Mumbai: Almost a year after issuing a letter of acceptance to the contractor, the BMC has obtained an NOC from the Union environment ministry for the proposed Madh-Versova bridge.
The civic body now has to seek approval from the Bombay High Court, as the project will impact 2.3 hectares of protected mangroves -- a mandatory step for any construction in ecologically sensitive zones.
"The exact number of mangroves affected is yet to be determined. Once all approvals are in place, the work order will be issued," a BMC official said. The total contract cost stands at Rs 2,395 crore, comprising Rs 1,990 crore for civil works, Rs 39.89 crore for operations and maintenance over three years, and Rs 365.36 crore as GST (18%).

he planned cable-stayed flyover will span 2.06 km, connecting Madh island to Versova by crossing over the Madh creek. Currently, the two areas are linked by a ferry service, with no direct road access. Motorists must take lengthy detours via Link Road, SV Road or Western Express Highway, often facing travel times exceeding 45 minutes during peak hours. The bridge is expected to cut commute times by 40 to 60 minutes.

Environmentalists have voiced strong objections, citing the destruction of natural stormwater buffers. Advocate Godfrey Pimenta said, "In the 1991 Development Plan, this was designated as a no-development zone (NDZ). However, the 2034 DP introduced a road network that includes the Madh-Versova bridge. This move will systematically destroy natural habitats and will burden local infrastructure beyond its capacity.

Hubballi: After more than 15 years since its establishment, Karnataka State Law University (KSLU) in Hubballi is set to have its own dedicated administrative building. The construction of the G+3 structure is under way on 2.4 acres, at an estimated cost of Rs 39.5 crore. The building is expected to be completed by May 2026. KSLU, established in Jan 2009, currently operates from a former PWD guest house that was repurposed into an administrative office. Spread over a 55-acre campus, the university offers undergraduate and postgraduate courses in constitutional law, intellectual property rights, business and trade law, criminal law, and international law. While around 1,200 students study on the campus, the university has a total student strength of approximately 45,000 across the state. The total built-up area of the four-storey structure will be 94,761 sq. ft. The ground floor will be 24,440 sq. ft, first floor 20,321 sq. ft, second floor 22,255 sq. ft, and third floor 20,321 sq. ft. The second floor will accommodate the finance section, ICT section, syndicate zone and cabins, student welfare and development section, academic zone and toilets. New Delhi: Chief minister Rekha Gupta has asked the public works department to submit the revised estimated cost for the Barapullah elevated road project to get it approved by lieutenant governor VK Saxena. The department has already spent nearly Rs 1,239 crore on the project against the sanctioned amount of Rs 1,260 crore, while a portion of the road measuring 690 metres is yet to be built. The overall cost of the 3.5-km road, connecting Sarai Kale Khan in the west of the Yamuna with Mayur Vihar in the east, is expected to exceed the sanctioned amount. The additional chief secretary of the finance department observed at the meeting of the expenditure and finance committee last week that approval was being sought only for the arbitration award of Rs 175 crore, due to the delay in completing the project. Though the elevated road was to be completed by Oct 17, 2017, the project was delayed because govt failed to acquire a portion of land owned by private individuals. The case went into arbitration, leading to an award of Rs 120 crore in favour of the contractor. The amount eventually increased to Rs 175 crore, with interest and goods and services tax added to it. To enforce the award, the contractor filed a petition in Delhi High Court . Following the court's directions, PWD paid an amount of Rs 170 crore to the contractor. Gupta has asked the department to seek legal opinion on whether the arbitration order can be challenged now. The committee also deliberated that an inquiry was needed to ascertain the loss to the govt exchequer due to payment of arbitration awards without seeking the opinion of the law department and fixing responsibility for the erring officials. The chief minister last week ordered an inquiry by the anti-corruption branch for approval and acceptance of arbitration awards by authorities "not competent to accept" and delay in execution of the project.

Supreme Court mandates compensation for accidents during office commute

The Supreme Court has ruled that employees and their families will be entitled to compensation under the Employees' Compensation Act, 1923, not just for accidents occurring during the course of work but also for mishaps while commuting to and from their place of employment. The Supreme Court judgment came in a case involving Shahu Sampatrao Jadhavar, a watchman at a sugar factory in Maharashtra.(Vipin Kumar/ Hindustan Times) In a significant verdict broadening the scope of workers' rights and social welfare protection, a bench of Justices Manoj Misra and KV Viswanathan interpreted the phrase 'accident arising out of and in the course of employment' in Section 3 of EC Act to include commuting accidents, provided a clear nexus is established between the time, place and circumstances of the accident and the employment. This liberal interpretation, authored by Justice Viswanathan and delivered in a case involving the death of a sugar factory watchman on his way to work, is a progressive step in expanding the social security framework for millions of workers across India, especially those not covered under the Employees' State Insurance (ESI) scheme. 'We interpret the phrase 'accident arising out of and in the course of employment' under Section 3 of the EC Act to include accident occurring to an employee while commuting from his residence to the place of employment for duty or from the place of employment to his residence after performing duty,' the court said in its July 28 ruling. It clarified that the benefit of this interpretation is contingent on showing a clear nexus between the time, place and circumstances of the accident and the employment. That is, if a worker meets with an accident during a routine and timely commute to or from the workplace, it may qualify as employment-related for compensation purposes. The judgment came in a case involving Shahu Sampatrao Jadhavar, who worked as a watchman at a sugar factory in Maharashtra. His shift on April 22, 2003, was scheduled from 3 AM to 11 AM. While commuting to work in the early hours, his motorcycle met with a fatal accident around 5 km from the factory. He left behind his widow, four children, and his mother. A claim under EC Act was allowed by the commissioner for workmen's compensation and civil judge, Osmanabad, who awarded ₹3,26,140 as compensation along with 12% annual interest, and also directed the employer to pay 50% of the amount as penalty. The employer's insurance company was held liable to pay the compensation. However, the Bombay High Court reversed the award, holding that since the accident occurred outside the precincts of the factory, it could not be said to have arisen out of employment. Setting aside the high court's ruling, the top court restored the commissioner's award and reaffirmed that the commute to work can form an integral part of employment under EC Act if the contextual nexus is established. The court drew from Section 51E of ESI Act, which was introduced in 2010 and explicitly provides that commuting accidents, if there is a connection between the circumstances, time and place, are deemed to have occurred in the course of employment. While EC Act does not have such a specific provision, the top court held that since both statutes are beneficial legislation aimed at social welfare and worker protection, they are 'statutes in pari materia' (dealing with the same subject matter). Hence, the interpretation under one can inform the other. 'Both the EC Act and the ESI Act seek to ameliorate the conditions of workmen and provide them social security benefits,' stated the judgment, noting that EC Act applied to all other employers and employees not covered under ESI scheme. The court cited its own 2016 ruling in Jaya Biswal Vs IFFCO Tokio General Insurance Co to reaffirm that EC Act is a social welfare legislation, meant to secure minimum protection and compensation for workers, with reduced legal formality and regardless of fault.
