his thoughts known in his masterpiece, 'Reflections on the Revolution in France' (1790)—must have seen it coming. But apart from their Whiggish leanings and wide learning, the two had little in common. Fox was born in London and came from wealth and political prestige. 'The plays in which he had acted, the poetry he had memorized, and the Latin and Greek he had translated,' writes Mr. Grant of Fox, 'made up the intellectual capital on which he would build his reputation as Burke's rival for the unconferred title of the greatest political talker of the age.'
