The Federal Board of Revenue (FBR) has served 'nudging' notices to nearly 11,000 companies and individuals, advising them to fix anomalies in their last sales tax returns or be ready for consequences such as penalties, freezing of bank accounts, and sealing of businesses.
The notices were issued last month in the middle of negotiations between the business community and the government, underscoring the authorities' resolve to recover due sales and income taxes from individuals and companies.
FBR Chairman Rashid Langrial believes that existing taxpayers are paying far less than their due taxes. He has begun applying a risk management system to identify loopholes in the tax returns filed by these entities and individuals over the past five years. Sources said that in the first phase, about 11,000 nudging notices were served by corporate tax offices in Karachi, Lahore, and Islamabad. Traders in Karachi and Lahore also observed a strike last month against the government's decision to give arrest powers to the FBR and add back half of over Rs200,000 in cash expenses in income tax calculations.
When contacted, the FBR said these "non-intrusive and legally non-binding nudging notices" were served to encourage behavioural and social changes among taxpayers.
"Please correct anomalies in your sales tax return. Your failure to act will be viewed as a choice not to comply," cautioned the FBR in its notices to companies and individuals in Lahore. The FBR warned that failure to address anomalies and file accurate returns in the future could lead to financial penalties, placement of FBR staff within businesses for monitoring, and best judgment assessments by tax commissioners, which can result in heavy fines.
It also advised thousands of people that their bank accounts could be frozen and business premises sealed for non-compliance. Taxpayers were informed that the FBR used advanced data analytics to examine returns and benchmark them against peer businesses and jurisdictions. The analysis was fully automated without human involvement. The FBR said that for the tax years 2019 to 2024, its system identified anomalies in 2024 returns. These included unusually high sales claimed as exempt or under reduced-rate categories and low value addition based on the comparison of sales to purchases.
"To avoid enforcement actions, ensure that these anomalies do not reoccur in subsequent returns and file correct sales tax returns for the upcoming due periods," the FBR cautioned. Jawed Bilwani, President of the Karachi Chamber of Commerce and Industry (KCCI), criticised the FBR's decision to serve notices during ongoing talks. He said many KCCI members received notices without any prior awareness campaign.
Bilwani also criticised the FBR's method of comparing one shop's sales patterns with competitors', arguing that sales and value addition depend on brand and quality and are not uniform. "A customer may buy a shoe for Rs100 or Rs1,000. The FBR has no right to treat both values the same," he said.
The FBR, however, claimed that nudging notices helped increase the number of returns filed in July. A final analysis will be made after the extended filing deadline ends on August 4. In another type of nudging notice, the FBR warned that reduced-rate sales were unusually high relative to domestic sales, with many sales claimed as exempt or under reduced-rate categories instead of taxable.
"Your reported output tax is significantly lower than expected for businesses in your sector and location," the notice stated.
However, the business community argued it is unjustified to compare similar businesses without accounting for differences in efficiency, cost structures, and management. The FBR also flagged excessive refund requests stemming from high input tax claims and an unusually high number of credit and debit notes. "Please correct anomalies in your sales tax return to avoid strict enforcement actions," stated another notice. The FBR added that enforcement actions, such as posting inspectors at business sites, particularly in cement factories, have significantly improved collections despite low sales.
The FBR chairman has also transferred over 250 tax officers from grades 17 to 22 as part of a strategy to place only A and B category officers, as classified by various agencies, in key field positions.

