Brazil Supreme Court Holds Social Media Platforms Liable for User Content
Six of the 11 Supreme Court judges voted to hold platforms responsible for third-party content seen as illegal, in a decision that could result in fines against social media companies for not removing some users' posts in the country.
The decision could impact the business of platforms including Meta's Facebook and Instagram, as well as TikTok, Elon Musk's X and other internet giants, such as Alphabet's Google, in a market of more than 200 million people.
Only one justice so far voted to not change the current law on the matter, which says that the companies can only be found responsible for third-party content on their platforms if the firms do not comply with a legal decision ordering the content removal.
Writing for the majority, Justice Gilmar Mendes said current Brazilian law represents "a veil of irresponsibility for digital platforms."
"Even if they are informed of the occurrence of crimes on their platforms, they (currently) cannot be held responsible for damages caused by keeping this content online, except in the case of a court order," he said.
Asked to comment, Meta sent a 2024 statement where it had said that a decision holding platforms responsible could make them "liable for virtually all types of content even without having been notified."
In a statement sent before the vote which gave the court a majority, Google said the current Brazilian law regarding social media can and should be improved, "as long as procedure guarantees and criteria are set to prevent legal uncertainty and the indiscriminate content removal."
TikTok and a representative of X in Brazil did not immediately respond to requests for comment.
The court did not agree on the scope of the decision, such as what types of content would be considered illegal. The court's head, Luis Roberto Barroso, said he will work with the court members to find a consensus.
Four judges still need to vote in the trial, which has been rolling over for months. Votes previously cast can still be changed, although that is not common. The trial is set to resume on Thursday.

Brazilian Supreme Court Justice Alexandre de Moraes has ratcheted up restraining orders against former President Jair Bolsonaro during his trial for an alleged 2022 coup plot. Trump demanded an end to the case that he calls a "witch hunt" as he slapped a 50% tariff on Brazilian goods and hit Moraes with financial sanctions that are putting Brazil's banks on edge. Despite fears of a spiraling crisis for bilateral relations, the judge expressed confidence in a late Tuesday interview at his Brasilia office that sanctions would be unwound against him via diplomatic channels or an eventual challenge in U.S. courts. "A judicial challenge is possible and I have not yet found a U.S. or Brazilian lawyer or scholar who doubts the courts would overturn. But at this moment, I've chosen to wait. That's my choice. It's a diplomatic matter for the country," said Moraes. The standoff with Trump is the highest-profile test yet for the 56-year-old jurist, whose bald visage and muscular frame have come to define the Brazilian high court he joined eight years ago. He has taken the lead on many of the court's most prominent cases, cowing Elon Musk in a showdown over his social media platform, sending hundreds of right-wing rioters in the capital to prison and barring Bolsonaro from running for office. Navigating the U.S. crackdown on his personal finances and bilateral trade with Brazil has done little to change his routine, he said, which includes boxing, martial arts and a new favorite book: Henry Kissinger's "Leadership," the late U.S. diplomat's final volume on 20th century statecraft. Moraes said he trusts diplomacy will restore his standing in Washington. He said prosecutors blamed the current fallout on a campaign by allies of Bolsonaro, including the former president's lawmaker son Eduardo, who is in the U.S. and under investigation in Brazil for courting Trump's intervention in his father's case. "Once the correct information has been passed along, as is being done now, and the documented information reaches the U.S. authorities, I believe it won't even require any legal action to reverse (the sanctions). I believe that the U.S. executive branch itself, the president, will reverse them," Moraes said. Pressed on the reason for that confidence, Moraes said he was aware of internal divisions in the U.S. government that had slowed the sanctions and could still undermine them. "There was reluctance in the State Department and great reluctance in the Treasury Department," he said, without elaborating or explaining how he received that information. A State Department official with knowledge of the matter told Reuters separately that the sanctions against Moraes had faced substantial pushback from career officials. The actions against Moraes were "completely, legally inappropriate," said the source on condition of anonymity, adding that officials from the Treasury's Office of Foreign Assets Control had initially said no but were overruled. A Treasury spokesperson said: "The Treasury Department and Office of Foreign Assets Control, along with the entire Trump administration, is in lockstep that Alexandre de Moraes has engaged in serious human rights abuse. Rather than concocting a fantasy fiction, de Moraes should stop carrying out arbitrary detentions and politicized prosecutions." The U.S. State Department did not immediately respond to a request for comment. Brazilian courts could punish Brazilian financial institutions for seizing or blocking domestic assets in response to U.S. orders, Moraes also said in the interview. Verify social media content authenticity, Fahmi warns Malaysians
KUALA LUMPUR: Communications Minister Datuk Fahmi Fadzil expressed serious concern about netizens accepting social media information without verification. He emphasised this tendency makes people vulnerable to scams and misinformation campaigns. Fahmi highlighted the critical difference between social media content and professionally vetted mainstream media reports. He stated mainstream media upholds strict journalistic ethics and integrity standards. We are seeing a trend where many netizens believe everything they see online, Fahmi told the Dewan Rakyat. He explained some individuals even fall victim to sophisticated scams involving artificial intelligence like deepfakes. For instance, some believed claims of a cable car service in Perak, the minister revealed. He also cited the widely circulated false allegation that Zara Qairina died after being put into a washing machine. Fahmi described another case involving a so-called pathologist on TikTok livestreams claiming to be an expert. Checks with the Health Ministry revealed he was not a doctor, Fahmi informed the house. He added authorities confirmed the individual had a known history of scams. Fahmi further noted the Sabah Journalist Association criticised influencers swarming a press conference. These influencers behaved as if they were professional reporters at the event concerning Zara Qairina's death. They asked questions, but their intention was to create content for personal gain, he asserted. Fahmi pointed out that viral views generate significant financial returns for these creators. He lamented that integrity and factual verification were completely ignored in the process. To counter this issue, Fahmi announced a mobilisation of government communication channels. The Information Department, Bernama, and the Broadcasting Department will produce public education content. This initiative aims to help the public understand that not everything on social media is true. On a separate matter, Fahmi addressed the case of five teenagers charged in Kota Kinabalu. He stressed their identities are protected under Section 15 of the Child Act 2001. This is not due to any directive but is required under existing law, Fahmi clarified. Any case involving children under 18 automatically falls under the Child Act, he concluded.
