Minor seeks permission from Delhi High Court to abort pregnancy, HC asks report from AIIMS
New Delhi [India], June 28 (ANI): The Delhi High Court has directed a medical board constituted at the All india Institute of Medical Science (AIIMS) to examine a minor who seeks to abort her pregnancy.
Minor is a victim of sexual assault and is seeking permission to abort her 26-week pregnancy. She has approached the High Court through her mother.
Justice Manoj Jain directed the medical board to examine the minor and file a report. 'Keeping in mind the urgency cited, the above Medical Board is directed to conduct the necessary medical examination and to give the requisite report,' Justice Jain ordered on June 27.
Justice Jain also directed that such a report be transmitted to this Court in a sealed envelope on or before 30.06.2025, or in the alternative, the investigating officer of the case would be permitted to collect such a sealed envelope, containing the report, from the concerned medical board.
The matter has been listed for hearing on June 30. The court noted the fact that the petitioner is interested in the termination of the pregnancy, and it is in the aforementioned backdrop that she prayed that a medical board be constituted to submit an opinion on medical termination of pregnancy in terms of the Medical Termination of Pregnancy Act, 1971. She prayed to further direct her to medically terminate her pregnancy.
Advocate Anwesh Madhukar, counsel for the petitioner, submitted that the petitioner is not willing to continue with the pregnancy, and this sentiment has been echoed by her mother, who was present during the hearing.
It is also submitted that since pregnancy is a direct result of sexual assault, anguish caused by such pregnancy is required to be presumed as a grave injury to the mental health of the minor victim in terms of Explanation II of Section 3(2)(b) of the Medical Termination of Pregnancy Act, 1971. The Gujarat Government is committed to helping women build careers in the medical field and contribute meaningfully to healthcare as skilled doctors. To ensure that financial constraints do not hinder the medical education of Gujarat's aspiring female MBBS students, the Government of Gujarat has implemented 'Mukhyamantri Kanya Kelavani Nidhi Yojana' (MKKN). This scheme aims to provide financial assistance to bright female students pursuing MBBS. As a result, countless ambitious women across Gujarat are now proudly donning white coats and fulfilling their dreams. Under MKKN, Rs 772 Crore in Financial Assistance Provided to 25,768 Female Students to Pursue Medical Education Under MKKN Yojana, the Gujarat Government provides financial assistance to female students from families with an annual income of up to Rs 6 lakh who secure admission to MBBS after completing Class 12. So far, 25,768 female students across the state have received financial support amounting to Rs 772 crore to pursue their journey of becoming doctors. In 2024-25, the scheme had initially set a target of supporting 4,500 students with a budget of Rs 150 crore. However, 5,155 students have already been assisted, with disbursements reaching Rs 162.69 crore. It is worth mentioning that the Gujarat Government launched the MKKN scheme in 2017-18. Under this initiative, the state sponsors 50 per cent of the admission fee for girl students from families with an annual income of up to Rs 6 lakh, who secure MBBS admission based on their NEET scores. Importantly, this assistance is extended irrespective of the students' community background. Pratibhaben Chauhan from Jamnagar completed her MBBS education at Narendra Modi Medical College in Maninagar, Ahmedabad, and has now achieved her dream of becoming a doctor. Sharing her experience, she said, 'For middle-class families, pursuing an MBBS in a private college is not always a financially viable option. Despite getting good marks and earning a seat in a reputed college through the merit list, I was hesitant to take admission due to my modest financial background. However, through some senior doctors, I came to know about Mukhyamantri Kanya Kelavani Nidhi Yojana and applied for it. This scheme gave me the courage to go ahead with my admission at a private medical college and greatly eased our financial burden.' She added, 'During my four-and-a-half-year MBBS journey, I received a total of Rs 25,48,000 in financial assistance from the state government. Today, I have been able to fulfil my dream of becoming a doctor and am now preparing for my postgraduate studies. My family and I are sincerely grateful to the Government of Gujarat for this support.' From this scheme, many ambitious women like Pratibha across the state are realising their dream of becoming doctors. "Before 2014, AIIMS in Gorakhpur was merely a dream. Today, it is a major healthcare centre for people across eastern UP, northwestern Bihar, and parts of Nepal. It caters to the health needs of over five crore people directly and nearly seven crore indirectly," Yogi said. Reflecting on the journey, the CM said he fought from the streets to the Parliament for AIIMS. "I'm perhaps the only person on this stage who has witnessed AIIMS Gorakhpur's transformation from a seed to a banyan tree," he said. Delhi HC allows 16-year-old rape survivor to terminate 26-week pregnancy
The Delhi high court on Monday allowed a 16-year-old survivor of two separate sexual assaults to terminate her 26-week pregnancy, despite a contrary recommendation from medical experts at the All India Institute of Medical Sciences (AIIMS), New Delhi. Under the Medical Termination of Pregnancy (MTP) Act, abortions are legally permitted up to 20 weeks. (HT Archive) Calling the case 'unfortunate', justice Manoj Jain observed that the pregnancy, a result of sexual assault, had caused the girl 'grave mental injury and serious mental trauma'. 'The physical fitness of the minor is not in doubt, as this has been certified. However, AIIMS has expressed reservations about terminating the pregnancy. That said, it is not difficult for this court to understand the grave mental injury inflicted upon the minor. The situation is unfortunate,' the court said. The girl was allegedly assaulted twice by different men—once during Diwali last year and again in March. She did not reveal either incident until June 21, when a medical consultation with her sister confirmed that she was 26 weeks pregnant. She then informed her parents, following which an FIR of rape was filed. Given that the pregnancy had crossed 24 weeks—the legal threshold for termination in most circumstances—she approached the high court through her mother, seeking permission to terminate it. Under the Medical Termination of Pregnancy (MTP) Act, abortions are legally permitted up to 20 weeks. Following a 2021 amendment, certain categories of women—including survivors of sexual assault—may terminate pregnancies up to 24 weeks, with medical board approval. The law also permits courts to allow termination beyond 24 weeks in exceptional cases involving foetal abnormalities or serious risks to the woman's mental or physical health. The high court had on June 27 directed AIIMS to examine the minor and submit a report. On Monday, the court noted that while the AIIMS panel found the girl physically fit for the procedure, it advised against termination citing that even though she was physically fit to undergo the abortion, the procedure had the likelihood of adversely affecting her capability of conceiving in the future.. Nevertheless, acknowledging the psychological toll on the minor, the court directed AIIMS to proceed with the termination and asked the Delhi government to bear the costs of the procedure and post-operative care. 'Keeping in mind the overall circumstances and the fact that the minor is a survivor of twin sexual assaults, the petition is disposed of with the following directions: The medical superintendent, AIIMS, shall ensure the termination is carried out without delay, by a team of competent doctors, in line with the MTP Act and related guidelines,' the court said. It also directed that the foetus be preserved for DNA testing and further investigation into sexual assault case.