Listen to article The government on Wednesday made it mandatory for tax officials to consult at least two representatives of the business community before initiating investigations that could lead to arrests in tax fraud cases, watering down any real chances of detaining accused individuals. In line with the understanding reached between the business community and the government, the Federal Board of Revenue (FBR) has issued a Sales Tax General Order outlining a lengthy procedure before traders or any businesspersons involved in alleged sales tax frauds can be arrested. The order states that, after concluding an inquiry in tax fraud cases, the commissioner inland revenue of the FBR "shall not give approval to initiate investigation unless he has obtained approval from the member (inland revenue operations) of the board." However, the caveat is that the FBR commissioner cannot seek the member's approval until he convinces the business community that fraud has indeed occurred and that there are sufficient grounds to justify an arrest. "Before seeking approval of the member inland revenue operations, it is binding upon the commissioner to consult with two representatives of the business community from among such representatives as notified by the board." A cursory look at the general order indicates that it will now be next to impossible for the FBR to arrest anyone, given the cumbersome process outlined. The government had obtained arrest powers for the FBR through the budget, a move that had sparked nationwide criticism. The Pakistan Peoples' Party (PPP) had equated the FBR's arrest powers with those of the National Accountability Bureau (NAB) and initially refused to support them. However, PPP later reached a compromise after the government inserted several safeguards into the law to address the concerns of its key coalition partner in the National Assembly. The government had vowed to raise Rs389 billion through enforcement measures during the current fiscal year. The FBR had been granted powers to prohibit major purchases like cars and homes, penalise cash expenses over Rs200,000, and arrest tax defaulters. However, through three different notifications issued this week, the government has diluted these punitive powers, effectively taking FBR back to square one vis-à-vis traders. This continued leniency towards traders has put the salaried class at a disadvantage. Salaried individuals paid a record Rs555 billion in taxes, whereas there are no independently verified or credible figures for income tax paid by traders during the last fiscal year. According to the new general order, the FBR "shall not initiate an inquiry unless approval from the commissioner has been obtained." Even after completing an inquiry, the commissioner cannot proceed further unless he has satisfied the business community and has obtained the necessary approval from the member inland revenue operations. The order states that various trade bodies will nominate their representatives, from which the FBR will pick two representatives for each region. Each trade body listed must nominate two individuals who "should be compliant and reasonably significant taxpayers." The member inland revenue operations will nominate two persons for each region for consultation from among those nominated by the trade organisations, based on their income tax payments for the latest tax year, export contributions, and compliance history, according to the order. The member inland revenue operations may not select more than one person from any single nominating trade organisation within a region. The FBR has listed the Pakistan Business Council, Lahore Chamber of Commerce and Industry, Federation of Pakistan Chambers of Commerce and Industry, Sialkot and Gujranwala Chambers, All Pakistan Textile Mills Association, Faisalabad Chamber of Commerce and Industry, Multan Chamber of Commerce and Industry, Islamabad Chamber of Commerce and Industry, Rawalpindi Chamber of Commerce and Industry, Overseas Investors Chamber of Commerce and Industry, Karachi Chamber of Commerce and Industry, Quetta Chamber of Commerce and Industry, Hyderabad Chamber of Commerce and Industry, and Sarhad Chamber of Commerce and Industry. Based on geographical location, the FBR will notify a two-member trader representative committee for each separate region. This week, tax authorities informed Prime Minister Shehbaz Sharif that the FBR suffered a setback due to compromises made with the business community, according to sources. After initially claiming to go after wealthy, under-taxed individuals by banning their major purchases and disallowing the treatment of large cash deposits as banking transactions, the government has now reversed course. The FBR has also amended its position on cash expenses, stating that "when a person, whether a national tax number holder or otherwise, deposits the cash against invoices in the bank account of the seller, the payment shall be treated as having taken place through banking channel and no disallowance of the expenditure will be made in this regard under this clause." The government has also decided not to immediately ban the purchase of cars, homes, plots, and investments in stocks by ineligible persons. Officials have acknowledged that this decision is a significant setback and effectively negates recent enforcement efforts, taking both the FBR and the government back to square one in their dealings with the trader community.

ISLAMABAD: The Federal Board of Revenue (FBR) has excluded recreational clubs from the definition of non-profit organisations. According to the details released by the FBR on Finance Act 2025, the clause (b) of sub-section (1) of Section 18 of the ordinance, which provides for taxability of income derived by cooperative societies from the sale of goods, immoveable property or provision of services to its members has been explained through earlier Act, to always include aforementioned incomes as chargeable to tax under the provisions of this Ordinance. FBR eases key Finance Act provisions The scope of this explanation regarding tax on income on account of sale of goods or rendering of services by cooperative societies to its members has been expanded to say that it shall mutatis mutandis apply to recreational clubs involved in similar kind of transactions with its members. The corresponding amendment has been made in clause (36) of section 2 of the Ordinance wherein those recreational clubs have been excluded from the definition of non-profit organizations which charge membership fee exceeding rupees one million for any class of new members as joining fee, FBR added.
