The Democratic Alliance (DA) has filed an application in the Pretoria high court challenging the employment equity quotas in the Employment Equity Amendment Act which it says are merely 'racial exclusion under a new name'.

The Democratic Alliance (DA) has filed an application in the Pretoria high court challenging the employment equity quotas in the Employment Equity Amendment Act which it says are merely 'racial exclusion under a new name'.
It sets hiring quotas for 18 economic sectors, from mining and transport to construction and agriculture, in a bid to increase employment opportunities for 'designated groups' including blacks, women and people living with disabilities.
Companies with 50 or more employees must align their employment equity plans with the new sector-specific targets and these must be implemented between 1 September 2025 and 31 August 2030.

The law is one of several pieces of legislation and policies the government has implemented since the fall of apartheid in 1994 in what it says is a drive to reverse the racial inequalities which favoured white people.
'We are taking the minister of employment and labour to court because Section 15A represents a radical and harmful departure from previous employment equity law. These quotas will destroy jobs, undermine the economy and violate the constitutional rights of all South Africans,' Bagraim said.

'Where companies once set their own equity goals, based on context and the available labour force, they are now compelled to meet government-imposed demographic targets, regardless of skills, local realities or business viability,' Bagraim said.
'It is about protecting people's rights under the Constitution, the rule of law and the livelihoods of South Africans. The DA believes that real redress does not mean implementing policies that bring more division. We believe that true transformation can only be achieved by focusing on inclusive economic growth that creates opportunity for all.'
He said the legal argument against the amendment was two-fold, focusing on 'constitutional invalidity' and 'abuse of state power'.
'Section 15A violates Section 9 of the Constitution, which guarantees equality before the law and prohibits unfair discrimination. A law that forces employers to fire or refuse to hire people based on race, whether they are black, coloured, Indian or white, is not redress. It is unconstitutional discrimination,' Bagraim said.
He added that the minister's powers under Section 15A were 'vague, unchecked and dangerously broad'.

Bagraim said the government had 'tacitly' admitted that the quotas were damaging by exempting businesses with fewer than 50 employees.
'Our court action will expose the real issue — the problem is not the quotas themselves but the law that enables them. That is why we are challenging Section 15A directly, not just quotas that flow from it. Every law must be judged on whether it grows the economy and creates jobs. These quotas fail that test spectacularly.
'We are standing up for the right of every South African to be employed on the basis of their skill, character and contribution — not the colour of their skin. And we will not stop until this unconstitutional law is overturned.

Image: BackpagePix The Ahmed Kathrada Foundation (AKF) has slammed Minister of Sports, Arts and Culture, Gayton McKenzie, for threatening to shut down it and other civil society organisations. McKenzie made these remarks in a recent interview with the Paris-based English-language quarterly magazine, Africa Report, where he was speaking about the Afrikaner's resettling in the United States, xenophobia and his 2029 leadership vision. McKenzie recently sparked controversy by calling for the dismissal of foreign nationals working in departments under his authority, with many including the AKF and other prominent civil society organisations, criticising him for being xenophobic. During the interview, McKenzie told Africa Report that he would get rid of illegal foreigners and he would close down charities that are anti-government, adding that the country needs patriotic charities. When asked if that included AKF, McKenzie said the foundation is a disgrace to the memory of the anti-apartheid activist, adding that he had never heard them speaking about the poorest of the poor not having jobs. The foundation said these comments are a direct attack on the values of the country's democracy, the rule of law, and the rights of civil society organisations to operate freely in South Africa. 'Minister McKenzie's contempt for our Constitution and the rule of law is serial and sinister. His most recent threats follow the equally dangerous and unlawful directive he issued earlier in May, instructing the dismissal of all foreign nationals employed in entities within his department, under the threat of firing the CEOs of those entities. "These actions were, and remain, entirely without legal foundation and constitute a clear violation of both South Africa's Constitution and its labour laws,' said the foundation. 'It is not just the threat to shut down the AKF that we resist, but the broader pattern of Minister McKenzie's abuse of power. He tells us without shame and repeatedly that a government in which he holds office is one in which his personal whims should hold sway rather than the democratic principles he is sworn to defend,' the foundation said, adding that his actions are not just unlawful, they are dangerous to the social cohesion, stability, and growth of our country. The foundation accused McKenzie of seeking to justify his illegal actions under the guise of advocating for the poor. "A Minister who abuses his power and disregards the Constitution cannot credibly claim to be serious about addressing the very real and grave issues of unemployment, poverty, and inequality in our country. A Minister who actively seeks to alienate the residents of those markets in which our goods, services and industry must find uptake is not a Minister serious about creating jobs or economic growth.' The foundation said the real threats to South Africa's future are not the civil society organisations that speak out against harmful, fact-free policies. Nor are they from those foreign nationals lawfully present in South Africa. It said the true threats are those who, like Minister McKenzie, actively undermine the rule of law, sow divisions and pursue populist agendas at the cost of the common good. 'We call on President Cyril Ramaphosa, the Cabinet, and all responsible authorities to distance themselves from Minister McKenzie's harmful rhetoric and actions. His threats to close organisations like the AKF- whose record speaks for itself and which exists to uphold the values of justice, equality, and democracy- must be rejected in the strongest terms," the foundation said. McKenzie spokesperson, Stacy-Lee Khojane, said the Minister had attended the Comrades Marathon in KwaZulu-Natal on Sunday and was not available to respond. However, shortly after the release of the AKF statement on Friday, McKenzie reaffirmed his stance, saying illegal foreigners in South Africa are protected by very powerful foundations, the media and law societies. This is as the political parties are gearing up for the 2026 local government elections. In an interview with IOL, Zille confirmed that she has been approached to become the DA's mayoral candidate, but she is in talks with her family regarding accepting the nomination. 'I have been approached to put my hat in the ring for mayor. I am still considering it and consulting my family,' she said. Although no deal was reached, Zille said they have been head-hunting candidates for over a year, with potential ones showing interest. However, she said some potential candidates have said they cannot do the job for the remuneration offered to a mayor. 'If I decide to run, I will have to go through the same gruelling selection process as everyone else,' she said. The Democratic Alliance (DA) in eThekwini has demanded that Mbhele be placed on immediate suspension and referred to the Financial Misconduct Board. This demand comes in the wake of a Constitutional Court decision that dismissed the municipality's attempt to overturn a prior ruling, which held it liable for R30 million in damages. The damages stem from the municipality's 2013 decision to cancel contracts with Daily Double Trading 479CC. Courts previously ruled that the cancellation was unlawful, and the municipality's latest bid to appeal was dismissed this week by the Constitutional Court, which found it had no reasonable prospects of success. Lawyers for Daily Double Trading have given the City five days to pay or risk having their assets seized by the sherrif of the court to the value of the judgement. 'The DA believes that, as the head of the city's administration, Mbhele has a duty to safeguard public funds and not act recklessly when ratepayers' money is at stake. The party believes that his conduct in this matter warrants a formal investigation by the Financial Misconduct Board and that he should be suspended from his duties pending the outcome. He had every opportunity to comply with previous court orders related to this matter but refused to, thereby wasting public funds defending an indefensible position," said councillor Thabani Mthethwa in a statement.
